The defense for IH filed a motion for immediate release. The motion was denied on Nov. 22nd.

Subpoenas have gone out for the trial. The defendant's lawyer has filed a motion for change of venue. I'm guessing the lawyer thinks he won't get a fair trial in such a small town where Halee was probably well known.

The defendant also filed a motion for a gag order on 11/30.

The gag order was granted for all trial participants effective Dec 19th.

Comes now the State of Indiana by its Prosecutor, Michael J. Perry, and its Chief Deputy Prosecutor, Levi J. Burkett. The Defendant is present and in custody of the Warrick County Security Center and with counsel, Mark K. Phillips.

Court hears argument on Defendant's Motion for Reconsideration Pursuant to T.R. 53.4 or, in the Alternative, Relief from Judgment or Order Pursuant to T.R. 60(b)(8); Court DENIES motion.

Attorney Phillips is heard on the State's Response to Defendant's Second Motion to Suppress filed December 22, 2017. Parties are heard on Supplement to Defendant's First Motion in Limine filed January 5, 2018; Court reserves ruling on this Motion until Trial.

Court hears from the parties on Joint Motion for Unredacted Jury Questionnaires filed January 5, 2018; Court DENIES Motion.

Attorney Phillips now files Motion for Individual Voir Dire and Sequestration of Jurors During Voir Dire; State objects; Court hears argument; Court DENIES motion.

Parties agree that photograph exhibits will be reviewed prior to Trial to determine what photographs will be used during Trial. Court indicates that the deadline for Preliminary Instructions is Friday, January 12, 2018.

Attorney Phillips now moves to continue Trial date of January 16, 2018 and cites reasons why; State takes no position. Court grants motion to continue Trial and Trial date of January 16, 2018 is now continued to May 1, 2018 at 8:30a.m. reserving two (2) weeks.

Per the case records on Doxpop, the state offered a plea deal of 60 years if he pleads guilty but Hagan rejected it.
 
Hoping Halee receives justice. My children are this age and these cases break my heart. Such waste.

An interesting section from this article:

Both Phillips (defense attorney) and Ridlen (deputy prosecutor) said in their opening statements that the gun allegedly used to kill Rathgeber was never found.

“There is no bullet, there is no casing and there is no gun,” Phillips said.

Both attorneys mentioned the possibility of other suspects.

Ridlen asked the jury not to speculate about other people mentioned during the trial, naming two men who witnesses might point to as potential suspects based on tips to law enforcement.

Phillips suggested investigators did not investigate those alternate suspects enough before accusing Hagan of Rathgeber’s murder.

Good point. I also read that they didn't find his DNA on the towel that was found with her body even though it matched ones he owned. I wonder if he used gloves?
 
A mistrial because jurors saw IH in a holding cell. Wow.....that’s ridiculous.

Yeah, I've never heard of that before. Just seems like grasping at straws on the part of the defense attorney.
