Her lawyer is arguing that she has only abandoned the kids for 6 months so there’s no case as it’s not 12 months yet :mad:

Section 18-401 – Idaho State Legislature

TITLE 18
CRIMES AND PUNISHMENTS
CHAPTER 4
ABANDONMENT OR NONSUPPORT OF WIFE OR CHILDREN
18-401. DESERTION AND NONSUPPORT OF CHILDREN OR SPOUSE. Every person who:
(1) Having any child under the age of eighteen (18) years dependent upon him or her for care, education or support, deserts such child in any manner whatever, with intent to abandon it;
(2) Willfully omits, without lawful excuse, to furnish necessary food, clothing, shelter, or medical attendance for his or her child or children, or ward or wards; provided however, that the practice of a parent or guardian who chooses for his child treatment by prayer or spiritual means alone shall not for that reason alone be construed to be a violation of the duty of care to such child;
(3) Having sufficient ability to provide for a spouse’s support, or who is able to earn the means for such spouse’s support, who willfully abandons and leaves a spouse in a destitute condition, or who refuses or neglects to provide such spouse with necessary food, clothing, shelter, or medical attendance, unless by the spouse’s misconduct he or she is justified in abandoning him or her;
Shall be guilty of a felony and shall be punishable by a fine of not more than five hundred dollars ($500), or by imprisonment for not to exceed fourteen (14) years, or both.

I’ll try this a different way. The prosecutors wanted her to stay in jail or have bond set at an amount she couldn’t pay. The defense wanted her out of jail and set an an amount she could pay. Based on the testimony in Hawaii Chad had access to approx 150K. If forced to pay the full 10% he has those resources. The judge knew it, the defense knew it and the prosecutor knew it. Bail was set in a range that Chad was known to have. Defense won.
 
They didn’t present her with the opportunity to turn herself in bc she ran the other times . For sure a flight risk. This is disappointing. So she’ll go to chads house where his kids are living ?

Her attorney really tried to make her into a good person. I’m terrified she’ll hurt herself and we will never know where the kids are. I hope she ends up breaking conditions of the bail and ends up right back there
I also think the prosecutor missed an opportunity to point out that at the very moment that Lori’s Hawaii Councelor was trying to claim Chad’s residence in Hawaii, he was at the house with furniture movers moving out.
 
I dont think anyone involved is going to like her living in Tammy's house or sleeping in that bedroom either.

I doubt Lori and Chad will stay in the house where Tammy died. All the reporters will be camped out there. If Lori gets out then they will probably stay with CP or another loyal AVOW member who believes the hogwash about this all being a "misunderstanding". MOO.
 
I hope we can get one of our lawyers to explain these possibilities. We know they have so much information, and now that she is back in ID--how WOULD the Feds do something... and when and can they????

If they have the evidence they need, they CAN let Chad spend his dead wife’s life insurance money to bail Lori out and then swoop in and arrest her before she even makes it down the jail steps into his waiting arms ;)
 
I heard awhile back of someone getting arrested the minute they walked out on bail. But I need to mark my reply as speculation because I can't remember where I saw that. Jmo
Well, I will keep my fingers crossed that something like that happens. Would be funny to see her have to come up with more bail money. Chad's accounts will drain quicker. Now I have to go back and read the last 20 pages in this thread to see what else I missed today while I was at work. Any speculation of who she may stay with? That Parrot guy, perhaps? Or maybe Chad has rented a place for the 2 of them? I'm sure we will find out at some point.
 
Firstly, Tammy’s life Insurance people should freeze Chads bank account while LE is investigating Tammy’s death. Unless he’s emptied it / hidden anything left.

Secondly, Social Security should tell Lori she has to pay back the kids SS payments SHE has been getting in HER account since they went Missing in Sept. SS needs to stop the deposits FGS! Possibly freeze her account too.
Follow the money....IMO
I don't know if SSI has the ability to "show the kids OR give back the money"...

IMO she won't hurt herself. She fully believes that she can get away with it. She'll be defiant till the end.
 
IF someone posts bail, unless someone directly has a cool mil to give directly to the court, she will have to pay a bondsman $100,000 that is NOT going to come back to them...the bondsman will put up the remainder of the million....they take the 10% as their "fee" essentially...then if she runs, doesn't appear, etc, the bondsman is on the hook for it all and therefore will hunt her down...

I believe the 10% can be paid directly to the jail and is refundable is that possible in Idaho? In my State, a bondsman is not required.

My question - did Lori even make eye contact with her son? He said he tried to lock eyes with her.
I hope Colby is able to get in front of Lori while in Idaho, his goal for being there. I very highly doubt it would make any difference at this point, but I hope he gets that chance to confront her in person about his missing siblings.
