Casey Defense Wants Judge Disqualified
Defense Files Motion Alleging Judge Had Inappropriate Relationship

In the motion, Anthony's defense team alleged that Judge Stan Strickland struck up an inappropriate relationship with a blogger known as "Marinade Dave."

"The defendant, Casey Marie Anthony, reasonably fears that she will not receive a fair trial because of the conduct and apparent prejudice and bias of the judge," the motion said.

The motion alleges that Strickland contacted "Marinade Dave" through his blog and eventually by phone, but did not disclose the relationship to the defense.

According to the defense, "Marinade Dave" has blogged about the murder case against Anthony on several occasions, including blogs titled "Casey Anthony must die!" and "Caylee's murder: Premeditated and pretty stupid, too."

A young woman who was one of Casey Anthony's jailhouse friends spoke exclusively to WFTV on Friday in her first one-on-one interview. She said Casey described how she used to knock her daughter Caylee out with chloroform.

&#8220;She would pour it on, like, a rag, like, a wash rag, and put it on the baby's face,&#8221; 21-year-old Maya Derkovic told WFTV reporter Kathi Belich.

Derkovic is a convicted killer. She said she met Casey in the Orange County jail. Derkovic reported details of her whispered conversations with Casey to detectives; the two used to talk in the jail through an air vent.

Derkovic said she called investigators around Thanksgiving last year, because &#8220;it was the right thing to do&#8221; concerning the murder of a child. She insists she has no intention of asking for time off her 30-year sentence.

Do you think Baez called first to make sure Strickland was gone for the day before filing? LOL, J/K

Thank you for publishing that motion, Angel. I have now read the motion, quite detailed. I see the imprint of Mr. Cheney Mason in this move and in the research that led to it too.

This is SO drastic!
 
Submitting an assessment like this, condemning the judge's conduct, does have repercussions too. Note that the House of the judge, 10., is at the degree of the nodes, thus tragic disparagement. Mercury, which rules this motion project, is going to turn backward tomorrow and as it retrogrades, it will square Mars revealing this as a bad misstep. The motion hits on the raw. Does Defense really imagine that Judge Strickland is unaware of ethics and codes of conduct, lines that must not be crossed? He could actually lay such lines himself! This is an insult.

Having said THAT and although I do completely agree that it is a HUGE insult, I am fearful that this insult has enough steam to pull this train all the way into the station. It's in the wording of the statutes...and how things may be perceived by the MOVANT (KC)...so I am asking-
Will the Honorable Judge Strickland step down, remove himself, and open the way for another, perhaps LESS lenient and considerate to take his place?
 
I remember when this blogger was in the courtroom, and after the proceedings, Judge Strickland asked someone to tell the man to step forward. Judge and Blogger spoke and people were curious. Then we found out later it was the blogger and the conversation was revealed. The defense team didn't squawk then, back in October, so why now? If there was a problem, shouldn't a motion have been filed immediately?

Just read all the papers filed. So many pages! :eek: So this is what the defense does all day, reading online blogs.

But of course, the protest should have been filed timely. Many rulings and decisions have been handed down since October. Way back in 2008, perhaps Lee, perhaps someone else relayed the opinion from Jose Baez that Judge Strickland was the fairest and best judge Prisoner could have drawn~that The Team was fortunate and so was she. Further, Judge Strickland never complained to the bar about Jose Baez, he passed on a complaint made against Baez, as the law required him to do.

When this latest motion was filed, the Sun (which defines what the event is about) was on a degree of crisis. The moving party was driven by inner compulsion to a startling, jarring extreme. This rocked the case like nothing else could. Critical Sun obstructs in stubborn resolve and in a Fixed Sign conjunct a Cadent House, Mercury puts this forth in desperation when all hope for overall success is gone. But now she has done it and it has made its impact just as though she had pressed her handprint in wet cement, because she is found in Fixed Taurus, and she has set off a chain of reactions. There will be a change now in the homicide case, Sun in H. 8, but Sun ruling H. 12, this is self-damaging, she undoes herself by this act (not for the first time, of course).

