I think this is going to be a hung jury. Would like to find out if that one juror made it on the final jury.

Me too, can't believe the judge didn't bounce that juror like a hot check.
 
With so many of the victims putting up a fight I'm surprised Mrs. Orlinski didn't hear anything, she had no problem hearing GH yell when he discovered them that morning, it seems (from what we've read).

Did the prosecution say GH had no mj in his system when tested?

He tested positive for that.

I think she said she heard a dog barking but didn't know who's dog it was .

The jury in Guy Heinze Jr.'s death penalty murder trial will reconvene about 7:15 p.m. to tell Judge Stephen Scarlett whether they believe they can reach a verdict. Early in the afternoon the foreman said the jury was deadlocked 9-3 on 8 murder and one aggravated assault charges and said they were still deadlocked.

When Scarlett asked about whether they had made progress the foreman said he didn't know because they hadn't taken a vote recently.

"We've got a couple of options,'' Scarlett said. "We've had long day.''

The choices are to take break for the night and resume deliberations Friday morning, continue deliberating Thursday night or decide if reaching a verdict was even possible, he said.

"Take a break. Have dinner. Maybe reach a concensus where you are,'' Scarlett said.

He then recessed court for an hour.

If they cannot reach a verdict, Scarlett would declare a mistrial on the nine serious charges. The state would accept the verdict on the drug charges that the foreman said the foreman said had been reached.

After dinner, the jury sent a note to Superior Court Judge Stephen Scarlett requesting the break. Scarlett then recessed court.

I think it is going to wind up hung and will have to be retried.

I think the rouge juror, who sounds like he has a very strong controlling bullheaded personality... was able to sway a couple of the weaker personalities to his side. I have seen that happen in jury cases I have sat on and these people really don't deliberate like the law requires. They actually draw their line in the sand and refuse to deliberate.

A lot of times jurors aren't even aware that they can inform the Judge when someone is refusing to hear any arguments from the other parties and are refusing to deliberate. I doubt this jury knows they can do this.:(

We had one woman removed from a case I was on because that is exactly what was happening. She wouldn't deliberate or even listen to all parties. Thank goodness we had an honorable Judge who knew that everyone is required to deliberate and listen in earnest to both sides of the argument. We listened to her spiel for over an hour but when we tried to show her the evidence proving the man was guilty BARD she turned her chair away from us. Once she was booted and an alternate brought in we came to an unanimous verdict after she had discussed her beliefs about the evidence. Also once our 'non-deliberating' juror was removed the one other person siding with her became much more receptive to listening to the evidence from the others. I think she felt a lot of pressure from this juror and felt pressured to side with her. There are always seems to be controllers/leaders and followers in juries.

I am saddened that the case isn't going to be resolved now but I am livid with this Judge for not removing a juror that should have never been allowed to sit on this case in the first place. I know the DA has to be so angry about his rulings on this juror.

I know the families (Toler/Heinz/West) hate to go through this agony again but it is far better than a very guilty man walking free.

Now I know why she acted so tough.......she was.:floorlaugh:

I don't know about being a DI but she did go on to be a truck driver before she made it big in Hollywood.:D

That is so sad and reminds me of the women jurors crying when they couldn't come to an unanimous verdict in Jodi Arias' sentencing phase.

Nothing is so painful as not rendering a verdict. It leaves everyone twisting in the wind.

IMO

I still don't see how that was the hard part for the jury. They found her guilty so it should have been easy to send he to her fate . It was BART that she murdered him. No question in anyones mind she was guilty. NONE . I think they just didn't want to be the one sending a person to die. I think there was ore hope for reform and positive prison enhancement on the DC sniper than on Jody .IMO
 
BRUNSWICK, GA. | Having announced a 9-3 deadlock Thursday on the murder charges against Guy Heinze Jr., the jury in his death penalty murder trial nonetheless will keep deliberating.

The foreman of the eight-woman, four-man jury told Superior Court Judge Stephen Scarlett shortly after lunch they had reached a verdict on two drug charges but could not agree on eight malice murder counts and one of aggravated assault.

“Is it your opinion you are hopelessly deadlocked,” or could further deliberations be fruitful, Scarlett asked the foreman.

When the foreman hesitated to answer, Scarlett told the jury to discuss the matter and advise him.

They went back to the jury room, but instead of returning to tell Scarlett whether they felt a verdict on all charges was possible, they came back at 2:30 p.m. to watch a videotaped walk-through of the crime scene. The videotape showed the bloody interior of the mobile home where, Heinze had told police, he came home early Saturday morning on Aug. 29, 2009, and found his whole family beaten to death. There was, however, one survivor, Byron Jimerson, who was 3 at the time.

No more was heard until about 6:15 p.m., when the jury came back to the courtroom. When Scarlett asked about whether they had made progress, the foreman said he didn’t know because they hadn’t taken a vote recently.

“We’ve got a couple of options,’’ Scarlett said. “We’ve had a long day.”

An hour later, the jury asked to recess for the night. That is what the judge ordered.

If they still cannot reach a verdict Friday, Scarlett could declare a mistrial on the nine more serious charges. The state would accept the verdict on the drug charges.

It was evident that the defense team believes the jury has found Heinze guilty on the drug charges. After talking with one of the defense lawyers, Heinze’s younger brother left the courthouse in tears.

The violation of the Georgia Controlled Substances Act, a felony, and misdemeanor charge of possession of marijuana arose from police finding a mild narcotic painkiller and a small amount of marijuana in the car Heinze was driving.

If he has been found guilty on both, Heinze faces a maximum five years on the felony and up to one year on the misdemeanor.

The sequestered jury has deliberated at least 15 hours over two days.

If there is a mistrial, Heinze will remain in custody as he has been since Aug. 29, 2009. That’s when he reported he had come home from being out all night and found his father and seven others dead in a single-wide mobile home north of Brunswick where 10 people lived.

He is charged with eight counts of malice murder in the deaths of his father, Guy Heinze Sr., 45; Russell D. Toler Sr., 44; Toler’s children, Russell D. Toler Jr., 20, Chrissy Toler, 22, Michael Toler, 19, and Michelle Toler, 15; Chrissy Toler’s boyfriend, Joseph West, 30; and the senior Toler’s sister, Brenda Gail Falagan, 49.

He is charged with aggravated assault with intent to murder in the beating of Byron, who is now 7 and lives with his paternal grandmother.
