DORML may be her address but the prisoner is not staying in a dorm, it is pure and simply a well stocked jail that provides corrections personnel with a 360° view of inmates from a central control and an intercom master station. The cameras monitoring jailed women and surveilling activity inside the facility are here, there and everywhere and they are resistant to blows, bullets and disabling. The jail is equipped with audio devices. Other tracking mechanisms are in place as well, some of the scans more invasive than capture on a video. But they are not invasive of privacy rights because those are lost at entry. There is no expectation of privacy in a jail. Visits are surveilled and all mail is subject to search, justified in part by the possibility of drugs, *advertiser censored*, cell phones and other contraband like that old standard, The File.
The reality is that no matter where Prisoner saw the telecast, even on the floor of DORML-12 where inmates watch t.v. together, her reaction to the news of a discovery on Suburban Drive would have been seen, monitored and recorded. The present defense motion cites a 1985 case, Maine v. Moulton, "The Sixth Amendment is violated when government either knowingly exploits or intentionally creates an opportunity to confront defendant without counsel." But the confrontation in the common room of the infirmary was not between accused and a state agent, her confrontation was with the actuality she was witnessing on television.
