Delays possible as judge in Markeith Loyd's murder case set to retire (with clip)

Mar 22, 2019

"ORLANDO, Fla. - The case against accused cop killer Markeith Loyd has dragged on for more than two years. Now the judge and one of the prosecutors say they're ready to retire.

This could mean more delays, and it seems increasingly unlikely that we'll see a trial in May....

Loyd's lawyer also revealed some of his defense strategy, saying, “You've got to remember, race is a huge issue with Mr. Loyd.” He believes in his mind that he was mistreated racially his entire life, and he talks about that on his Facebook page.

He talks about the white man and the white devil."

Jury to be sequestered in trial of accused cop killer (with clip)

Apr 17, 2019

"..."A sequestered jury is extraordinarily unusual, but in a case like this of a high profile nature, it kind of make sense to do it this way," said criminal defense attorney Mark O'Mara, who defended George Zimmerman in the last high profile case in Central Florida in which a jury sequestered.

"We had not only a sequestered jury, but an anonymous jury, slightly different. Sequestered meant they had to stay in the same place, anonymous means nobody knew who they were," he said.

For more than three and a half weeks, the jury of six, plus three alternates, were sequestered until they deliberated.
"I wanted a sequestered jury because there was so much pressure about this case, we had a media city outside of the courthouse," O'Mara said...."

State Attorney Aramis Ayala struck from witness list in Markeith Loyd case (with clip)

May 16, 2019

"ORLANDO, Fla. - Accused killer Markeith Loyd and his attorneys were in court Thursday, fighting to have State Attorney Aramis Ayala on their witness list....

The judge denied the defense’s request Thursday and Ayala was struck from the witness list.

In 2017, Ayala refused to seek the death penalty in the case.

Gov. Rick Scott pulled Ayala after she made her death penalty decision.

The defense claimed the jury should know about the specific reasons that Ayala had to refuse the death penalty in Loyd’s case.

But the prosecution said they did not see the value in her testimony....

A trial date is set for September...."

A request to access documents and evidence related to Loyd's capture will be revisited at a later date when the excessive force investigation is completed by Aug. 1....

In new motion, Markeith Loyd claims he shouldn't be charged with death of unborn child (with clip)

Jun 4, 2019

"ORANGE COUNTY, Fla. - Accused cop killer Markeith Loyd claims he cannot be charged with murder for the death of his ex-girlfriend's unborn child....

Loyd's defense attorneys said state lawmakers have no right to say killing an unborn baby equals murder and are asking a judge to drop that charge from the case.

"There's a legion of cases to support the state's position that they are entitled to charge Markeith Loyd with the death of that unborn child," said Channel 9 legal analyst Bill Sheaffer.

Markeith Loyd Attorneys: Keep OPD Slaying Out of Sade Dixon Trial

Jun. 05, 2019

"ORLANDO, Fla. — Markeith Loyd is facing two separate murder trials: one for the death of ex-girlfriend Sade Dixon, and one for the death of Orlando Police Lt. Debra Clayton.

His attorneys want evidence and witnesses tied to those two trials kept separate.

Defense attorneys and prosecutors argued the issue before a judge Wednesday in Orlando....

Witnesses took the stand in relation to both cases, including lead investigators and two witnesses who say they saw Loyd and Clayton at an Orlando Walmart where Clayton was slain.

Prosecutors told the judge video and witness evidence about his alleged killing of Clayton was important to proving Loyd's motives. ...

They also showed video from surveillance cameras showing the moment Loyd allegedly continued to shoot Lt. Clayton after she had fallen.

Although prosecutors say the testimony and evidence helps prove Loyd’s guilt in Dixon’s killing because of his efforts to get away from law enforcement, his defense attorneys claim it has nothing to do with that case and will only taint the jury.

Judge Leticia Marques agreed with Loyd’s defense attorneys on one point and ruled the video of Clayton being shot will not be let into Dixon’s trial.

But she’s still deciding whether to allow the witness testimony and other evidence, like the shell casings from the scene, in the Dixon trial...."

Woman recalls moment she saw Markeith Loyd inside Walmart, notifying Debra Clayton
'I was a little nervous and was anxious to get outside,' Takeshia Bryant said

June 05, 2019

"ORLANDO, Fla. - The Supreme Court's landmark Roe v. Wade ruling was expected to be cited Wednesday during a hearing for Markeith Loyd, who is accused of shooting and killing his pregnant ex-girlfriend and an Orlando police officer....

