Big takeaways from today’s #Delphi court hearing for defendant Richard Allen, who’s charged with the murders of teenagers Abby Williams and Libby German: 1. Trial date set for Jan 8-26, 2024

2. No suppression hearing today on whether ballistics testing/evidence is admissible. That hearing will be set later. 3. Judge did not decide if Allen will be moved to a county jail instead of the state prison he’s in now. She is considering testimony & will rule later. #wthr 2/

4. Prosecution and defense both referenced “incriminating statements” Allen allegedly made in prison. Prosecutor said Allen “confessed 5 or 6 times to killing the girls.” Defense team says the vague statements are inconsistent with Allen’s previous statements. #wthr 3/

5. Richard Allen appears to be in poor physical health. Even with help from police escorting him, he bumped into a wall and seemed to have poor balance. Has also lost a lot of weight since last fall and seemed dazed/confused at today’s hearing. #wthr 4/

 
Richard Allen’s attorneys have made their way into the courthouse. Allen is set to appear before a judge at 10am. No phones are allowed in the courtroom, so I will update as I can.

When discussing Allen’s state at the Westville facility the prosecution stated he made an admission. His attorney said he made incriminating statements. That was just briefly mentioned, we will hear more on that after we reconvene.

When asked about the “threats” mentioned inside Leazenby’s safe keeping filing with the court, he stayed there were no “physical” threats. Adding no actual threats were made to Allen or the facility.

The judge will not be deciding on a motion to dismiss key ballistic evidence in this case. This morning the defense called their 4 witnesses to the stand to testify on moving Allen.

Former Carrol County Sheriff Tobe Leazenby was the first witness to the stand. He testified that they can’t house Allen in their jail. He said they don’t have the staff or the capability to do so. He said if Allen was there he would have to be in general population.

Leazenby was questioned by the defense about his decision to put Allen in the Westfield facility, after stating he never went to the facility to check it out.

Leazenby said he made the decision to transfer Allen out of a fear for his safety and the facility.

When asked about the “threats” mentioned inside Leazenby’s safe keeping filing with the court, he stayed there were no “physical” threats. Adding no actual threats were made to Allen or the facility.

The Cass county sheriff took to the stand and testified about what their facility. He said that they have the capability of holding Allen but that he “didn’t want to”

A captain from the Westville facility talked about how the facility houses their inmates. And explained some of the questions on the defense rose.

UPDATE: Judge Gull will deal only with a safekeeping motion during Thursday’s hearing, according to I-Team 8 investigative reporter Richard Essex.

Allen’s attorneys want him moved to a new correctional facility because of his treatment in prison.

Gull and the attorneys are also discussing statements Allen made about the Delphi murders while in prison, Essex says.

The court will not take up the motion to suppress or the motion about ballistics evidence during Thursday’s hearing.

The court says it will create a new website to allow public access to some, but not all, of the motions filed in the case. This process could take up to a week to complete, according to Essex.

DELPHI, Ind. – Prosecutor Nick McLeland said in court Thursday that Richard Allen “confessed five or six times” that he killed best friends Abby Williams and Libby German on remote historic trail in Delphi in February 2017.

“He made multiple confessions to multiple people,” McLeland said on Thursday.

Richard Allen’s defense attorney acknowledged “incriminating statements” made by Allen but attributed the comments to his client’s deteriorating mental state.

“He has made incriminating statements implicating himself in the crime,” said Allen’s defense attorney, Bradley Rozzi.

Defense attorneys and prosecutors made arguments in court Thursday about statements previously made by Delphi murder suspect Richard Allen, including the reported “confessions” of the murders.

At the end of Thursday's five-hour hearing, Special Judge Frances Gull, McLeland and Rossi all agreed to a three-week trial starting Jan. 8, 2024. The first three or four days will be jury selection in Allen County. Then the trial will shift to Delphi for the rest of the trial.

Gull also indicated the secret filings from both the state and the defense ends next week. Both sides have sealed motions for what ordinarily are open to public inspections.

Gull said she will review the motions, and upload them to a website for all to see.

Some of those motions included requests to suppress evidence, which is what Thursday's hearing was supposed to address.

Thursday's hearing initially was to be a bond hearing based on the last hearing in February. The bond hearing was changed last month to a hearing to address motions to suppress evidence. But that didn't happen, either.

Court has wrapped up for the day let me brief you a bit.



Galipeau says he has no current concerns about Allen’s safety in the Westville facility.

The warden states that Allen has been on suicide watch in the recent months. He is on 24 hour surveillance via camera and a companion (an officer, or a fellow inmate).

He says Allen also has access to a tablet where he can download music, movies, and make phone calls. He cannot text.

Galipeau states he is being held in a-pod. And a 12 x 8 1/2’ cell with 24 hour surveillance. He gets to shower three times a week, gets three sets of clothing a week, access to commissary, rec time one hour five times a week. He can change his clothing whenever he wants.

The next witness to the stand was the Westville Warden, John Galipeau. He spoke to the type of facility Allen is being housed at.

The Sheriff says there have been no immediate threats made to Allen. He also said, “as long as I can get it arranged to get the transport done safely I don’t have a problem with that.” When asked if he would be okay with Allen moving to a different facility.

He also expressed concerns about transporting Allen. Saying they simply don’t have enough manpower.

Liggett said they only have five full time deputies and a jail commander. He said he also would be concerned with Allen’s safety since the crime he is accused of involves children.

Sheriff Liggett spoke to the size of the Carroll county jail. Saying that if their jail would be considered for Allen to move to, they would not be able to house him. He said “our jail is extremely small.”

Let’s talk about the states witnesses in today’s hearing, the first to the stand was Carroll County Sheriff, Tony Liggett.

She did approve a temporary restraining order against the DOC during attorney meetings with Allen.

The judge says she will take all of the testimony from today and release a ruling in the coming days.
 
Trial Date set for #RichardAllen, January 8-26, 2024. It is my understanding that RA is the only pretrial defendent being incarcerated at maximum security Westville. I can't really express how wrong and unusual this is. He is not CONVICTED, therefore, he should not be in a maximum security prison. He should be in a jail, like other defendants awaiting trial. And no, it's not for his safety. Hogwash. Jails house much less dangerous criminals and they have solitary arrangements (Note: #BryanKohberger's situation) He must be treated fairly or the just adjudication of this matter could be at risk. I hope Judge Gull moves him post-haste.
