Just a theory about how it could have been accidental, and please bear with me since this is a true story that happened to me and my son over 10 years ago.
I was an apt. manager for a large complex and lived across the lot from my office. My son was 4 months, and my daughter was 3. I had a 17 yr old babysit, and would come over and check them on lunch and breaks.I had a strict rule for NO BATHS, but to call me if they got too dirty to wipe up.
The day "it" happened, I had started my morning normal, and while leaving to my office, I mentioned how excited I was that Alex had his first "big boy bath" in the tub with his sister in one of those rings that suction to the bottom.She told me later that she thought it was ok since he 'graduated' to the big tub. Evidently, the sitter forgot to gather towels before, and left to get them. In that time, my oldest got out, my baby's bath ring came un-suctioned, and he went face first in the water for 1-3 minutes. Needless to say, I got a phone call phantically yelling "HE'S BLUE!!"
I can still remember running as if I was floating and got to him in time. Thank God I knew infant CPR, but the young girl was ignorant to the fact that you NEVER leave a baby unattended. I called 911 and after a night in the hospital, he is fine 10 years later.
The reason i decided to share this is that maybe it WAS an accident. LE is usually gung-ho on prosecuting a baby death, let alone one with a drug-addicted mom.I am in NO WAY condoning what happened to Trenton, just trying to make some sense of why they ruled it an accident.