Common Signs hold all the angles, so some alteration is sure and recusal is a distinct possibility but not probable because these Common or Mutable Signs can be persuaded by others & by circumstance and Mercury was about to change her mind even as she filed this drastic protest crying foul.

I am SO glad you mentioned that. Each time Baez says this, I shout back at him, "She killed Caylee". Or more accurately, she murdered Caylee. The Team is unbelievable and I can't believe the justice system is walking on eggshells for the likes of "Ms Anthony", which also inflames me. :furious:
 
Don't know if this matters but on page 4 of the motion where CM notarizes the document.....his notary stamp expired November 20, 2009.
 
Old stamp. He should have crossed out the date and put in the new one, or he could have purchased a new stamp. Bet he was thinking why bother getting a new stamp, I'm retiring.

I don't think so. I'm a notary and if I did not have my stamp I could handwrite out the date of expiration. He just overlooked the date.

He is licensed. He just used the wrong stamp or didn't bother to get a new stamp. Should have figured...pretty much standard for this group. Their motions are always full of clerical errors.
 
My own view of Judge Strickland's blog reading is that this was done as part of his appraisal & assessment of Defense ability to obtain a fair trial in Orange County for the prisoner in light of their desire to change venue. He would also, as any normal person, find interest in what is written about the case in some blogs and find boredom in others.

Mr. Mason and the prisoner, however, have concluded scanning the blogs to be solicitation and courtship. Those are the semantically colored terms used over and over in their motion. If you walk down your block and stop to look at a house, maybe even take a picture of it, this then proves you are seeking to snap the house up in a foreclosure auction or proves that you want your photos published in the newspaper because you seek fame or proves that you are going to report the homeowner to the Planning Department.

In sum, the motion proves nothing and draws spurious and tendentious conclusions from ephemera. The prisoner is frightened by opinions voiced in Dave's blog and the fear then pervades her waking thoughts, affecting her ability to be the reasonable person required by the recusal statute; she immediately attributes those opinions to the judge. She would do this no matter who the judge, just as she attibutes evil opinions to the manyheaded. We have heard her do that on multiple occasions.

It often seems the defense is led by caprice. Samuel Johnson said, "Being in a ship is like being in jail, with the chance of being drowned." The prisoner is drowning in her own paranoia, so it is very like indeed.
 
Talk about "being your own worst enemy" Maybe we won't even need a trial the way the defense and the prisoner are going. I say let them keep digging "her grave"

I am wondering if there is any way to tell if the Defense truly want this motion to pass or if they just wanted the media hype from it? I ask because on the 04/12 and 04/14 Notices of Provision of Supplemental Discovery were filed. Then 2 days later on 04/16 we have this motion filed at just before the close of business on Friday. (BTW, the motion was given to the media hours before it was filed with the court.) Anytime something damaging is coming out in discovery, the defense tends to try to cause distractions with something else. Any way to tell if there was anything damaging in the discovery that was recently handed over?

Casey's Defense Refiles Motion After Notary Error

ORLANDO, Fla. -- Less than a day after Eyewitness News discovered there was a problem with a motion in the Casey Anthony case, her defense team filed a new version.

On the motion they had originally filed, seeking a disqualification of Judge Stan Strickland, at the bottom of the motion (read that version), Anthony's newest lawyer, J. Cheney Mason, notarized it himself; but an inspection of the notary seal shows Mason's certification as a notary expired in November 2009.

WFTV talked to legal analyst Bill Sheaffer Sunday. He said the fact that it's expired could be seen as a defect and an opening for a judge to deny the motion; however, the defense would be free to re-file the motion with new notarization.

That's exactly what the defense did, with a new motion being filed Monday afternoon.


My comment...of course this is the unstamped version so it would appear this went out to the media before it went to the court....AGAIN.
