Officials with the Fulton county court handed the indictment to judge Robert McBurney.
Proposed trial date on 3/4/24. Judge Scott McAfee presiding. Though McAfee was assigned the case soon after the indictment was handed up on Monday evening, it could be transferred to a different judge later in the process.
8/17/23 Update from CNN: Fulton County’s sweeping indictment against Trump & 18 additional co-defendants also includes details involving 30 “unindicted co-conspirators” – people who Fulton County District Attorney Fani Willis alleges took part in the criminal conspiracy to overturn the 2020 election. Some of the co-conspirators are key Trump advisers, like Boris Epshteyn, while several others are likely Georgia officials who were the state’s fake electors for Trump. One of the unindicted co-conspirators who appears multiple times in the indictment is Georgia’s Republican Lt. Gov. Burt Jones. Willis was barred by a state judge from investigating Jones after she hosted a fundraiser last year for Jones’ Democratic opponent when he was a state senator running for lieutenant governor. The 98-page document alleges the 30 unindicted co-conspirators, who are not named, “constituted a criminal organization whose members & associates engaged in various related criminal activities” across the 41 charges laid out in the indictment. 8/24/23: Fulton County DA Fani Willis has asked a judge to set a trial date of 3/4/24 for Trump & his 18 co-defendants. Willis’ proposed schedule also requests arraignments for Trump & his allies the week of 9/5/23. She hasn’t changed her Aug. 25 deadline for them to surrender at the Fulton County Jail.
8/25/23 Update: Mark Meadows is seeking to move the Fulton County, Georgia, prosecution against him to federal court so that he can try to get the case dismissed under federal law. On Wednesday, a federal judge scheduled an 8/28/23 hearing for Meadows & others to present evidence about whether to move the case.
8/25/23 Update: GOP operative Michael Roman & Georgia State Sen. Shawn Still are now booked in the Fulton Co Jail & show as being processed shortly after midnight. 8/25/23 Update: John Eastman's attorney Harvey Silverglate said his client intends to sever his case from his co-defendants & pursue a speedy trial. Chicago pastor Stephen Lee has turned himself in to authorities at the Fulton County Jail. 8/25/23 Update: Sidney Powell is seeking a speedy trial, according to a new court filing. One of the other 19 defendants charged in the election interference case, Kenneth Chesebro, has also sought a speedy trial. A judge recently set his trial date for 10/23/23.
8/25/23 Update: Notice of Initial Batch of Discovery. DA Willis requested that attorneys for the defendants “provide a USB drive that is at least 2 terabytes large for copying of the initial batch of discovery” by September 5, the filing states.
8/25/23 Update: Harrison Floyd will remain in the Fulton County jail for now. During his first appearance in court Friday afternoon, Judge Emily Richardson told Floyd that she would not be setting bond because Floyd had already been indicted & assigned to Judge Scott McAfee, who would address bond moving forward. Richardson also informed Floyd of his rights & read the charges that he is facing during the brief virtual appearance. Floyd does not have representation & told the judge that he could not afford a private attorney. Richardson told Floyd he did not meet the eligibility requirements for obtaining a public defender. He appeared over video conference in a large, empty room dressed in a prison uniform. When a bond release was denied, Floyd objected, arguing that he voluntarily surrendered.
8/25/23 Update: Cathy Latham, who served as an illegitimate elector for Trump after the 2020 presidential election, has joined other defendants seeking to have the Georgia election subversion case moved to federal court. In a court filing Friday, Latham said she was following the orders of then-President Trump.
8/25/23 Update: All but one of the defendants have surrendered after negotiating a bond deal with prosecutors, allowing for a fast booking process at the Fulton County jail. The 18 agreements allow each defendant to be out on bond during the course of their legal case, as opposed to remaining in custody. Each of the 18 defendants has also pledged to a standard set of conditions, including prohibitions on discussing the case with witnesses or one another.
8/26/23 Update: Shawn Still, one of the Georgia fake electors, is trying to move the case to federal court.
8/26/23 Update: A superior court judge has set the first group hearing in a Fulton County case implicating Trump & more than a dozen allies in alleged election interference, according to court documents. The notice shows that all 19 co-defendants are expected at the Fulton County Courthouse at 1pm next Thursday, 8/31/23. It is unclear what the hearing will address, or if anyone will attend virtually. The case’s trial date has been heavily debated. Court documents suggest that Fulton County DA Fani Willis was originally considering 3/4/24 trial, but defendant Kenneth Chesebro was approved for a speedy trial set for 10/23/23. Willis then moved to set all the trials for that date — a motion Trump objected, looking to sever his case.
8/24/23 Update: Former Trump White House chief of staff Mark Meadows’s request to move his case to federal court will be the subject of an evidentiary hearing Monday. It’s possible that Meadows might need to testify for his request to succeed, and we learned Thursday that Fulton County District Attorney Fani T. Willis has subpoenaed two central witnesses to participate: Georgia Secretary of State Brad Raffensperger (R) and his chief investigator, Frances Watson. (Politico’s Kyle Cheney said this makes Monday’s hearing something of a “mini trial.”) Also Thursday, a judge set an Oct. 23 trial date for one defendant, Kenneth Chesebro. Chesebro has requested a speedy trial, which he is entitled to under Georgia law. Former Trump lawyer Sidney Powell has also requested a speedy trial, though her trial date hasn’t been set. While their prosecutions might be separated from the defendants who prefer to delay their proceedings (including Trump), an early trial for one or more defendants could get at central facets of the alleged conspiracy.
8/25/23 Update: Jeffrey Clark, former Justice Dept. (DOJ) official, filed a notice of removal on Aug. 21, requesting that his case be moved from state to federal court, where he is expecting the charges to be dismissed. A request to expedite the process before the arrest deadline was denied by Judge Steve Jones of the U.S. District Court for the Northern District of Georgia, who will oversee the hearings related to removals. The hearing will take place Monday, 9/18/23 & the DA’s office has until Sept. 5 to file a response.