Attorneys representing Loyd, who faces two upcoming murder trials, recently filed new motions, again asking a judge to remove the death penalty as Loyd's possible punishment. The judge denied a similar motion last month.
During Wednesday's hearing, Loyd’s defense said multiple times, “The state is going to kill someone.”

At that time, the judge ruled that the defense can not call the state or state attorneys “killers” for wanting the death penalty for Loyd.

Another motion brought up at the hearing was the use of biblical references during the trial.

“I’m not going to be preaching religion but there are decisions we make based on morals,” Loyd's defense said when considering the death penalty.

The judge granted the motion to not use biblical references during trial: “Quoting the Bible is not allowed.”

The state’s first witness in the hearing was an Orange County Sheriff’s Office detective who was the lead homicide investigator in the case.

The second witness called to testify was Takeshia Bryant, who was inside Walmart with her son when she recognized Loyd....

The state called one final witness to the stand, Peter Cadiz, who is an Orlando police officer and was the lead investigator for Clayton's death....

Below is a look at the events that led to that search and what has unfolded since it began. Please note that some times are approximate...."

New transcripts contradict Markeith Loyd's longstanding claims of self-defense (with clip)

Jun 26, 2019

"ORANGE COUNTY, Fla. - New transcripts paint a picture of Markeith Loyd's pregnant ex-girlfriend fearing for her safety and trying to flee back into her home the night she was shot.

Sade Dixon's brother told Loyd's lawyer in a deposition that she attempted to run back into the home, but that the door was locked, contradicting Loyd's long-standing claims of self-defense.

It was known for months that Loyd was arguing with Dixon over whether she was smoking marijuana while pregnant with his child, but newly released records from the investigation reveal she told at least one of her siblings that Loyd had been physically abusive in the months leading up to her slaying.,,,"

Jurors in Markeith Loyd’s 1st trial can be told he shot Debra Clayton — but not that she died, judge rules

JUL 24, 2019

"When Markeith Loyd goes on trial in the slaying of his pregnant ex-girlfriend, jurors will learn that Loyd is also accused of shooting Orlando police Lt. Debra Clayton to avoid capture.

But they will not be told that Clayton died in the shootout, Circuit Judge Leticia J. Marques ruled Tuesday....

“The fact that she died is not relevant to any material issue in [the case of Dixon’s killing],” Marques wrote in her ruling. “The fact that [Loyd] shot Debra Clayton to avoid arrest for Ms. Dixon’s shooting and then ran is all the State needs to establish. Introducing Debra Clayton’s death is unnecessary and the prejudicial impact would outweigh the probative value of the evidence.”

Marques ruled that jurors in the Dixon case will also not be allowed to hear Clayton’s radio transmissions or see surveillance footage that authorities have said recorded the officer’s killing.

However, prosecutors will be allowed to introduce evidence that the same gun was used to shoot Dixon and Clayton, and that Loyd had that gun when he was arrested later. Jurors can also hear testimony about the moments leading up to Clayton’s shooting, Marques ruled.

Loyd faces the possibility of the death penalty in both killings.

His trial in Clayton’s slaying is currently expected in May."

Markeith Loyd seeks to combine murder trials, delay trial start to April
Loyd accused of killing Sade Dixon, OPD Lt. Debra Clayton

August 02, 2019

"ORLANDO, Fla. - Attorneys for the Orlando man accused of killing his pregnant ex-girlfriend and an Orlando police lieutenant are asking that his separate murder trials be combined, according to a motion filed Friday with the Ninth Judicial Circuit Court.

Currently, Markeith Loyd is set to have separate murder trials in the deaths of Sade Dixon and Orlando police Lt. Debra Clayton. The trial connected with Dixon's death is scheduled to begin in September. Loyd's second trial is scheduled for May 2020....

A motion filed Friday afternoon by Loyd's defense attorney asks the court to consolidate both cases. Loyd's attorneys say that because evidence will be presented in the first trial to show that Loyd allegedly shot Clayton with the same weapon Dixon was killed with, he would have to defend against Clayton's homicide twice, according to the motion, because the lieutenant's death was widely reported in the news media.

