The fact that he admitted it several times to his WIFE is damning and speaks volumes. That pretty much negates the possibility that sarcastic declarations were maliciously taken as admissions, for me anyway. However, I'm still very, very curious about the context in which it was said. Was this a come-to-jesus moment for him and his wife? And beyond that, did he say WHY? I mean most of us are here to understand WHY people do what they do. Even when there's no reason, something led to the event. A whim? A fantasy? Rage? Something personal against them regarding an interaction?
I don't suppose the transcriptions themselves are included in the doc dump... I have them, but I've only looked at like a dozen so far.

Ok but unless he gave some info to his wife in that call that only the killer could know, then I don't think that is the end of this case really. Its not uncommon for people to confess to things they didn't do (even murder). I'd like to know precisely what he told the wife?

The killer walked with purpose per the witness statement to LE - I want to know if he had Libby and Abby picked out already as his victims? I'd like to know, what did he do in the days BEFORE the murders? How about the *hours* beforehand? And immediately after, where did he go? Did he go home and shower? Wash his clothes? Was DNA / transfer evidence from the scene found in his car??

The state's motion says "0n April 3, 2023, Richard Allen made phone call to his wife Kathy Allen. In that phone call, Richard Allen admits several times that he killed Abby and Libby. Investigators had the phone call transcribed and... #wthr 2/


...the transcription confirms that Richard Allen admits that he committed the murders of Abigail Williams and Liberty German. He admits several times within the phone call that he committed the offenses as charged. His wife, Kathy Allen, ends the phone call abruptly." #wthr 3/


The motion goes on to address Allen's deteriorating mental health condition. It says "Soon after, investigators were made aware by the Warden of Westville Correctional Facility that Richard Allen began to act strangely..." #wthr 4/


"...Richard Allen was wetting down paperwork he had gotten from his attorneys and eating it, he was refusing to eat and refusing to sleep. He would go days on end refusing to sleep. He further, broke the tablet that he used for text messages and phone calls..." #wthr 5/


"...He went from making up to 2 phone calls day as of April 3, 2023 to not making any phone calls at all. To date, Richard M Allen still has not made a phone call since April 3rd, 2023." Allen's defense team has argued any confessions were due to his poor mental state. #wthr 6/

Unspent, ejected rounds, and the markings that ejections and extractors cause on casings and unspent bullets, have been used by States as evidence to lock up murders since - at least Dianne Downs ... that's 1994 folks.

They had casings from rounds fired at the crime scene but never did recover the weapon. What they did have however was unspent rounds recovered from her residence that had been cycled through a weapon ... and the markings on those matched those found at the crime scene. See the Oregon Superior Court ruling linked below - relevent portion bolded in red font by me. Oregon Supreme Court went on to deny her appeal).

Suspect the defence is hanging onto a limb no matter how thin it may be. That ruling says only to me that the prosecution needs to ensure their testimony comes from someone actually recognized as an expert in this realm.

FACTUAL AND PROCEDURAL BACKGROUND
Petitioner Elizabeth Diane Downs was convicted of murder, attempted murder, and assault in the Lane County Circuit Court in Oregon in 1984. The jury found that she fatally shot one of her children, Cheryl, then age seven, and seriously wounded the other two, Christie and Danny, then ages eight and three. Christie testified at trial that she saw her mother open the trunk of her car and then shoot each of the three children. Ballistics experts testified that bullets taken from Downs's home had extractor marks identical to cartridge casings found at the crime scene. The marks were from a.22 caliber Ruger semiautomatic pistol, the same make of a firearm which Downs had possessed and used previously. Downs's gun was last seen in her possession in 1983. The murder weapon was never recovered.
Downs's conviction was affirmed on appeal by the Oregon Court of Appeals without opinion and the Oregon Supreme Court denied review in 1987.
