UPDATE: Twin Falls prosecutor pursues re-trial following recent hung jury

The Twin Falls prosecutor says he will continue to pursue the case against Joshua Molina after a hung jury verdict.

Tuesday the Twin Falls prosecutor Grant Loebs tells KMVT that it was without question whether or not they would try again and "I hope we can get all 12 jurors next time."

Molina will not be sentenced until his re-trial and Amanda Dunlap will not go to trial until Molina is through with his trial.

So from the article - he will be tried for ALL the charges again - or just the ones that the jury couldn't decide on? The 1st degree murder & the 2 counts of felony injury to a child.

The retrial will be for the remaining charges this jury could not decide. There is a status conference scheduled for 4/24/2020. The court record is also showing a motion and order to release juror contact information. I am sure the lawyers want to know where the jurors got stuck during their deliberations.

Twin Falls man found guilty of injury to girlfriend's child

TWIN FALLS — A jury has found a Twin Falls man guilty of injuring a child, but was unable to come to a verdict on a charge of first-degree murder and two other counts of felony child injury.

Joshua Molina, 35, was on trial in the abuse and death of Lyryk Altom, the 20-month-old daughter of his then-girlfriend, Amanda Dunlap.

Twin Falls County Prosecutor Grant Loebs told the court he wants to re-try the three charges the jury did not find a verdict on.

“I think we put on a good case,” Loebs said. “There are always improvements to make.”

A status conference hearing is set for April 24.

“The problem is going to be finding a date with the court calendar so full,” Loebs said. “We will, but it will be at the convenience of the court calendar and all the other trials that are scheduled.”

Dunlap has also been charged with nine counts of injury to a child — eight felonies and one misdemeanor — and first-degree murder in the toddler’s death.

A status conference in her case is set for March 16.

Dunlap and Lyryk moved into Molina’s home in August 2017.

Lyryk was taken to St. Luke’s Magic Valley Medical Center with bleeding in her brain on Oct. 8, 2017. A doctor at St. Luke’s told police he believed her head injuries were caused by non-accidental blunt force trauma. She was flown to a Boise hospital, where she died six days later.



No one saw who delivered the blow to the little girl. But Dunlap and another roommate told police they were in Molina’s living room when Molina came out of a bedroom carrying Lyryk’s “limp but contorted body,” Loebs told the jury Friday in his closing arguments.

Court documents said photos, text messages, and police interviews with Dunlap suggest Molina had physically abused the baby repeatedly in the months leading up to her death, and that he told Dunlap not to bring her daughter to a doctor.

Plead not guilty.
Status hearing on 9/17 continued to 1/7/19, waived preliminary hearing. 1/7/19 Update: Next Status Conference hearing on 4/8. 4/8/19: Status conference hearing on 6/11, pretrial hearing on 7/22 & jury selection on 8/1 & 8/2, trial starts 8/12/19. 6/11/19 Update: Next hearing 7/2. Status hearing on 7/29.
7/2/19 Update: Next status hearing on 7/29. On court site jury selection dates 8/1 & 8/2 & trial date 8/12/19 no longer listed. Might be the same as Molina’s court dates. 7/29/19: Next hearing on 8/27. 8/27/19: Next status conference hearing on 3/16/20.
1/16/20 Update: Defense attorneys were still submitting Supplemental Responses to Request for Discovery.
*Joshua Eric Molina (33/now 35) – Trial began on 2/25/20 & ended 3/8/20 with Molina guilty on one count of felony injury to a child, another count was changed to a misdemeanor, and Molina was also found guilty of that. The jury was unable to reach a verdict on the two other charges of felony injury to a child, as well as the first degree murder charge. Twin Falls County prosecutor Grant Loebs will decide whether or not to bring in another jury in hopes of reaching a verdict on the remaining charges. There is no word yet when sentencing will be. Status conference hearing on 4/24. Defense files motion & order to release jury contact info.

Trial began on 2/25/20 for Molina only & ended on 3/8/20 with guilty verdicts for 1 count of felony injury to a child. Will be retried on the 1st degree murder & 2 counts of felony injury to a child.

3/7/20 Saturday Day 9: Jury deliberated. Will continue on Sunday, 3/8.
3/8/20 Sunday Day 10: About 2:30 P.M. Sunday, the jury announced they found Molina guilty on one count of felony injury to a child, another count was changed to a misdemeanor, and Molina was also found guilty of that. The jury was unable to reach a verdict on the two other charges of felony injury to a child, as well as the first degree murder charge. Twin Falls County prosecutor Grant Loebs will decide whether or not to bring in another jury in hopes of reaching a verdict on the remaining charges. There is no word yet when sentencing will be.
