In Ga. You can't drive while drunk even on private property. In fact, regardless if you are driving or not, if the keys are in the ignition, and you are behind the wheel, you can be charged. The engine doesn't even have to be running.
The question I have is this... If that cop thought he was passed out drunk, then why did he tell him to drive the car?
 
At about 32 minutes into the tape, AFTER the shooting, 2 'witnesses' come over and start screaming at the cops. Accusing them of hassling the man, and arresting him for 'no effing reason.'

BUT it clearly shows the officer giving him a breath detector test and he was over the legal limit for alcohol. And the man had been lying to him continuously about him not driving his car---which was a flat out lie.

He was drunk and his girlfriend had been drinking too and she dropped him off to his car, even though they had both been drinking for awhile.

So these witnesses were wrong, when they said he was about to be arrested for 'no reason. 'And they begin screaming at the cops, calling them names, saying 'no wonder he was trying to get away, 'you were hassling him and arresting him for no reason.'

Is that what we have come to now? Cops are not supposed to arrest drunk drivers anymore?

And if someone takes a breathalyser and fails it, and doesn't want to get arrested, it is fine for them to begin punching the cops and grabbing their weapons from them?
I can't help but wonder what if the weapon grabbed was the officer's weapon and he was shot at rather than tazed? I guess LE needs to holster their weapons and just take it based on this ruling? I don't know what the answer is but I sure would not want to be an officer these days.

The fact that Brooks was unarmed is important, CNN Law Enforcement analyst Charles Ramsey said.

"Now you know he's not in possession of a firearm or any other deadly weapon," said Ramsey, a former Philadelphia police commissioner.

After Brooks stole the officer's Taser and ran away, "it looks like he may have even fired the Taser at some point in time," Ramsey said.

But it's unlikely Brooks would have been able to use the Taser a second time, Ramsey said.
"Once you fire the Taser, it has to recycle before it can be used again," he said. "I would doubt very seriously if most citizens would even know how to operate a Taser."

So instead of shooting Brooks, Ramsey said the officer could have continued the foot pursuit, "get on a radio and call for some assistance."

"You've got the car. You've asked for his driver's license. You know who he is. So even if you don't get him right now, you can get him later," Ramsey said.

"The need to immediately apprehend is taken away. And you can only use deadly force under certain, very narrow circumstances," such as if the officer's life or anyone else's life is in danger, or if the person being pursued poses a serious danger to the public.

"That's not the case here," Ramsey said.

Brooks died from organ damage and blood loss from the two gunshot wounds, the medical examiner's office said.

I have had a conceal permit to carry ever since I was in my early 20s. It saved my life in my mid 20s when I was coming home from work around 12:15am. If I had hesitated in firing my weapon into the lower passenger door, I have no doubt whatsover that the 3 thugs in the truck would have succeeded in running me off the road as they were trying hard to do.

The police officers told me if I had hesitated to fire my weapon they would have found me raped, and murdered with my body thrownout somewhere.

If they had been able to surround me blocking me in, I wouldnt have hesitated one second to shoot as many of them as I could, and I'm an expert shooter even now in my old age. I damned sure wasnt going to wait to see what their intents were!

Every self defense gun instructor stresses no one can hesitate to react in threatening situations. Hesitation of any kind is taken advantage of by the criminals. Legal gunowners are also instructed to immediately react to the threat. Even 2 seconds can be a difference between life or death.

Imo, like so many before this police officer he is another sacrificial lamb being offered up to appease the actual violent criminals who commit all of these felonies without hesitation.

Unfortunately we have seen this knee jerk reaction before with several being built on false narratives without a chance for the evidence to come forward.

We saw how dangerous they can be when Ferguson was under siege burning to the ground. The criminal was falsely portrayed as a gentle giant instead of a very aggressive giant. None of the potstirrers waited for the facts to come out, and when it did the city already was in shambles for the taxpayers to repair.

The facts told the real story of how a ruthless aggressive larger suspect did everything he could to take officer Wilson's gun from him even being so bold he tried to come inside of his patrol car in order to do so. If Mike Brown had his way Officer Wilson would be dead today. Imo. Instead the officer who didnt do anything wrong was stripped of his career, and his life ruined through no fault of his own. As you know that case is not the only one built on false narratives that left other cities in ruin.

