Dancer Didn't Die In Joliet Murder Defendant's Lawyer Argues

JOLIET, IL — After being in Will County's Jail for three-plus years, Joliet first-degree murder defendant Deointae Shawnrico McMillian wants his charges dismissed in the Nov. 10, 2018, homicide of Schaumburg dancer Danica Shernay Ford, 22.

Since November, McMillian's lawyer, Paul Napolski of Joliet's Essington Road, has filed multiple motions in hopes of getting his client's murder charges dismissed on the premise that Ford's slaying happened outside of Will County.

Napolski's motion alleges misconduct and incompetent testimony.

McMillian's lawyer contends that Will County Sheriff's Detective Kimberly Topolewski misled the grand jury during her testimony. She was the only person to testify before the grand jury.

In response, Assistant Will County State's Attorney Erin Krone argued: "The People deny that Detective Kimberly Topolewski either intentionally, purposefully, deliberately or inadvertently misled the grand jury by failing to disclose evidence that the murder occurred in another county and counter assert ...

Krone has asked the judge "to deny defendant's motion to dismiss these charges. Alternatively, should the court determine that this county is not the proper place for trial, the People respectfully request that this court transfer the case to the county which it determines is the proper place for trial."

*Setting (for trial) Hearing (both cases) (@ 9:30am ET) - IL – Danica Shernay Ford (22) (found in Woodland Memorial Cemetery on Nov. 12, 2018, Joliet; Id’d Nov. 20, 2018) – *Deiontae Shawnrico McMillian (24/now 28) (BF) charged & indicated (2/13/19) & arraigned (12/18/19) with 2 counts of 1st degree intentional murder & 1 count of 1st degree murder. Plead not guilty. $2M bond. And indicted (11/21/18), arrested (11/22/18) & arraigned (12/18/18) in Fayetteville, N.C. (was extradited to Illinois) also charged (11/12/18) with concealing a homicide. Plead not guilty. $2M bond.
Trial was set to begin on 11/30/21 for murder charge only was cancelled re Motion to Dismiss.

3/8/22 Update: Defendant is present in the custody of Will County Sheriff & by attorney Paul Napolski. People present by Erin M. Krone. Matter comes on for hearing on defendant's pro se motion for substitution of attorney. Defendant is admonished as to self representation. Defendant proceeds with self representation. Attorney Napolski is withdrawn from matter. Discovery to be tendered to the State. On State's motion, over defendant's objection, matter is continued for trial setting. Defendant remanded. Next motion on custody on 3/14/22 & setting (for trial) hearing on 4/13/22. 3/11/22: Motion for admonishment of defendant by the Court.
3/14/22 Update: People present by Erin Krone. Defendant is not present & currently in custody of Will County Sheriff & refused to be transported. Matter comes on Court's motion to admonish defendant.
