Fulton County, Georgia Criminal Election Influence Investigation. Prosecuting Office: Fulton County, GA District Attorney’ Fani Willis’ Office. Case #23SC188947
Officials with the Fulton county court handed the indictment to Judge Robert McBurney.
Proposed trial date on 3/4/24. Judge Scott McAfee presiding. Though McAfee was assigned the case soon after the indictment was handed up on Monday evening, it could be transferred to a different judge later in the process.
8/17/23 Update from CNN: Fulton County’s sweeping indictment against Trump & 18 additional co-defendants also includes details involving 30 “unindicted co-conspirators” – people who Fulton County District Attorney Fani Willis alleges took part in the criminal conspiracy to overturn the 2020 election. Some of the co-conspirators are key Trump advisers, like Boris Epshteyn, while several others are likely Georgia officials who were the state’s fake electors for Trump. One of the unindicted co-conspirators who appears multiple times in the indictment is Georgia’s Republican Lt. Gov. Burt Jones. Willis was barred by a state judge from investigating Jones after she hosted a fundraiser last year for Jones’ Democratic opponent when he was a state senator running for lieutenant governor. The 98-page document alleges the 30 unindicted co-conspirators, who are not named, “constituted a criminal organization whose members & associates engaged in various related criminal activities” across the 41 charges laid out in the indictment. Unindicted co-conspirators per CNN: Co-conspirator 1 is Tom Fitton of Judicial Watch, Co-conspirator 3 is Boris Epshteyn, Trump political adviser, Co-conspirator 4 is Robert Sinners, Trump’s Georgia election day operations lead, Co-conspirator 5 is Bernie Kerik, former NYPD Commissioner, Co-conspirator 6 is GOP operative Phil Waldron, Co-conspirator 8 is Georgia Lt. Gov. Burt Jones, Co-conspirators 9 is former Georgia Republican Party Treasurer Joseph Brannan, Co-conspirators 10 & 11 are Georgia GOP officials Carolyn Fisher & Vikki Consiglio, Co-conspirators 2 & 8-19 are the fake electors, Co-conspirator 20 is unclear-The indictment says Individual 20 was part of a meeting at the White House on December 18, 2020, with Trump, Giuliani & Powell, known to have discussed the possibility of seizing voting machines. Co-conspirators 21 & 22 are Conan Hayes & Todd Sanders, Co-conspirators 23-30 are related to Coffee County voting machines, Co-conspirator 25 & 29 are a Cyber Ninjas CEO Doug Logan & analyst Jeffrey Lenberg, Co-conspirator 28 is Jim Penrose.

8/26/23 Update: A superior court judge has set the first group hearing in a Fulton County case implicating Trump & more than a dozen allies in alleged election interference, according to court documents. The notice shows that all 19 co-defendants are expected at the Fulton County Courthouse at 1pm next Thursday, 8/31/23. It is unclear what the hearing will address, or if anyone will attend virtually. The case’s trial date has been heavily debated. Court documents suggest that Fulton County DA Fani Willis was originally considering 3/4/24 trial, but defendant Kenneth Chesebro was approved for a speedy trial set for 10/23/23. Willis then moved to set all the trials for that date — a motion Trump objected, looking to sever his case.
8/28/23 Update: A date for arraignment apparently just hit the docket too. 9/6/23 @ 9:30am for Trump. Everyone else that day too in 15 minute increments. Donald Trump: 9:30am, Rudy Giuliani: 9:45am, John Eastman: 10am, Sidney Powell: 10:15am, Mark Meadows: 10:30am, Cathy Latham: 10:45am, Scott Hall: 11am, Kenneth Chesebro: 11:15am, Trevian Kutti: 11:30am, Harrison Floyd: 11:45am, Jeffrey Clark: 1pm, Stephen Lee: 1:15pm, Jenna Ellis: 1:30pm, Shawn Still: 1:45pm, Ray Smith: 2pm, David Shafer: 2:15pm, Michael Roman: 2:30pm, Bob Cheeley: 2:45pm & Misty Hampton: 3pm.
8/31/23 Update: Trump's Entry of Plea of Not Guilty & Waiver of Appearance at Arraignment.
8/31/23 Update: On Thursday, Fulton County Superior Court Judge Scott McAfee said he will permit a live YouTube stream of all related hearings & trials that emanating from DA Fani Willis’ vast, sweeping indictment of Trump. The live stream will be operated by the court. Also Judge McAfee has set 9/8/23 as the possible release date of the final report of the special purpose grand jury that investigated interference with the 2020 presidential election & recommended a number of people be indicted for alleged crimes.
