Arraignments were held on Friday of two men indicted in the death of a kidnapping victim...

Both are charged with a count of murder, theft by unlawful taking, kidnapping resulting in death of victim and two counts of tampering with evidence and have $1 million cash bonds.

Both entered not guilty pleas to the charges on Friday in Fleming County Circuit Court.

Kentucky State Police Detective Wes Prather said during a pretrial hearing that officers turned their attention to Black after a video was found of him using Russ' credit card at an ATM.

Prather says a body has been found, but it has not yet been positively identified.

According to a spokesperson with the Kentucky State Police, the remains were only identified recently after Russ' military records were obtained by police...

"Did the witness say why Mr. Black and Mr. Howard may have killed Mr. Russ?" Black's attorney, Rowan County Public Defender Charles Landon asked Prather. "Robbery," Prather said. "That's what she (the witness) had said." During the hearing, Prather also told the court that Russ' cause of death was strangulation and blunt force trauma.

Black and Howard were both indicted and will be in Fleming County Circuirt on Feb. 6 for a pretrial hearing.

FLEMINGSBURG | Commonwealth's Attorney Kelly Clarke requested more time to decide if he would seek the death penalty in the case of murdered University of Cincinnati professor Randall Russ.

Clarke said he was originally supposed to decide if he would seek the death penalty for accused murderers Charles Black and Kevin Howard, by Aug. 28, but did not want to rush "such a serious decision."

"I was not comfortable making a decision so serious before examining all the evidence," Clarke said. "There is still outstanding DNA evidence and I just didn't feel like this was a decision that needed to be rushed. I have now talked with the family and I know where they stand, so I'm just asking for a little more time."

The charges against the two men came about after Black was arrested on Oct. 1 in connection with the disappearance of Randall Russ.


Black was arrested after officials said he led officers with the Kentucky State Police to a body buried in a shallow grave in the Hillsboro area of Fleming County. The body was later identified as Russ.

Black was questioned after evidence allegedly emerged of him using Russ's credit card to withdraw $700 from an ATM. Black told police Howard had killed Russ in his home while he was next door. Black said when he returned, Russ was bound and gagged and was dead.

Black said he and Howard took Russ's body to the area of Ringo Grange City Road, where they buried him in a shallow grave before cleaning Russ's vehicle and taking it to Fort Boonesborough in Richmond, according to Kentucky State Police Trooper Wes Prather.

A trial date for Howard and Black has been set for Feb. 8 and is expected to last about three weeks.

The trial for two men accused of murdering University of Cincinnati professor Randall Russ has been cancelled...

During a pretrial hearing Friday, Commonwealth's Attorney Kelly Clarke told Circuit Court Judge Stockton Wood that DNA evidence found at the crime scene had not yet been tested against Howard and Black's hair samples... "I don't see any other options but to cancel the trial for now since we don't have DNA," Wood said. "I'll set another pretrial hearing and you tell me what lab you want to send the DNA to."

Wood said he would set a new trial date at a later time, after more information is available on the DNA samples.
 
Kevin Howard and Charles Black, who both pleaded guilty to charges related to the death of a Dry Ridge man, were recently sentenced.

In July, Howard, 39, pleaded guilty to second-degree manslaughter and two counts of tampering with physical evidence. Black, 52, pleaded guilty to facilitation to commit robbery and two counts of tampering with physical evidence.


Howard was sentenced to 20 years in prison and Black was sentenced to 15 years in prison on Sept. 2, according to Commonwealth’s Attorney Kelly Clarke. The men were originally arrested in October 2014, after Russ’ body was discovered buried in a shallow grave.

They were charged with murder, tampering with physical evidence, kidnapping and theft of a vehicle over $500, but under $10,000. Both defendants could have been facing the death penalty.
