Judge Greg Granger has granted a motion for mistrial in the case of Isaiah Hagan.

The defense is requesting that Hagan be discharged.

Jury selection in the new trial began Wednesday morning. Attorneys will interview the jury pool to find 14 people to sit on the jury — 12 regular jurors and two alternates in case of emergency.

Co-worker says he was with Hagan the day before Rathgeber was found dead

Allen told the court he was interrogated after Rathgeber was found and that he told detectives multiple times he did not think Hagan killed Rathgeber.

He said detectives ask if the names Jordan Hughes or Thaddeus Rice meant anything to him.

However, outside the presence of the jury, Allen told the court he believed Rathgeber may have been killed in retaliation for having knowledge about the death of Jackson Wheeler – the baby of Jordan Hughes, a close friend to Rathgeber.

Court discussing witness (Jordan Hughes) the state was going to call her, but she was released.

The defense says the witness shouldn’t have been released because her testimony could be relevant to this case.

The judge ruled that if the state does not call this witness, the defense still can. State says they want to appeal the ruling.

We're told witness Jordan Hughes indicated she was going to plead the 5th amendment. The defense argued the witness should not have been released because her testimony could be relevant to the case.

Hughes' name has been brought up several times in the trial. The judge ruled the defense can call Hughes to the stand even though the state approved her release.

The state then said that they wanted to appeal that decision. The judge denied the appeal.

Pape was found guilty of second degree murder in the slaying of Rebecca "Becky" Friedli, 18. Pape and Smith were both found guilty of first degree murder in the slaying of Becky Friedli's mother, Vicki Friedli and her boyfriend Jon Hayward.

Both men could face life in prison without the possibility of parole. Their sentencing is set for Aug. 10.

Donna Hagan (IH mom) is on the stand. She’s a correctional officer with Warrick Co. She testifies she owned a 9 mm handgun but it is missing now. She noticed it was gone when police searched her house in April 2017. Donna says Isaiah was crying when they talked. "Isaiah told me he shot Halee accidentally. Later he took the gun and threw it in a dumpster."

After lunch - Phillips asked to adjourn for today to prepare a cross-examination for Donna Hagan. Court in recess until Monday morning.