So now another officer will be hung out to dry. His life will be ruined too. I have no doubt he will be charged. Not because he's guilty of anything, but to appease the hateful criminal masses they know will burn Atlanta businesses to the ground in a heartbeat. Or the lawless coming in, and taking over areas of the city to leave it in ruin like the area in Seattle that is being held under siege.

All of these Mayors, and Governors are facilitators for the lawless. They are the reason all of the craziness is allowed to go on with serious felonies being done in plain sight yet they dont care, and actually supports the lawless instead of the law abiding citizens, and businesses in their areas.

So the cities are held hostage by all of the violent criminals. So are the DAs who are going to charge every white officer no matter how dire or dangerous the situation was to their personal safety. Their safety doesnt matter one bit to these politicians, and never has, imo.

.Like I see many say they believe the police should just stand there taking it all, and do nothing. The only one who is given a benefit of a doubt are the criminals.

It shows how upside down our country is in now where bad acts are proclaimed as good acts or excusable behavior. In the past three weeks we have seen what it looks like when the lawless takes over many of our nation's streets. It will continue to spread like toxic waste destroying everything in it's path because LE is prevented from doing their job to protect these communities, and its citizens.

We are being swallowed up plummeting into a deep hole of moral decline. We use to pride ourselves of being a.country of law, and order. Now we see serious laws being broken every single day, and it's allowed, and worse even supported.

I had a similar experience at age 12. A black man entered my cousins house. He was drunk and wanted to show us a"a good time". Thank goodness my cousin was very tall, she reached over the doorway and pulled a shotgun down from the gun rack. I was shaking so bad I could hardly call the police, while she held him at gun point.

My daddy took me out the next day and made me practice firing until I could at least hit the target.

I too, have a concealed to carry permit.

The "man" had just been released from a federal prison, for raping a lady. He was convicted of illegal entry, theatening to rape us. It was horrible, we had to testify at the trial, I was 12 years old.

I'll leave this country, once other countries allow entry. I will not live the rest of my life in fear of the unlawful.

I don't think he chose to park in the drive thru of a Wendy's to sleep it off rather than drive drunk.

Wendy's did the right thing by calling the cops for their safety and the safety of their customers. What business wants someone, with unknown issues, passed out on their property with other customers around.

The cops had to do their job and respond to the call.

There's only one person responsible for everything that went down, and it's not the person from Wendy's that called or either of the officers who responded.
I agree Rocco, I don''t believe Brook's pulled into Wendy's drive through to sleep it off. He passed out. I don't believe the officer should have been fired or should face charges for handling this situation the way he did. He made the right call based on his assessment of the situation at the time.
 
It will be interesting to see the results of the toxicology report.
I am puzzled how someone that blows a .108 could be passed out drunk or sleeping one second and then coherent enough to overpower two cops the next.
I'm wondering if there were other factors that contributed to the sudden change of behavior.

No wonder Mr Ramsey is a former police commissioner! CNN needs better spokespeople . Maybe Greta can come on again and talk about this issue!

My statement was made tongue in cheek. I was referring to when CNN had Greta join their virtual "Town hall" panel, discussing Covid and racial issues recently.

Sgt. Rob Pride on Rayshard Brooks shooting: Atlanta officer appears justified in using force

GBI Director Vic Reynolds said Brooks had grabbed a stun gun from one of the officers and appeared to point it at the officer as he fled, prompting the officer to reach for his gun and fire an estimated three shots.

“We can look through history and see how many officers in policing history have been killed when they were disarmed of their own firearm and when a Taser is used against officers, it has that capability,” Pride noted.

“It has that capability of incapacitating an officer and having them disarmed and killed with their firearm and so I don't know of many agencies that this wouldn't be a deadly force encounter and it will be interesting to see what comes out of the investigation in regards to whether policies were met or not.”

Firing him immediately was a huge mistake. It just added fuel to the fire and helped convince the rioters that he was in the wrong. Apparently they don't do an investigations anymore into incidents. If you shoot someone---you get fired---investigation to follow.
 
I don't blame Wendy's for calling 911 at all. What were they supposed to do, let the guy block the drive-thru where they could no longer take orders and just close the drive-thru down?
What if he had a heart attack? How was the person that called supposed to know that?

They absolutely did the right thing by calling 911. They certainly couldn't approach him not knowing if he was dangerous or not. That is why people call 911 for help millions of times a year.