That motion was one of three filed Friday by Loyd's attorney, Terry Lenamon, who specializes in death penalty defense.

The second motion asked the judge to strike testimony given recently during the hearing to establish whether the state can present evidence during Dixon's muder trial about Clayton's shooting....

The third motion asks the court to move Loyd's September trial date for the charges related to Dixon's death to April 2020."

Markeith Loyd rants in the courtroom, claims deceased ex-girlfriend set him up (with clip)

Aug 13 2019

"ORLANDO, Fla. (FOX 35 ORLANDO) - Accused killer Markeith Loyd appeared in court on Tuesday afternoon....

n court, Loyd went on a rant where admitted that he understands anything he says can be used against him at trial.
"From the very beginning, they've been reporting lies," Loyd said on the record in open court. "I tried to turn myself in three different times after the situation, and you see the results of the third time."

Loyd was referring to the night he was captured after running from police for weeks. Investigators say Loyd's eye was injured, when he refused to obey commands.

Attorneys were scheduled to argue whether the two murder cases the state has against Loyd should be tried together, which is what the defense prefers. However, before that could even be discussed, Loyd's attorney filed a motion in open court, asking the judge for Loyd to undergo a competency examination. Attorney Terence Lenamon told the court that he thought one was necessary after a discussion he had at the jail with Loyd on Monday. Loyd made it clear, he is not on board.

"I ain't talking to anybody! I ain't crazy!" Loyd said. ...

For now, the proceedings are on hold until a doctor rules whether Loyd is competent to proceed with his cases. The first trial is set for September."

Markeith Loyd rants in the courtroom, claims deceased ex-girlfriend set him up

(sound is bad)

Loyd is certainly a narcissistic and classic sociopath. He doesn't recognize authority because he needs to always be in control. He talks incessantly so others can't talk, and then expects everyone to accept all that he says as fact. The mental eval is necessary, IMO, but will be interesting.

Sade's poor family, having to listen to Loyd's rant... especially when he tried to place the blame on Sade for what happened to her. Loyd will never accept responsibility for his actions. Someone else is always to blame. smh

Questions about accused cop killer's mental competency could delay trial

Aug 13, 2019

"ORANGE COUNTY, Fla. - Justice for the victims of an accused cop killer may yet again be delayed after questions have arisen over his mental competency.

Markeith Loyd's latest courtroom outburst brings about an automatic delay just as Loyd's lawyers were fighting for a delay in his trial for the murder of Sade Dixon, Loyd's pregnant ex-girlfriend....

Channel 9 legal analyst Bill Sheaffer said that while these outbursts can delay the start of the trial, it may not matter.
"All the psychologist is interested in is whether or not the defendant understands the nature of the proceedings, the charges against him and whether he can communicate rationally with his lawyer," said Sheaffer. "There is so much evidence that's not going anywhere, whether it's tried today or two years from now, they'll get it to trial, same evidence."

Questions remain if Loyd may legitimately have mental issues or if he's just gaming the system.

The judge gave no deadline for when this evaluation is to be completed...."

Sade Dixon's family is still waiting on justice more than 2 years later

Aug 13, 2019

"ORLANDO, Fla. - Almost three years after 24-year-old Sade Dixon was fatally shot outside her parents’ home, her family is still waiting for justice....

Currently, Loyd is set to have separate murder trials in the deaths of Dixon and Clayton. The trial in Dixon's death is scheduled to begin in September. Loyd's second trial is scheduled for May 2020.

Loyd faces the death penalty if convicted on either first-degree murder charge.

Loyd’s defense team is attempting to combine the trials, which Dixon’s family said they are against.

"Both families need justice, but our daughter deserves justice as well - separately from the Clayton case, because they were two separate cases," said Dixon’s father, Ron Daniels....

Dixon's parents never looked at Loyd during the hearing and were disappointed with the outcome.

"It was a full circus. He knows what he’s doing," Dixon’s mother, Stephanie Dixon Daniels, said. "As far as I’m concerned, he knows what he did and he knows the truth." ...

Loyd will be evaluated by a doctor to determine if he is competent to stand trail on first-degree murder charges. Dixon’s family knows this could mean another delay in justice.

"We understand you have to go through the process, and this process has been super long," Daniels said."