8/28/23 Update: Meadows motions hearing. Meadows also added another lawyer - Robert Bittman. Meadows testified on his own behalf. Georgia Secretary of State Brad Raffensperger also testified. US District Judge Steve Jones did not rule from the bench on Monday. He acknowledged that arraignments in the criminal case were scheduled for 9/6/23 & aid he would rule as quickly as possible. Meadows’ attorney said “we are entitled to a prompt determination” of whether his state criminal charges will be moved to federal court. As the hearing drew to a close, one of the judge’s final questions was whether Meadows had any federal authorities that Trump didn’t have as president. DA Fani Willis’ office said no, but Meadows team said yes, arguing that the chief of staff has a “wide range of authority.” The breadth of his federal authority is key to determining whether the case will stay in state court.
8/28/23 Update: Atlanta lawyer Ray Smith filed a waiver of arraignment & entered a not guilty plea on Monday, 8/28/23. 8/28/23 Update: Judge McBurney has ordered the full release of the Fulton County special grand jury report now that all have been indicted. He says he’ll do it 9/8/23 unless there are objections.
8/29/23 Update: Judge Steve Jones has ordered an evidentiary hearing for two more of Trump's Georgia co-defendants seeking to move their cases to federal court. David Shafer & Cathleen Latham — who both posed as electors — will make their case on 9/20/23.
8/29/23 Update: Judge Jones just entered an order for a supplemental briefing to be filed by 5pm Thursday, 8/29/23 by both parties. The issue is - if even one of Meadows overt acts (but not all) as charged in the indictment occurred under the color of his office would that alone be sufficient for federal removal of a criminal prosecution?
8/29/23 Update: Consent Bond Order: Harrison Floyd now has bond $100K. Chris Kachouroff, a Virginia-based attorney who filed paperwork Monday to represent Floyd in Georgia, said he was contacted Tuesday by Fulton County District Attorney Fani Willis’ office to arrange the bond & claimed his client was only given bond because the prosecutor “didn’t like the optics” of Floyd remaining behind bars any longer. Jeff DiSantis, Willis’ spokesman, strongly denied Kachouroff’s version of events. “Mr. Floyd has had the opportunity to work out a consent bond in the same manner as the other defendants named in the indictment, but chose not to do so until today,” he said.
8/29/23 Update: Motion to Clarify or, in the alternative, partially set aside case specific scheduling Order entered on 8/24/23 filed by DA Fani Willis. She is asking the judge in the Trump racketeering case to fast-track all 19 of the defendants — not just Ken Chesebro — while permitting the others to file motions to sever from the larger case. Defendant Chesebro has not filed a motion to sever & because the Court has held no hearing on a motion to sever, the State of Georgia respectfully requests that the Court set aside its Case Specific Scheduling Order entered on August 24, 2023. The State of Georgia further respectfully requests that the Court set a deadline for any Defendant wishing to file a motion to sever, allow the parties, including the State of Georgia, sufficient time to brief the severance issue & hold a hearing on any filed motion to sever so that the Court may consider the factors set forth in Cain & its progeny, as required by Georgia law.
8/29/23 Update: Attorney Sidney Powell has waived a formal arraignment & pleaded not guilty, a court filing on Tuesday showed. Other Trump allies, Trevian Kutti & Ray Smith, have also waived formal arraignment & entered not guilty pleas.
8/30/23 Update: Attorney Kenneth Chesebro filed a motion Monday, 8/28/23 asking a judge to unseal a host of underlying records in the case -- including the special grand jury report that recommended charges, the transcripts of testimony heard by the panel & any recordings of the proceedings.
8/30/23 Update: Sidney Powell files a motion to sever her case from the other 18 co-defendants claiming that she has “no substantive connection with any other defendants regarding the charges in the Indictment.”

