Moorer supporters and attorneys react to bond denial

Judge Steven John explained his decision before denying the two bond. He said his decision was because of the seriousness of the charges, the condition of the state statute, the nature of the case, the potential punishment, consideration of all matters presented and whether or not the Moorers would show in court if they were granted bond.

Horry County judge denies bond for couple charged with murder in Heather Elvis case

Monday’s hearing shined more light on the relationship between Heather Elvis and Sidney Moorer and the alleged harassment from Tammy Moorer after she discovered the relationship.

Deputy solicitor Donna Elder told the court that Tammy and Sidney Moorer were having sexual relations in different locations around the Myrtle Beach area at about the same time Elvis disappeared.

Elder also said Tammy Moorer also handcuffed her husband, Sidney, to the bed and didn’t allow him to use the phone because she couldn’t trust him after Sidney had a relationship with Elvis.

Tammy Moorer’s attorney Greg McCollum pointed out during the hearing that Tammy, a lifelong resident of Socastee, has no prior record and a strong faith in the justice system.

“She doesn’t even have a traffic ticket,” he said. “She has a strong belief in the courts and looks forward to the point when she can face and answer the charges against her.”

Circuit Court Judge Steven John denied bond for Sidney Moorer, 38 and his wife, Tammy Moorer, 42, of Myrtle Beach during a nearly two-hour bond hearing in a packed Conway courtroom on Monday for a case that has played out on social media and national television.

Along with tips and support for Elvis’s family, theories, unfounded accusations and threats against both families have surfaced online. The case drew so many onlookers Monday that Horry County’s largest courtroom reached its 227-seat capacity and many would-be observers had to be turned away.

“This is about our daughter Heather. I’m asking you to protect our youngest daughter. I can’t have another child go missing. I can’t fathom that thought,” Terry Elvis said to John during the hearing. “It’s been threatened because of this situation and I believe it would get worse if bond was allowed.”

(snip)
“We put our life on hold. There’s a huge void in our life,” Elvis said. The family has not been “able to live without fear and threats” to them.

Heather Elvis’s family and supporters also filled the courtroom. Donna Vance, an Elvis supporter, put on her teal “Heather Elvis” T-shirt as she left the courtroom. The judge had barred such displays inside the hearing, and extra security measures were in force for those entering the court.

Officials also held the groups and released them in a staggered timeframe to allow them to exit the building and not cross each other’s paths. John sternly warned attendees about any emotional outbursts at the start of the hearing and said that if someone had an outward display or had an electronic device that alerted during the hearing, they would be held in contempt of court.

Police also have re-enacted what they think may have happened to Elvis at the boat landing on Feb. 28. Officers spent several hours at the location to determine tidal flows and how water circulates around the Peachtree Boat Landing to figure out how they might recover evidence in the case.

Testimony weaves a tale of how Moorers’ lives became intertwined with Heather Elvis

At this time last year, Sidney and Tammy Moorer were raising three children in their Socastee home and running their own businesses.

Today, they are murder suspects in the disappearance of Heather Elvis and at the crux of an investigation that has been marked by death threats to both sides, social media misinformation, text messages, video surveillance, GPS phone records and wild speculation.

The couple will remain jailed without bond pending prosecution on charges they kidnapped and killed the 20-year-old St. James High School graduate who Tammy Moorer had learned had an affair with her husband last year.

'No matter how long it takes’

For the Moorers the case is just beginning, but for Elvis’ father, the 90 days since his daughter was last seen is the beginning of “life sentence,” Terry Elvis wrote on a Facebook post Tuesday.

“I once was different, I once could understand, I once could live life and smile. But, then it happened, you vanished, my life was turned upside down, I still do not know where to turn to, suddenly everything changed, still thru it all, one thing remains constant, Heather my dear sweet child, no matter how long it takes, no matter the cost or the sacrifice, I your father and the rest of your family and your friends will never give up hope, we will never give up faith and we will never stop looking for you till we bring you home,” Terry Elvis wrote in the posting.

In court on Monday, Terry Elvis said his family lost a “vibrant young woman.”

“I miss her laughter and her light in our life,” Terry Elvis said. “Her potential was yet to be fulfilled. . . . We will continue to search for her.”

Horry County prosecutors not considering death penalty in Heather Elvis’ murder

The husband and wife accused of murder in the disappearance of Heather Elvis aren’t likely to face a death penalty if convicted.

Jimmy Richardson, 15th Judicial Circuit Solicitor, said his office is confident in the evidence they have accusing Tammy and Sidney Moorer of murdering Heather Elvis, but said it’s premature to talk about the death penalty.

“I think at this point we’re way too early to start worrying about death penalty,” he said. “Certainly we would want to have more evidence, we would want to have the body.”

SCPA says documents related to Heather Elvis case should be released

The S.C. Press Association says that requested court documents related to Heather Elvis’ disappearance, which Horry County withheld this week, should be released.

The Sun News filed a Freedom of Information Act request seeking documents detailing what was found during the execution of search warrants at the home of Sidney and Tammy Moorer, who are charged with Elvis’ murder.

Horry County spokeswoman Lisa Bourcier said that the results of the search warrants are exempt under state law because the information is to be used in a prospective law enforcement action or it would disclose investigatory techniques.

Bill Rogers, president of the SCPA, said Thursday that search warrants are not exempt under South Carolina law.

“You don’t need the FOI[A] to get court documents,” he said. “They are open under the constitution of South Carolina.”
