County 31 did not occur within the territorial limits of Fulton County]. General Demurrer to Counts 1, 30, 31. Some more details regarding the allegations against Fani Willis and Nathan Wade.

I certainly hope, for multiple reasons, that these allegations are not true and are just an attempt by Roman to get Willis removed.

He seems to have no evidence so far, but according to the article there’s a bunch of talk about it around court and from alleged close sources.

If there should be any truth to it, then I don’t know what these people were thinking, in their personal lives of course but, for our purposes, as it affects this case.

I have no doubts that whether this is true or whether it’s a false allegation, Trump and his team will run with this as true. His lawyer will file some conflict of interest paperwork and the trial will end up delayed.

IMO

My first thought when I heard about this was that I can’t imagine Fani Willis being so stupid as to appoint Nathan Wade to this position if they are or have been in a relationship. She doesn’t strike me as someone who would shoot herself in the foot and risk this case for any reason. But Trump’s playbook is “People say..” or “I’ve heard…” when he’s about to spread a false and defaming rumor. So I would expect nothing less from any other defendant in this case.

Gov. Kemp has sure changed his tune. In August he was very supportive of Willis. Not so much, now. There will be an investigation and it won't surprise me if she isn't re-elected.

No thread for this so posting here, I think people will be interested to see this:

NEW YORK (AP) — Former President Donald Trump was ordered Friday to pay nearly $400,000 in legal fees to The New York Times and three investigative reporters after he sued them unsuccessfully over a Pulitzer Prize-winning 2018 story about his family’s wealth and tax practices.

Ha! We don’t even have enough threads to cover all Trump’s legal issues. We can be sure he’ll appeal, of course.

Okay - I made a mistake & misread the document. The hearing 1/12/24 was ONLY for Trump, Guiliani, Smith, Cheeley, Shafer & Kutti. I have corrected my notes. :)

According to this article, Fani Willis has three special counsels on this case. These articles are all making it sound as if Nathan Wade is the only one.

All three are being paid at the same rate.

I think the bigger issue with Georgians is that she is having an affair and taking lavish vacations with her vendor. She may be guilty of honest services fraud. It's a serious allegation and the Judge said he'll hold a hearing.

Willis described being the target of a "swatting" attack on Christmas night, when someone reported that a woman had been shot dead at her home. It led her to think that her oldest child had been shot, she said. "I thank you, Lord, that it all turned out to be a cruel hoax."

I can't imagine how terrifying and devastating that must have been for her...thinking her daughter had been murdered!
So many sick people out there who have no morals.

I am more interested in how this affects the RICO charges against all of the accused. And I don't think it does.

It is an opportune moment for Roman to try to publicly drag up some "dirt" and detract from the seriousness of himself trying to negate the results of a Federal presidential election and the votes of the American people.

imo

Former President Trump’s attorney Steve Sadow did not want to commit to whether or not he would be on board with the motions. “I’m leery to move and adopt motions that make such allegations without having a better understanding or substantiation of the allegation.” Link

Merchant (Roman's attorney) maintains she has witnesses who did not want to provide written affidavits but indicated they would testify in court if subpoenaed. Link

There's an epidemic of swatting calls to politicians, judges.

In May, the FBI launched a national online database so that police departments and law enforcement agencies can share information pertaining to swatting incidents. People making the calls often use technology to mask their true voice, caller information and location.

The FBI’s database is important for agencies to “connect the dots” on who is making the phone calls and if incidents are linked, said Frank Figliuzzi, a former FBI assistant director and a national security analyst for NBC News.

The issue is so salacious--and incredibly expensive to taxpayers--I doubt there will be a guilty verdict at trial.

From my link:
Superior Court Judge Scott McAfee said Friday he will wait until Willis, the Fulton County district attorney, responds to a motion this week by a Trump co-defendant seeking to disqualify Willis and Nathan Wade, the special prosecutor.

“Obviously, my plan was to allow the state to respond before setting a hearing date,” McAfee said in Atlanta state court, adding that he’s “targeting” early February.

McAfee replied at a hearing to a comment by Trump lawyer Steven Sadow that he’s weighing whether to join the Jan. 8 motion by co-defendant Michael Roman, which he called “salacious and scandalous in nature.” Craig Gillen, a lawyer for co-defendant David Shafer, said he’s also doing his own investigation and may join Roman’s motion.

The optics are getting worse and worse. One of the top private attorneys who previously worked with Willis on a RICO case, worked Pro Bono. Has he been paid the same as NW on this case?

Meanwhile NW drives a $100,000 car. A few months ago, the Judge handling NW's divorce held him in contempt for failing to disclose his income to his housewife's attorney.

...But to Willis’ left at the big announcement stood her very worst hire, Nathan Wade. She pays this private attorney $250 an hour to serve as a special prosecutor on the Trump case. Wade does not appear to have ever tried a felony case before this one, among the biggest in American history.

...the very fact that she would hire somebody so inexperienced and unqualified for a case involving an alleged assault on democracy itself answered a question posed on July 25 by Superior Court Judge Robert McBurney. He disqualified Willis from investigating then-Georgia State Sen. Burt Jones as a possible fraudulent elector for Trump. Burt was running for lieutenant governor and it turned out Willis had hosted a fundraiser for his opponent.

“I use that phrase, ‘What were you thinking?’” McBurney said, adding, ”The optics are horrific.”

At the time, it appeared Wills may have just suffered a temporary lapse of judgment. Now, it seems she suffers from a serious character flaw. And the answer regarding both messes seems to be that she was not thinking at all.

And, the motion added, she (Floyd's wife) had just learned that her husband was working on the Trump prosecution.

“Plaintiff has not produced one single document evidencing this income,” the motion read. “Plaintiff has not produced one single bank statement indicating where those funds have gone.”

On Oct. 24, 2023, the judge granted her motion to reopen discovery. Less than two months later, Wade’s wife told the divorce court that her husband had earned almost $700,000 for his work on the Trump case since May of 2022. She added that he had given her “nearly nothing” in financial support — a claim that Wade’s lawyers disputed in court papers.