8/31/23: Hearing: Notes from a tweet. Back & forth motions. Apparently, McAfee is a newbie judge and it's caused a lot of confusion that he severed Chesebro the way he did. Willis requests the judge makes sure the defendants asking for a speedy trial understand the ramifications of their decision & would he at least set a severance schedule if the defendants won't be tried together. Trump's new attorney, Sadow, objects to trying all defendants together, the October trial date & infers criticism towards Willis for substituting her judgement for the court's while also telling the judge what the judge must have been thinking or what the judge has done. Jeffrey Clark files a motion objecting to October 23rd & goes further to claim any trial date is premature (he wants removal sorted first). - tweets by legal analyst Lisa Rubin. (#900 page 45).
8/31/23 Update: Trump filed motion to sever his case from those of co-defendants who demanded a statutory speedy trial. Stating it would violate Trump's federal & state constitutional rights to a fair trial & due process of law. Filed by Steven H. Sadow. 8/31/23: Smith: Motion for severance.
9/1/23 Update: Fulton County DA Fani Willis responds to Judge Jones's request for additional briefing as Mark Meadows seeks to move his state criminal charges to federal court. (#929 page 47). Meadows' response (#931 page 47).
9/1/23 Update: Georgia Gov. Brian Kemp (R), who declared this week that the state would not be “engaging in political theater” as he shut down calls within his party to remove or punish Fulton County DA Fani Willis.
9/1/23 Update: DA Fani Willis' brief filed today clearly set everyone straight, in a polite way, about the (very limited) role of overt acts in the RICO charge and the non-existent role of overt acts in a removal analysis.
9/1/23 Update: Judge McAfee DENIES Fani Willis's request to advise defendants of how a speedy trial demand impacts their rights to certain discovery deadlines & notice of trial. McAfee says that imposing the deadlines Willis set out in her motion would conflict with the way he typically runs trials, as set out in his standing case management order. So, he denies the motion, but says Willis can raise the issue down the road if it becomes relevant.
9/1/23 Update: Ken Chesebro stresses that he really, really doesn't want to be tried with Sidney Powell in October. He's asks Judge McAfee to sever his case from Powell.
9/1/23 Update: Sidney Powell files to adopt Chesebro's motions requesting the names of unindicted co-conspirators & ability to interview grand jurors.
9/1/23: Order: Rule 22 Order allowing the use of devices for non-recording purposes. Guiliani: Limited entry of appearance for Brian Tevis & L. David Wolfe as counsel for defendant. 9/1/23: Cheeley: Waiver of arraignment (pled not guilty), discovery & demand for list of witnesses. 9/1/23 Update: Mark Meadows pleaded not guilty in a court filing posted Tuesday, 9/5/23 in the court docket to Georgia racketeering charges alleging he tried to help Donald Trump steal the 2020 election. By entering a plea through a court filing, he avoided needing to appear Wednesday, 9/6/23 at a scheduled arraignment hearing. Meadows is free on $100K bond pending trial.
9/2/23 Update: Defendants who so far have waived appearance at arraignment: Donald Trump, Rudy Giuliani (Trump lawyer), Sidney Powell (campaign lawyer), Ken Chesebro (Trump lawyer), Jenna Ellis (campaign lawyer), Bob Cheeley (lawyer), Scott Hall (involved w/ Coffee County election breach), Harrison Floyd (Black Voices for Trump), Stephen Lee (pastor). Mike Roman (campaign official), Ray Smith (campaign lawyer), Shawn Still (fake GOP elector) & Trevian Kutti (publiist).
Defendants who have not yet waived appearance at arraignment: Mark Meadows (White House Chief of Staff who is afraid of being yelled at), Jeffrey Clark (DOJ official), David Shafer (GA GOP chair, fake elector), Cathy Latham (fake elector, tied w/ Coffee County election breach), Misty Hampton (Coffee County elections supervisor) & John Eastman (Trump lawyer).
9/5/23 Update: Georgia Republican Party Chairman David Shafer, state Sen. Shawn Still & Cathy Latham − have also pleaded not guilty to their charges & waived their hearings. Other co-defendants whose not guilty pleas were posted Tuesday were John Eastman, Michael Roman & Harrison Floyd. The only co-defendant whose plea was not posted in the court docket by noon Tuesday was Misty Hampton.