For doing the right thing they no longer have jobs, and Wendy's has one of their restaurants in ruins like so many other businesses have suffered the same fate including many minority own businesses.

What did any of these business owners do to deserve having their businesses ruined with some never being able to reopen again. These violent lawless groups think they have a right to destroy anything they choose.

Imo, it shows none of them really give a tinker's dam about the deaths of these men.

If they truly cared they would care about every single life they lose, and not just those who allows them to spill out on pur streets constantly committing very violence acts THEMSELVES.

Since all of this began many more police officers have been attacked while trying to protect the peaceful protestors.

It's in the high hundreds now, with some severely injured even still on life support now, and some ambushed, and shot dead.

How much blood of innocent police officers have to spill out on our streets before their lust for violent attacks against them are satisfied?

The hypocrisy is so obvious as they say black men are more likely to lose their lives now due to being killed by white cops or Covid. I just heard those ridiculous words uttered again by a FNN guest. I dont see how they can say these things repeatedly with a straight face. Imo, they must think everyone are stupid as rocks. If they would just tell the truth I would have more respect for them. It's as if they think no one knows about all of the large inner cities taking the lives of more black men by their own race. Do they not wonder why their population isn't increasing, and why?

More black men have lost their lives due to being murdered in ONE SINGLE DAY than those who were unarmed, and killed by LE officers in a single year. Where is the outrage about who takes their lives far more often?

Imo, when only a part of the truth, and facts are only allowed to be said, and the entire truth, and facts are continuously suppressed .....not allowed to be spoken the entire truth will never be known.

This constant conveniently picking, and choosing who's life matters makes no sense. Imo.

It makes even less sense by the group title of Black Lives Matter when the only time the lives seem to matter are when they are killed by a white cop. Why is that?

How many unarmed black men are shot, and killed by a cop of all races each year? And were they really no threat to the officer? Mike Brown was also an unarmed suspect yet was extremely dangerous.

We have seen cases where suspects were unarmed, but they used their own strength to brutally murder their victims by beating, and kicking their victims to death.

So unless we know the particulars of each shooting of unarmed suspects of all races we will continue to not have all the facts. I even believe the FBI list those who used only their strength were considered deadly weapons.

In fact I would rather be shot, and killed (although i pray i never fall prey) than being beatened, and kicked to death.

We have seen cases where sadistic murderers kicked their victims in the head over, and over again causing the skull to shatter into pieces.

So I think there isn't much of anything that couldnt be considered as a deadly weapon including being unarmed, but using their own strength to cause horrific deaths.

Imo, we need all of the facts to be front, and center being discussed just like we always do in ALL murder cases we follow.

Guilty until proven innocent is their new norm. What a world!!
 
He was drunk and passed out in the drive thru. Not the driveway. Customers were blowing their horns to get the line moving. Who else besides the police would you suggest handle it? An alcohol counselor who would have had to been called from home which might have been 40 miles away? How about a minister? What about the French fry kid inside Wendy’s?

There are no alternatives to the police. They are the only ones brave enough to encounter a guy like this. They might handle a drunk doing something crazy five times a night. To suggest that there are alternatives is a fairy tale.

I am asking if there was any alternative to the guy asleep in his car because he was too drunk after celebrating his daughter’s 8th b-day to end up dead. And mind you, I am not thinking about BLM, but just as anything else who ended up drunk publicly.

My husband said, “could they just shoot him in the leg?” I said, no. I understand that when police shoots, they shoot to kill.

But before? As I have said, I bet that any policeman has friends who have issues with alcohol, some drink themselves because alcohol is legal, are we to shoot all of our alcoholics and addicts?

Are they allowed to register high blood alcohol level, call a relative, ask to drive the guy home, let him or them pick up the car in AM, and later, yes, slap him with a fine and mandatory AA visits? Make him pay, make a year of AA visits miserable for him, but not dead.

I am not blaming the officer. I am thinking that deescalation is not taught well, probably, because too often people respond with violence to show of force. It is human nature.

And then the city pays to all the victims. Because drunk driving is a mistake. Sleeping in the driveway...I’d expect the guy to be in the ER, not in morgue.

Again, not blaming this concrete officer. I think that there are ways out before it turns deadly. They always need to be explored. Because the guy...mom died a year ago, daughter turned 8, so he drank too much. Human factor.
