So what could that discovery compliance be for? Information as to his whereabouts on the 13th February perhaps?

What does that have to do with failure to report as a sex offender?

He didn't fail to report until ? Not sure about this information, if he was in court on May 29th, how could he be mia.

He appeared in court on March 6 and again on May 29.

Nations registered as a sex offender in Johnson County on April 10 with an address at the InTown Suites in Greenwood. He then went MIA."

I don't know. That's why I am asking. Perhaps they are asking his lawyer where he has been checking in since May ? He absconded for a reason and I guess they want to know why. Alternatively, they could be advising they are going to extradite him and asking for a response within 30 days.
 
I don't know but reading this legal site it gives the impression if Indiana planned to extradite they'd have acted when he was first charged in El Paso?

It'd be great if a legal expert here would offer their opinion.

They did act when he first got charged by issuing the warrant. Then they waited for the plea deal, then they issued this discovery compliance. I think we may be seeing extradition in progress here. JMO.
 
IMO he would return home and be happy there, whether or not he saw or could id BG. I think he would have already done that and reported it to LE if he had a tip. The reward would sure come in handy for him though. :cow:

If BG KNEW land owner saw his face Feb 13 (as an example, perhaps they rode in a truck together as in a hitchhiker scenario or land owner noticed him in the vicinity that day...) you don't think land owner would be fearful? I would be!

Reading the link, you'll notice warrants may be issued but the state may choose not to incur the cost of extradition. There's been no indication of an Extradition Hearing, which appears would be required.

Do any of even know what a "Notice of Discovery Compliance" means in legal terms? It's obviously not the same as Notice of Discovery.

I think we're just all guessing.

I think a Motion to Compel Discovery is simply the court wanting information and establishing a deadline for a response. That's my guess.

I thought the detectives who went to the hotel in July were told by the manager he checked out on the 12th May. I'll have to check the May 29th date - I don't remember that. He missed a Court date on 18 July I know because that was why they went to the motel on that day.

Not if he knows he is in custody and could get some reward. :smile:

I stated, way back when, that a large part of RL's trouble is living alone out in the country on land trying to maintain it and horses, etc. As soon as he started getting busted for DWI and had his license suspended he set himself up to be suspectible for a the possibility of becoming involved with unsavory or even criminal folks. He would either always need a ride or drive illegally, or need to hire someone who he may not know all that well. That is IF he was not associated with that element previously. He seems to have made his own bed, <modsnip> it is an easy step for many to hang out in a bar for companionship but it is a slippery slope. He faces the same dilemma now, going home for the remainder of his sentence. He will either need to move near public transportation or hire someone to drive him or else he will be back in the same boat.

It’s basically documents given to each party ( prosecution and defense) that they have to comply with certain court orders and sharing certain information about the case such as information on witnesses, and evidence to be used at trial.

He did not appear in court on 5/29. He was picked up on 4/25 and they entered it on 5/29.

He did not appear at the May 29 Hearing.

I sort of feel like they helped him out on that Greenwood stop Driving while suspended and Paraphernalia on 4/25 because of his pregnant wife and he was in the PDP up to that point. But for some reason they did not enter the infraction until 5/29. By that time he had already missed other court hearings and checkins and warrants were being issued.

How would an extradition (contested or otherwise) take place, without a hearing and a judge ordering the extradition?

Guessing isn't a reliable means of forming conclusions.....if anyone reading here is versed in law they're probably rolling in laughter!
 
Nobody was caught so it'd be impossible for anyone to ever know. Something to consider, crime stats for Delphi rank it fairly highly for property crime. There could be a reason, or it might just be that locals are active in their reporting.

I am sure there was another incident much closer to Feb 2016, that same winter, classified either as burglary or breaking and entering but it was in his home instead of the barn. But I have searched and can't find it so maybe I'm dreaming.