The epitome of a cowardly yes man. Gah! He's probably my least favorite next to Trump - and I mean, that's in a list with Giuliani and Powell and Ellis so that's really saying a lot. Oh. But Giuliani is in a close, close race. How do you decide which villain is most villainous?

A moment on the stand that really resonated was when he testified Trump absolutely believed he'd won the election but Meadows stated, while Meadows thought there was reason to investigate, he also saw no reason to contest Barr's assessment that there was no widespread voter fraud.

It's my belief that Meadows has the type of character who will do whatever is politically, reputationally, or legally convenient at the time.

And I wanted to add - Meadows had multiple opportunities after January 6th to do the right thing and repeatedly chose not to - even when he was no longer working for Mr. Trump - in fact, just as a reminder, $1 million dollars was donated to Meadows non-profit from Trump's PAC just weeks after January 6th.

My reply: I've been wondering about the idea that a few select major states go through the process of declaring him ineligible to be on the ballot in their state. Surely a valid Republican who isn't a Trumper could be found to run him/herself, in each state, in order to have standing if necessary. He wouldn't need to be banned from the ballot in every state, just in enough to make it impossible to win.

My reply: I've been wondering about the idea that a few select major states go through the process of declaring him ineligible to be on the ballot in their state. Surely a valid Republican who isn't a Trumper could be found to run him/herself, in each state, in order to have standing if necessary. He wouldn't need to be banned from the ballot in every state, just in enough to make it impossible to win.

There is a precedent according to the article you linked.

"There has been one settled case since Jan. 6 that invoked the 14th Amendment. In September, a judge in New Mexico ordered a county commissioner convicted of participating in the Jan. 6 riot removed from office under the 14th Amendment. He was the first public official in more than a century to be barred from serving under a constitutional ban on insurrectionists holding office."
 
Republicans could have saved themselves a lot of grief if they had just voted to convict Trump on the Jan 6 impeachment trial with the only outcome being that Trump could no longer hold public office. It was the right thing to do and now they are paying for it dearly. They need to banish the cult and rebuild around people that have character and believe in the constitution and law and order.

While I agree with you in spirit, I struggle to see how you do that when Trump has effectively rebuilt the party in his image. Even his primary candidate opponents are hesitant to challenge him. And when Trump is gone there are 1,000 wanna-bes now waiting in the wings. The party itself has become the issue - the party itself is determined to do anything, become anything, in order to gain, consolidate, and keep power...even coalesce around their indicted frontrunner to protect him.

The problem isn't so much Trump as what Trump has unleashed. He's helped to open a Pandora's Box in which people are celebrated and rewarded for being their worst selves. How do you even begin to reform that? I just don't believe you can. At least, not for decades to come.

