Judge and attorneys will now hold a hearing about defense attorney Jeff Deen dealing with Toledo's interview from Oct. 26

In the transcript Toledo is talking about gator pit in Sanford. Deen says he believes the conversation is that the bodies may be there

Deen says there are no gator pits. Judge Zambrano says "This is Florida every pond is a gator pit.

Toledo told investigators that Tyshawn Jackson disposed of the bodies in gator pits. #luistoledo

Investigators don't believe that Jackson had anything to do with the killings and he has not been charged #luistoledo

Toledo's attorney, Jeff Deen, wants the comments about gator pits stricken from the video and transcript #luistoledo

Why is the defense trying to keep out the portion of the video of the defendant stating that Tyshawn Jackson disposed of the bodies in a gator pit?

Because at this point it's obvious that TJ was not involved but the fact that LT had a conversation stating he knew they were all deceased and disposed of in a gator pit is more evidence that they likely are deceased?

Prosecutor Ryan Will is now going to play a recording which defense objects to, so the judge may rule on that.

Ha...the defense is not winning many arguments now. They won enough during the pre trial hearings IMO.

Prosecutors playing video which showed Toledo getting up in interview room and entering another room.

Only an empty room is visible on the scream but the sounds of banging and screaming can be heard coming from off camera #luistoledo

The defense attorneys are now meeting to go over issues they are objecting to

Deen objects that state has not made a predicate, has not shown it's relevant

Deen said that state would have to argue the attempted suicide is relevant because it shows consciousness of guilt

Deen is saying that flight tends to neither prove guilt or innocence and neither does suicide #luistoledo

Deen #luistoledo is allowed to show grief if he did there's no showing of consciousness of guilt #luistoledo

Prosecutor Will's turn. Will said prior to attempt Toledo had denied knowning where his wife was and then was confronted with evidence

Will said Toledo then admitted to killing his wife but blamed neighbor for killing the children

Will said Toledo asked to use bathroom three different times and during second trip he tells a deputy to come with him #luistoledo

A deputy will testify that Toledo told him "I'll never tell you where the bodies are" but it was not recorded #luistoledo

Will said that on next trip to bathroom Toledo apparently breaks glass in bathroom

Will said deputies grabbed a Taser and a battering ram and broke down the door and dragged #luistoledo out

Will said deputies were yelling at #luistoledo to tell them where the bodies are and Toledo was yelling for them to let him die

Will said #luistoledo had already confessed to one murder and there is sufficient nexus to show consciousness of guilt with att. suicide

Deen says police are reacting to what #luistoledo has done and that's not evidence of consciousness of guilt

Judge Zambrano says he believes there is sufficient nexus. #luistoledo had already admitted to killing wife by the time of attempted suicide

Judge Zambrano said he will allow the recording of #luistoledo 's attempted suicide

***I like this judge. No nonsense and runs a tight courtroom. He doesn't even pretend he's going to think things over. He is confident in his judgments and makes most of them on the spot.

They probably thought it was a slam dunk that they could argue to keep it out. Or that the judge would take some time to make his decision which would give them more time to go over it and file some motions.

I thought the same thing about the questioning of Tyshawn Jackson. A very important witness. They should have been prepared to grill him when the prosecution had him on the stand. Now they may have to call him as a witness which would mean they are putting on a defense. Not to mention the hint that LT may testify. Which changes the order of the closing statements doesn't it? I get confused, I know it's that way up here in Canada. :waitasec:

Yes. She filed for an injunction saying she'd had more than 50 threatening messages. The judge didn't grant it.

Court records obtained by the Orlando Sentinel reportedly indicate that Toledo’s sister-in-law, Kimberly LaSanta, had sought a domestic-violence injunction against him last year after he allegedly sent her more than 50 threatening text messages in a two-day period.
“He has threatened to take my kids, send someone to come in my house and hurt me,” LaSanta wrote in her court petition. “He threatened to put me in jail and hurt me. I have saved all 54 text messages for the judge to see. I am in fear of this man.”
For reasons not yet clear, the request was denied by a judge.
