Trial starts Monday, May 17, 2021. Court TV and Law & Crime have notified the court they will be live-streaming the trial.
I am looking forward to this trial. But I do hope these 2 outlets do a better job streaming than past trial attempts.

Court Tv is notorious for cutting away for breaks during critical times in the testimony....and L and C had a spotty record in recent trials, not sending cameras during key days for some reason, For example, they streamed the Opening Arguments for Prosecution in McStay Family trial, but didnt stream the Defense OA, for some reason. It was annoying.
 
Thursday, May 13th:
*Pretrial Conference Hearing (@ 9:30am CT) – IA – Mollie Cecilia Tibbetts (20) (July 18, 2018, Brooklyn; found Aug. 21, 2018) – *Cristhian Bahena Rivera aka John Budd (24/now 26) arrested (8/21/18), charged (8/22/18) & arraigned (9/19/18) with 1st degree murder. Plead not guilty. $5M cash only bond.
ICE logged an immigration detainer on Rivera. Confessed to killing Mollie.
Trial set to begin on 5/17/21 with jury selection should last 2 days & trial starts on 5/19/21 (should last about 10 days). Trial moved from Poweshiek County to Scott County in Davenport. 12 jurors & 3 alternates will be seated.

4/15/21 Update: During the pretrial conference, Thursday morning at the Poweshiek County Courthouse, plans for the trial were outlined. All pending motions to be filed by 5/4 & jury instructions by 5/12. The trial is set to begin at 8am on May 17th at the Scott County Courthouse in Davenport with jury selection taking 2 days & opening statements staring at 9am on May 19th. All proceedings are expected to take 10 days. There will be 12 jurors with 3 alternates. 5/4/21: Motion in Limine by DA Scott Brown; Motion in Limine by Jennifer Frese. 5/6/21: Response to State's Motion in Limine by Jennifer Frese. Application to restrict access to records, Motion for elevated security level filed by DA Scott Brown. Resistance to motion to Seal filed by Jennifer Frese. Order to restrict access to records filed by Joel Yates. Other Order: Supplemental expanded media coverage.
5/10/21 Update: Summarizing Motions filed: The defense requested 4 items to be prohibited during the trial. If approved, the state of Iowa would be prohibited from: 1).Telling the jury about the defendant’s prior criminal convictions, 2) Allowing officers called as witnesses to give the opinion as to defendant Rivera’s actions appearing “suspicious, strange, or incriminating”, 3) Telling the jury allegations against Rivera’s prior criminal convictions or “bad acts” & 4) Using any transcript of any interview played in court. The prosecution requested the court to: 1) Not allow the defense to make statements or arguments to the jury related to the length of punishment, 2) Prevent the defense from referencing the administration of polygraph examinations, 3) Hold a pretrial for any witnesses called to testify concerning the statement of Rivera or any other statements being made on behalf of Rivera, 4) Prohibit the defense from using statement regarding comments made on Aug. 20 or 21, 2018 & 5) Exclude photographs of Rivera at gathering with young children or his children.

Prosecutors say Cristhian Bahena Rivera, now 26, is an immigrant from El Guayabillo, a town of about 400 people, in Guerrero, Mexico. Rivera’s Facebook page said he attended “Preparatoria 35,” a college in Guerrero.

He, however, has many relatives in the Poweshiek County area.

He spent the four years before Tibbetts' death working as a farmhand at Yarrabee Farms in rural Poweshiek County. He gained employment there through a former girlfriend and worked on day-to-day operations with the cows.

They declined to comment to the Des Moines Register leading up to the trial, citing trial preparations, but in 2019, Chad Frese told the Register he's known members of Bahena Rivera's family for more than two decades, representing some in court and meeting others at church or around the community.

They forgot Mollie’s boyfriend at the time, who, iirc, joined the military & deployed somewhere far away. He was at many pressers & interviewed often with Mollie’s dad. I think of him often & hope he is safe & healing from all this while serving this nation. Have wondered if he’ll be at trial- to watch, testify, or provide victim impact statement eventually.

"Originally from Mexico, Rivera was found to have been in the country illegally, although he had no prior arrest record. He had been working in the state as a farmhand. His former employer said he had given a false name.

Police said Rivera confessed to the crime and led them to Tibbetts' body. His defense has claimed he was coerced into confessing by police. "



There is often a certain amount of coercion, when a young girl is missing, and the suspect was seen on video circling her in their vehicle and running up to her on the street. LE cannot just politely ask the killer to confess and lead them to her body.

Suspects need to be protected from actual force and physical coercion. But there needs to be a balance. Suspects do not need to be kept comfy and cozy and happy throughout their interrogation.

This guy led the cops to her dead body. He may have been 'manipulated' or pressured into doing so---but he finally admitted to it. It was not a false confession. So I have no problem with some pressure in order to bring a dead girl back to her family to be put to rest.

If you do the crime you need to do the time, and all the uncomfortable stress that comes with it.

The trial will start with jury selection, which could prove difficult because of the politicization of the case and how much it has been covered in the media, according to KCRG-TV in Cedar Rapids, Iowa. It was moved from the county where Tibbetts lived for that reason.

"They will be asked whether they’ve heard about it," University of Iowa law Professor James Tomkovicz told KCRG
. "And they will be asked whether they’ve formed views. And you know if they say they’ve formed views and they can’t put those aside and listen to the evidence and decide based on that, then they’re not, they’re going to be disqualified for cause."

Coercion-schmercion. You can coerce someone to make a false confession, but you can’t coerce someone to have knowledge where the body is. Just say’n.

For those who don't get Court TV, local Iowa channel KWWL will be airing the trial live on it's livestream and Facebook pages There are links in the article. It says the time is to be determined. Just a reminder, that jury selection according to what I read before is not going to be aired so trial should not start on KWWL until Wed. They expect jury selection to last 2 days. I was going to check in the morning to see if Court TV is at least talking about it.