And you see no true will for it either - there are precious few Republicans that talk about moderating their stance or persuading people - and an overwhelming majority with many in roles of power that would prefer to change the rules than have to change themselves.

(BTW, loosely related, it was reported recently a No Labels adviser also happens to be a 6 figure Trump donor. There are a lot of political pundits that suggest a vote for a No Labels candidate will help to ensure another Trump presidency but maybe it's just a coincidence. Maybe not. ;))

Has anyone else filed for waived arraignment & plead not guilty? And do you all think that the times will be squeezed in - starting at 9:30am (instead of 10am) for John Eastman, then 15 minutes later Mark Meadows, etc. etc....

Misty Hampton seems to fly under the radar with attention focused on bigger names in the indictment.

Misty was the Coffee County election supervisor. She let in people who copied the election software. (Let that sink in!)

When the breach was discovered, she resigned from her position. After that, she went to Michigan for a "meeting with Ben Cotton, who worked on a Republican recount of the presidential election in Arizona, and with Stefanie Lambert, a pro-Trump defense attorney who filed lawsuits targeting Dominion Voting Systems and alleged election fraud theories that were later debunked."

Clearly she wasn't horrified by what she did - she stayed with the election fraudsters.

Then what did Misty do? She got a job in another Georgia county to run elections!

Investigators are apparently looking at the election equipment in that second county, though I can't find any info that any wrong-doing was found. The person who hired Misty in the second county is "a former probate court judge who resigned amid a state investigation of ethics violations, finished in last place among four Republican candidates during last year’s primary for secretary of state."

Misty was hired to run the elections to replace that judge.


 
Here's another great article on Hampton and Latham and their many historical misdeeds in "Crooked Coffee" County as it relates to voter supression they undertook there; needless to say, very few were actually 'surprised' when they learned of the breach -- including republican voters.

No benefit but appearances do depend on the jurisdiction. If a defendant doesn't have legal respresentation, they have to appear in person to answer the charges. Also, not all courts allow attorneys to waive arraignment and enter a plea on behalf of their client.

In many Georgia counties though appearance is optional and most defendants choose to waive formal arraignment and not appear in court. I really thought the camera in the courtroom was going to ensure more people showed in person just to get the optics of an emphatic 'Not Guilty!' televised though.

(Probably giving these people too much credit for strategizing. JMO)
 
But as various legal experts have noted, Trump’s sale of that mug shot, taken by the Fulton County sheriff, may violate U.S. copyright laws. This could mean that theoretically, the millions he is making off that photo may rightfully belong to the Fulton County sheriff — an entity that just happens to be in desperate need of funds to address the horrific conditions in the Fulton County Jail.

Leave it to Trump to break yet another law just to cash in.

Just want to add my tuppence on a portion of the article posted - Fani Willis has been criticized by some posters for the conditions at Fulton County Jail even though that isn't her responsibility. Sheriff Labat - who is in charge of Fulton County Jail - recently begged county commissioners for more funding to alleviate some of the issues the jail is facing. The commission has chosen to keep a tighter rein on Labat and is refusing those funds until the sheriff has shown improvement with money already provided.

Ms. Willis has also had to beg that same county commission for funding to clear the backlog she inherited. The problems facing the criminal justice system are complex and multi-faceted. One person can in no way be responsible for all the issues it's facing - overpolicing, cash bail, overcrowding, lack of investment, for-profit jails and prisons, outsourcing to private vendors, poor institutional staff training and hiring, etc.

In fact, the Fulton County commision recently voted to renew the contract with NaphCare for the sixth time since 2018 - the company in charge of healthcare - despite an inmate's death due to lack of medical care becoming international news and the DOJ launching an investigation into access to medical care within the jail. NaphCare even managed to score a sweet $4.5 million MORE in their new contract. The commission approved it 7-0. Mr. Thompson or the appalling and horrific conditions he both lived and died in were not mentioned.

This diatribe isn't to defend Ms. Willis alone but rather to point out that district attorneys are but one cog. They could be making a whole lot more money in private practice without the necessity of playing politics for funding, having to field death threats, hiring their own security or being the target of virulent and vitriolic hatred.
