Suspect pleads not guilty for Natchitoches baby death, trial date set

NATCHITOCHES, La. (Natchitoches Parish Journal) - Felicia Marie-Nicole Smith, 27, has pleaded not guilty for the murder of Natchitoches baby Levi Cole Ellerbe.

The Natchitoches Parish Journal has reported that Smith pleaded not guilty on Thursday to the first-degree murder charge of 6-month-old Levi. Her trial date has been set for March 2020 and another judicial procedure is set for April 2019.

Levi’s mother, Hannah Barker, 22, was also arrested in the case and charged with being a principal to first-degree murder. She also pleaded not guilty and her court date is set for January 2020.


I have Barker's trial date as 1/13/20

can anyone get into Natchitoches Parish Detention Center/Caddo Parish 10th Judicial District County to see if there is a court date in April for Smith. I have next hearing for Barker as 2/25.

Judge Dyess set an initial motion hearing for Feb. 25, 2019 re murder charges. Trial set for 1/13/20.

Niner, do you have a link? My search dead-ended. I found a search court records link but you need a login and I'm not gonna do that. The other links to the Natchitoches court dockets went to a general calendar... for 2016.

So much for government transparency in LA. Sorry for the fail.

Preliminary exam hearing granted for woman accused in baby's burning death

April 30, 2019

"Felicia Marie Nicole Smith, one of two Natchitoches Parish women accused in the burning death of a 6-month-old boy, was granted a hearing to determine if there's enough evidence to proceed in her case after a judge cited the delay in appointing a public defender for her.

Smith and Hanna Nicole Barker both face first-degree murder charges in the July 18 death of Levi Cole Ellerbe, who was Barker's son. The cases are being tried separately....

The hearing was set for June 14, giving the Natchitoches Parish District Attorney's Office time to appeal her decision to the 3rd Circuit Court of Appeal, if they should choose....

The only other matter during Tuesday's hearing was a motion to modify another motion signed by Dyess months ago that sealed both cases from the public and press.

Strider said both the state and defense had agreed to the step because of "the sensitive nature" of the case. He said that original motion, which he wrote, was "overprotective."

A gag order already exists in both cases.

Both Strider and Brown agreed that the order should be modified to keep discovery, answers to discovery and exhibits under seal."

NATCHITOCHES — The state will decide by Aug. 1 whether to seek the death penalty for Hanna Nicole Barker, the woman accused in the July 2018 burning death of her 6-month-old son, Levi Cole Ellerbe.

Barker was in court Thursday [5/30] for a hearing on 22 motions in the first-degree murder case, all but one filed by defense attorney Dru Thompson.

Strider initially said Thompson would be the second person to know when that decision had been made, after Levi's family members. He then conferred quickly with Natchitoches District Attorney Billy Joe Harrington and told Dyess a decision would be made by Aug. 1.

The next hearing in the case is a pretrial conference set for Aug. 19.

Hearing continued for woman in homicide case of baby Levi Ellerbe


NATCHITOCHES — A preliminary examination hearing for one of the defendants in the burning death of infant Levi Cole Ellerbe was continued on Friday.

Felicia Marie Smith was in court Friday morning for the hearing, which was granted by 10th Judicial District Judge Desiree Dyess on April 30.

Friday's hearing lasted about 10 minutes. Both the prosecution and defense had agreed to continue the hearing without selecting another date, but they indicated the hearing would happen at some point.

Smith should be in court again on Aug. 23 for a hearing on discovery motions.
 
Natchitoches DA to seek death penalty for mother of baby burned to death

NATCHITOCHES, La. (KTAL/KMSS) – The Natchitoches District Attorney’s Office has confirmed the state’s intention to seek the death penalty in the case against a woman accused of burning her son to death.

Hanna Nicole Barker, 25, was indicted on a charge of first-degree murder in November 2018. A second woman, 27-year-old Felicia Smith, is also facing a first-degree murder charge.

THE SYSTEM had every opportunity and all of the power to remove him from her care and place him elsewhere. The family's hands were likely tied and the family was likely told "Until she does something to harm him physically, there are no grounds to remove her parental rights immediately, even if on an emergency basis" just like I was told. Unfortunately, in this state, unless she is willing to sign her rights over, is convicted of a violent crime, or is actively locked up for longer than 6 months, there is nothing the family could have legally done in this case. Stop blaming them.
