Dr. Hebben said she had to sign a non-disclosure agreement in order to use the tests so I assume whoever sent them to the defense had to do the same. So the person in trouble is the person that sent them, not the defense. And I'm sure that's not something Judge Lowy wants to get into on the last day of the trial.

If the defense had disclosed everything they had and wanted to use for evidence at the beginning of the trial this would have been addressed then and it wouldn't be an issue now.

BBM. Yes, this is exactly the reason that the discovery process is laid out as it is. Both sides are supposed to have everything that is going to come out at trial. There can be exceptions for things that come up during it, of course, but anything that could foreseeably be used must be disclosed ahead of time. This allows the court to schedule things like a motions hearing to argue out these procedural issues. The intent is that once a case gets to trial, things should be able to run smoothly with few surprises.

It's normal to have a Daubert challenge here and there where the jury has to leave the room while a proper foundation is laid to certify someone as an expert. When there is a case with a lot of medical experts, that can slow things down. But the amount of withholding the defense has done isn't normal. They could have easily brought up much of this ahead of time, and had filed motions/held oral arguments before the judge on these matters to figure out what was out vs. what was in. That's very common.

I know I'm not verified here at at WS, so you can take what I say with a grain of salt, but I spent four years doing criminal defense litigation and I am very, very surprised by how the defense has conducted themselves in this case. :twocents:

I suppose a possible advantage to slowing things down would be jurors losing interest, but that's a gamble, as you don't know if they've also just come to the conclusion that he's guilty.

The defense isn't trying to slow things down - it's a side effect of what they are pursuing. They are trying to blindside the prosecution. They want to get experts and evidence in which would likely otherwise not be permitted. They want to prevent the prosecution from presenting other evidence which would harm their case. They also want to hamstring the prosecution by not giving them adequate time to prepare cross-examination by not disclosing all experts and evidence at the proper time.

My sense -- based on nothing but my intuitions about human nature and my experiences in business negotiations -- is that the defense was hoping to sneak some things in at the last minute precisely because they felt that they had the leverage to do so since the judge and ADA wouldn't want to risk derailing the trial for too long at the 11th hour. Seems to me as if the defense was counting on the judge giving them lots of leeway so as not to leave even a hint of a whisper of 'unfair trial' to avoid being reversed down the road, and that the prosecution could do nothing but complain. I hope that these things can come back to bite them in future trials. Unfair dealing may be a reasonable strategy in a one-off situation, but when a relationship is not strictly transactional, over time, it hurts more than it helps. That's why I always, always negotiate fairly and with integrity, no matter what the other party is doing. :moo:
