This is one case where the motion is actually pretty relevant. But it's not going to happen. I just don't think judges do it.

In my previous years as a DV victim's advocate, and in my subsequent years as a trial watcher, I've only seen one trial case where a judge administered a JOA (it was a DV trial, and not a 2nd degree murder trial).
A judge (an elected public official) does not want to be held responsible for the verdict. IME, a judge would prefer that the jury delivers the verdict.
Having said that, I believe O'Mara has made a good argument for a JOA in this case. But I still doubt that Judge Nelson will rule in the defendant's favor.
What a blatant pair of crooks. IMO Hope her trial isn't another sham the public have to pay for.
Yeah like I said, and I guess I should qualify it this time since the only trials I've ever followed were murder trials, but this is one case that I've seen where this argument is actually relevant. The state has nowhere near proved their case.
Do you think GZ knew or heard what the term "stand your ground" means before the shooting? IMO

What I found to be incredibly sad was that someone, most probably GZ, was yelling for help as he said, no one came to help him. I don't think it was because they didn't want to help, but more so that they were afraid to help. It is more of a referendum on the status of our society today. Personally, I don't know what I could have done other than to call the police as the neighbors did.
I was discussing this trial with a woman who lives in FL, and she said she would have gone out no problem, with her .38 aimed and ready to fire. She would have no problem doing that. I don't own a gun, and I am chagrined to say that I would have been afraid to render assistance, when someone was yelling for help.
