Thank you for posting this, I was trying to find his testimony. It wasn't cut and dried when they arrived at the scene at all.
It truly wasn't, they did not have much to go on at that point. No pieces of tail light were found until after 5pm that day, so they did not have that evidence at that point, either.
 
The CW played this:
You're aware he was beaten up by Brian and [his nephew] Colin Albert," Read said in the audio clip, the first time jurors have heard her voice during the trial. "I mean, we're all in on the same joke, right? My taillight is cracked and John was pulverized."

At that point, Bukhenik said he advised Read not to say anything further.

This was 6 months later. At that point she'd learned Colin was in the house that night. Something the cops never addressed. Trooper Buk probably didn't like hearing it out loud.
 
I can see how the story evolved from the testimonies given so far. From onset at scene, it was an undetermined physical altercation resulting in JOK cold and unconscious laying in the snow. They all saw his face, some may have seen his arm. But clearly, by 10:40 am (per YB's reluctant affirmation ) he did call the ME and he did state to her that it was from physical altercation/ .

What happened after that, to change the story to vehicular altercation?
Jen McCabe happened.....
The story morphed.
She had directly called LE to give 'more information', and the interview with the McCabe's , Brian Albert, Yuri and Proctor happened. Suddenly....we be movin' to get the vehicle...
And, we are here..
 
There is a very interesting quote without context, where KR said that Colin and (another cop) beat JO to a pulp, and my tail light was broken. That could mean anything with context, that she knew what happened and was involved. That she was involved, not involved, trying to figure out who broke her tail light. To get that quote in context would be a huge asset to one side. MOO
And following from this, now starting to wonder might there have been an altercation at the rear of the vehicle when he was supposedly dropped off? Was there a fight and someone had that glass in their hand? And what scenarios would have led to it being broken and the supposed glass shards (if matching the cocktail / bar glass) where they were found? And where is their placement and where located?

Someone posted a few days back up thread if there might have been a case where the glass was ‘whipped’ across the back of the vehicle? May be some merit to that. And IIUC the FBI or a report attributed to them indicated the injuries to the victim were not from having been struck by a vehicle?

How much force would it take to break that right rear taillight lens and housing? I am not sure…… but probably more than simply running into someone. Maybe it was compounded with some additional force from another incident or altercation? Or movement from other individuals? And there is still the supposed later strike with the vehicle when backing in close quarters near another parked stationary vehicle. MOO
 
I don't know the quote, but could she have been speculating based upon some things she knew at the time?

We haven't heard from Tom and Erin Beaty yet as they are defense witnesses, but we know Erin has said Colin called her for a ride from Fairview that night. She either declined or he found someone else. Erin reported this, possibly to a private investigator, and for her attempt to be helpful, she claims she was verbally bullied by Jen McCabe and a friend and told to keep her mouth shut. Erin is almost certainly how the defense even knew Colin was in the house that night, as no one else in the house that night ever mentioned him. We'll hear from the Beatys soon.

Karen knew Colin and about his not so good relationship with John. So the above sounds like her speculating and trying to find out what actually happened to John that night.

My opinion only, I'm just speculating myself.

Why would no one at 34 Fairview mention Colin being in the house? How could there be an innocent explanation for not mentioning his presence? What, everyone just 'forgot'?

There is zero reason not to be honest about who was there.

What does that suggest?

I would love to hear from anyone who doesn't think this is suspicious.

Why & how would police obtain a warrant for a house connected to a motor vehicle accident?

Between Karen’s admitted excited utterances, the witnesses that arrived on scene and physical evidence like shards of taillight & damage to her vehicle

There was literally ZERO EVIDENCE he was beaten or involved in a physical altercation

Typically, people that commit crimes like this HAVE REMORSE, don’t have FILTHY RICH attorneys willing & able to dazzle with this level of smoke & mirrors and bullpoop and PR team churning out propaganda. Most people have somewhat of a conscious and hope to take a plea.

Not Karen though.

Ah.. but per the infamous Jen McCabe testimony John was there that night. Testified to such on the stand, oops! Personally I dont believe a word that comes out of Jen McCabes mouth, except that John was there.. MOO

AJ walking out from court yesterday was speaking with a throng of reporters. He stated that the video shown in court was not just inverted, it was manipulated. He stated that the time stamp ( barely visible to us) on the video has the numbers clearly shown normally, instead of inverted, like they should have been ( on an innocently inverted clip ) . He is clear that this manipulation was done purposely and not an accident.

It was meant to falsely lead the jury.

I was just thinking the exact thing....thank you for writing it all out! All of these people possess a really unique skill of being able to not only butt dial and it never goes to voice mail, but their phones magically unlock as well. Jen McCabe, by her own testimony, seems to also be able to send texts while her phone is in her back pocket repeatedly butt dialing.

and yet they want us all to believe that the screenshots taken of text messages between CA and AMc, and between BH and KR are totally legit!
 
Is that from the partial recording they played in court where she said, "we're all in on the joke?" If so, I'd love to hear the words before and after the part they played.
