I agree with most of your points. The only answer I've gotten is that since it's a death penalty case, the DT is being coddled and allowed them to get away with unprofessionalism, IMO.


These things shouldn't be allowed in any trial much less a DP one. IMO, these issues are because the judge lacks the experience, knowledge, gonads, backbone and confidence needed to preside over a death penalty case.
 
Oh, there will still be all the appeals and all of these issues will probably be cited as error -- but they will be unsuccessful.

ETA: In fact, the reason they keep bringing motions is to preserve the issue for appeal. If they don't complain about it at the trial level, they can't raise the issue for the first time during appeals.

There have been many things appealed on in our cases that were never brought up at the trial level. They were never considered "mentally retarded" until the US Supreme Court ruled we can't execute the mentally retarded over a decade after they were sentenced then voila they became mentally retarded. 7 yrs and 10 million dollars later, one of them was released from death row.
 
Yes, that's a possibility as well. Assuming she was an invited guest, they could have made a previous arrangement for her to not park by the house. Because her cell phone was turned off, it's more difficult to track her intentions as it seems odd that she wouldn't call as she was getting close. Heck, nowadays - people are incessantly on their cell phones; e.g., "I'm 5 blocks away - okay, I'm 2 blocks away - okay, now I'm at the end of the street - I'm walking and I'm calling you from the driveway - okay, now I'm on your porch - oh, there you are - I'm talking to you as I see you opening the door, and so on."

The problem I see with her statement is that she lied about parking in the driveway. If she was an invited guest, not only would the truth have been the easiest thing to say, but it also would have been more helpful to her story of Travis not wanting to be seen with her in public if she had said there was a prearrangement for her to park down the road.

So, either way (invited or not invited), this is extremely important in my opinion. It is a key element to premeditation because she lied about it. If she was invited, why didn't she just say she did not park in the driveway because of a prearranged plan, or that she decided on her own to park down the street to avoid being seen by his roommates, or there was no room in the driveway, or that she didn't want to block his roommates' cars. Anything but lying shows there was at least a reason for doing what she did other than premeditation of a murder.

I would think JA would want to park as close as possible to house/appartment/townhouse. Just further to carry clean up stuff no?

I disregard what JA says, believe what JM says to make his case.

Wonder why the door is open in all the pics except the face shot where u can see the water running down the shower door and then next pic the door is clearly open?
Anyway I will never know the truth of that day just hope the jury finds her guilt y of pre med and this trial is over with soon.

Isn't that water dripping down his face and not the shower door? It follows the contours of his face almost exactly. If it were the door, it would run straight down due to gravity. Imo. But agree with much of what you say, such as being done with the shower pics and eager to hear "The jury finds the defendant Guilty." :)
 
IIRC Nurmi went into Private Practice. Tried to get off this case due to this. I believe he is being paid what he would charge if he was working at his Practise. My recollection anyhoo.

Hence the long "eeeeeaaaaaaaannnnnnddd, let's go backs....."
 
Tri-Color (or is it Strawberry Shortcake?) must be a real threat to JA! But the real threat to the Prosecution is the tattle-tale who ratted Tri-Color out! It only takes one juror, sigh!

On another note, I wish the Judge would tell AVL to stop smiling at the jurors every time she gets a chance! It's infuriating!

I wouldn't say tattle-tale. If Tri-Color truly did something wrong, I am glad a juror(s) spoke up about it. It shows they are taking their job seriously.

However, I doubt that's the case. I have a feeling this is Nurmi making a mountain of a molehill.
 
What I'm super curious about is how Nurmi got whatever info he did. Did he use the whole photo business as a set up to be able to talk to jurors individually and ask leading questions in order to do a little weeding?

No doubt. I am sure Juror #5 has been in the crosshairs for a while if not from day one.

Not a Lawyer but I do believe Nurmi is under no obligation to continue representing her. I don't think we will see a mistrial. Pretty standard to file these motions. IMO

Don't know about any obligation that Nurmi may or may not have, but his attempt to remove himself from the case was rejected by the court, in the past.
 
Dunno if he could but I wonder why he would. At $225 an hour, another long trial would allow him to retire when it is done.

Doubt it. He's in private practice now and has all of the overhead associated with that. $225 is not a very high hourly rate. He's probably being paid what the court found to be "reasonable and customary" for a person in private practice in AZ. After he pays his staff, supplies, rent, etc. He's probably clearing less than half of that.

Or park as far away as possible so as to not risk being recognized.

Also, if neighbors or roommates noticed a strange car in the driveway or near the house, LE could easily find that car and track it back to the rental by JA, therefore putting her as the last one to see TA alive.

I thought that too. I also wonder if MS and 'D' are a part of it. 'D' was insisting to speak to the baliff last week and MS appears to be the type to extract revenge. :moo:

I know she testified that she parked in her usual spot...in the middle of the driveway.

I don't believe her.

Had she parked in the driveway, Enrique certainly would've seen her car there the next morning when he left for work.
 
It would be interesting to read all the text messages and e-mails they sent to each other from May 26 to June 4. If we had all of those, I think we could easily figure out whether he knew she was coming or not.

Just imagine being a juror and the information you would want!!! We've seen so much more than what has been admissable in court.

Of course, if all of this were to come into court, the trial would never end.

The one thing that I would like brought to the jury's attention is the gun and knives in her rental car at the time of her arrest. It frightens me and tells me that JA was capable of killing again and perhaps even planned to do so.

I'm sure that there will be more than one book written about this murder and the trial.
 
Wait!!!!! someone point me in the direction to find the info about tri color? Another juror turned her in?? For what??
 
I kinda thought that was a pen attached to a chain (like at a bank) that she was using?

I can't really tell, she's alone in the room, has paper on the table. It looks like she reaches behind her and gets something, uses it to mark on the paper, then plugs it in again? It makes a noise...

No...it was rejected and he kept at it, saying he had just opened his private practice. Then they said they would pay his private practice rate and he "gave in." I forgot where I found that info.....no link to back me up
