what I'm saying is that, if I were the defendant, I'd argue that the roommate(s) did it. And, yes, I would argue that they "said" they didn't notice anything amiss or an odor and that that is implausible under all of the circumstances -- including the dog with no request or instruction for care, the car in the drive or garage and whatever else there is to indicate that he's not "gone" -- possibly his cell ringing as someone suggested. Depending on what he usually did with the dog, that's probably enough right there. I'm guessing he didn't just leave the dog with no boarding and no request/instruction to his roommates about feeding and when he'd be back. And they haven't said otherwise. The smell is another implausible factor. Dead things stink big and intolerable -- especially in AZ in the Summer. So, if they didn't keep the AC at 68 or less every day, there was an undeniable stench. 4000 sq. ft. more or less isn't enought to mask it. Basically, that's two smallish one story homes laid on top of each other. Not a home where one wing doesn't know what the other is doing. The construction of any new home built in az after 2000, especially by KB, is appalling. There's no soundproofing or insulation. Just slap it up. You can hear people breathing in the other room. jmo
