'He was just running': Travis McMicheal testifies about Ahmaud Arbery

5 minute chase - damaging testimony

McMichael’s testimony was a gamble — not because he’d have a chance to explain to the almost entirely white jury what happened that day, as he did Wednesday, but because it offered an opportunity to cross-examine him. And prosecutor Linda Dunikoski extracted the potentially damaging admission during Thursday morning’s testimony.

Dunikoski directed Travis McMichael's attention to the pursuit of Arbery that he and his father, Gregory McMichael, initiated after his dad saw Arbery running past their home on Feb. 23, 2020, causing them both to grab their guns.

During his direct testimony on Wednesday, Travis McMichael testified that he walked out of his house with his shotgun and saw a neighbor pointing in his direction as if signaling where he saw the young Black man running.

Travis McMichael testified on Thursday that at no time did he go and speak to the neighbor about what had occurred before he and his father jumped in his truck with their guns and set out after Arbery.

He testified that he drove close enough to Arbery on three separate occasions to ask him to stop running so he could speak to him, but in each instance, Arbery kept running, never said a word to him and altered his course in an apparent attempt to get away from the McMichaels.

"When you first see him, he's not reaching into his pockets?" Dunikoski asked.

Travis McMichael answered, "No, ma'am."

Dunikoski continued her line of questioning, saying, "And he never yelled at you guys, never threatened you at all?"

Travis McMichael responded, "Did not threaten me verbally."

He agreed that Arbery never brandished a knife, gun, or had anything in his hands at any time during the pursuit, testifying, "He was just running."

On the English house "break-ins," Lawrence says she doesn't think there were even doors or windows on it. She says she's been on a boat ride with the Perezes, and Greg & Leigh McMichael after the #AhmaudArbery homicide.

Day of #AhmaudArbery shooting she & Brook Perez walked over to see what was going on. Lawrence says she and Leigh McMichael are colleagues at the same hospital. Don't chat, but "Friendly." As for boat, "Brook & Diego invited me & I'm not going to turn down a boat ride."

Lawrence didn't know #AhmaudArbery and never heard his name before this. About the 2 guys with flashlights: They were police officers. She never saw trespassers on her camera? Correct. Just people looking for somebody.

Lawrence has never seen a trespasser on her camera, ever. Isn't sure she's ever personally seen anyone's surveillance video. Her mom's car was rummaged through. It was unlocked. Still unnerving. Didn't call 911.

Camarillo asks about convo b/t Lawrence & Travis McMichael after #AhmaudArbery's shooting. He told her there was a video he & his dad were planning on "leaking." She agreed to share it when it was. To get out the neighborhood's version of past events & what led to this

Several neighbors had seen the #AhmaudArbery video? They showed her. "You've seen it?" Lawrence says yes. At that point nobody knew they'd engaged in a full-on chase thru the neighborhood? "I don't know what everyone knew." Did they tell you they chased or followed him?

Lawrence says, Correct, Greg & Travis McMichael had never told her they'd engaged in a chase of #AhmaudArbery. She didn't talk to anyone else about a "chase." "I didn't know there was a chase."

State: At some point after the homicide, Travis McMichael asked you to admit him to the FB page under the name "Travis Hathner (?)". Lawrence says his page had been hacked. To monitor what was going on under this fake name? Look at what people were saying? "Right."

Lawrence says she was willing to put Travis McMichael on neighborhood FB page under fake name because "I believed the account of the events as they were told to me by the family. I didn't see a reason he shouldn't have access to what people were thinking."

Laura Hogue says since defense of Greg & Travis McMichael has been joint in any ways, before there's any resting that goes on, she wants to perfect the record re: new evidence of mental health, #AhmaudArbery probation, & use of force expert--all prohibited by judge.

Hogue says you now have testimony from Travis McMichael that are consistent from the Gateway records and would be corroborated by our mental health expert.

There was someone who brought a bottle of water and poured it so Greg McMichael could rinse Ahmaud Arbery's blood off of his hands. And the officer said, "We have some wipes coming." We saw both those things on the bodycam. Here's the water-pouring.

Anyone know if the McMichaels' & Bryan have different lawyers for their Federal cases? Could they all be at the Federal hearing that is scheduled for today? I'm going to go ahead & post this - just in case it IS happening...

Therefore, attorneys asked the judge to extend the deadline for pretrial motions. The judge said he will consider the request, but doesn't want to move the actual trial date, which is set for February of next year. The judge said he will issue a written scheduling order in the next day or two, and also wants to schedule another status conference.

It sounds from Travis's testimony that he and dad were harassing Arbery. Seriously harassing him. Then they escalated the harassment into torment with dad threatening to blow his head off and Travis geting out and pulling a rifle on him.

Arbery tried to disarm his tormentor. His tormentor shot him 3x's.

The sleepy juror was likely wide awake for this.

After watching the defense's case in chief the last two days, other than Travis McMichael on the stand, I was underwhelmed and thought their case was very weak. I was left thinking, "I understand what they are doing with these witnesses, but they really aren't making a persuasive argument for me."
 
Has anyone else heard anything about the state saying no to a plea deal from W”R”B’s attorney
 
It is amazing to me that they keep saying what Mr. Arbery should have done. You are right. Mr. Arbery had no where to go. Even if he did, he would have been smart to calculate that if these animals were hunting him that he would surely be fired up for trespassing on another person's property. I like that the prosecution isn't going to the point by point response but rather focusing on the words of these criminals. It is a losing proposition to begin to legitimize their faulty thinking. The jury could be swayed if they think the pros didn't address the position fully if they tackle the topic. I thought the pros team was brilliant today in their stepping TM through the idea that Mr. Arbery was just running, never threatening, not the aggressor with an invisible finger pointing to TM as the aggressor.
AA looked like a hunted animal with GM riding in the back of the truck with a gun.
 
Lawyers for one of the defendants in the trial of the killing of Ahmaud Arbery have asked prosecutors for a plea deal, Arbery family attorney Lee Merritt told CBS News. Merritt said the prosecution "turned it down — flat out."

The request came from attorneys for William "Roddie" Bryan — the man who admitted to pursuing and boxing in Arbery with his vehicle and filmed the fatal shooting in Brunswick, Georgia last year, Merritt said.

Merritt told CBS News he believes the request means Bryan is "concerned about the strength of the state's case."

HLN is talking about it right now. Gough is claiming that the request for a plea deal is BS.
 
I was watching the video again of the shooting and I had this thought:

AA can be see running and the white truck was stopped on the road, with TM outside of the vehicle and GM in the bed of the truck. TM is armed. AA sees this and he decides to go around the other side of the truck to get away from TM. I believe that AA thought that TM was following him around the truck which is why when AA cleared the front of the truck, he turned left instead of right, or continued straight.

Kevin Gough says the jury needs to know that #AhmaudArbery had a 'last clear chance' to avoid William Bryan's truck, that he didn't exercise, and that his client can't be held responsible for that. State says Arbery had no duty to retreat

“There is no duty to retreat. The victim of a crime is the victim of a crime, and to allege that the victim contributed to his own victimization by not avoiding the criminals enough-- that's not the law, your honor."
