For all the locals following here who know KR can't be guilty and have to live in proximity to these events of police corruption and incompetence and a questionable DA office: I'm really sorry the jury are currently hung. Trying to send my virtual support and sympathy through the ether. Even in the eventual event of a hung jury and mistrial good things to come. :confused: to:) with time.
 
Someone upthread alluded to one other possibility, that being if a mistrial is ultimately declared might the judge then dismiss the case ‘with prejudice’? MOO

Excerpt from this reference (which is NY state and not MA; could not find details for the latter and IANAL):

“Once a criminal case has been ruled a mistrial, the prosecution may decide to refile the case. However, the judge may prevent them from doing so. When a judge rules a mistrial and dismisses a case “with prejudice,” the case cannot be retried later.”


Perhaps with due consideration of the presented evidence, testimony, and expert opinions the judge might review all and render such a determination? MOO
No way. That judge hates KR. No wY will she give her a chance to walk free.
 
A little while ago, Law & Crime switched over to some coverage about the protest outside the courthouse.

While on the one hand, I empathize with the O’Keefe’s, on the other hand I can also empathize with the citizens of Canton.

I watched yet another select board meeting from this past week where the town’s citizens were once again blown off, ignored, or escorted out of the meeting by police for asking questions they have every right to ask. Many of the citizens who spoke in that meeting are lining the sidewalks outside the courthouse today. And they’re not just random people. They regularly attend the select board meetings and have a vested interest. One woman was still asking for answers for issues she’d raised over a year ago regarding school budget expenditures. She was brushed off.

These people live in Canton. They KNOW the key players. They know the social climate in town. One person spoke about their fear of speaking out against cronyism and corruption because they knew it would have a negative multi-generational effect on their family. That person was a third-generation “townie.”

While I think some people are simply out for some fun and raising cain, the vast majority appear to be using the trial to highlight what they live with and see on a daily basis.

One protestor today (she, too, spoke at the select board meeting earlier this week and was basically brushed off), said she was never a political person. She was never a protestor. But this case has brought the corruption to light that the town’s citizens have been forced to live with, and she just couldn’t take it anymore (paraphrasing) so she got up off her couch to do something about it.

I don’t condone the harassment of the O’Keefe’s or witnesses in any way.

But I do support people exercising their right to assemble in protest against injustice and corruption. **Especially when they are footing the bill for said injustice and corruption as taxpayers.**
 
I think juries are people just like us who are entirely different in that we’ve all had different education, life experiences, understandings etc so I think it’s really rude to say they’re ignoring rational things in this trial or whatever, insinuating that they can’t possibly grasp concepts that we have.

I think KR should be acquitted of all charges. But I refuse to look down on jurors who are holding onto their G vote, too. We have posters on here who also believe she should be found G; I wouldn’t want to insinuate that they, too, are … too dumb to understand this stuff or that they refuse to acknowledge what I believe makes sense.

Additionally I don’t think hold outs are on a power kick. Why is it so hard to believe they are just standing firm in their stance because it’s simply what they believe? This is why we have juries of our peers—because we get different types of people from age to gender to professions etc. Different opinions.

I think the CW fell extremely short in their duties here and Lally screwed up big time. I think the defense did a remarkable job not just with their case but also in cross examining of CW witnesses. I think the judge showed a little bit of bias at times, especially her attitude yesterday. So I am hoping that ultimately KR is acquitted of everything, too.
 
iirc, either JMc or KerR shushed KR at the crime scene when hysterical (understandably) after finding JOK and saying "I hit him." iirc, they were acquaintances (?), they had something in common. Anyway, it wasn't until KR retained counsel that the verbiage "I hit him" changed. moo

I am really shocked at this hung jury....from my view point this is the most reasonable doubt I have ever seen in a case. But clearly some jurors don't see it.

Well J mc C thought she was bringing a jewel to the court when she testified, she had to be reminded..
