Judge calls off Saturday testimony in Casey Anthony trial

ORLANDO, Fla. — The Casey Anthony trial is on hold until next week.

Judge Perry announced that court would adjourn until Monday. He said a “legal matter” had come up.


Outside the courthouse, neither side would comment on the reason for the early dismissal. The Orlando Sentinel reports that defense attorney Cheney Mason shouted at the throng of reporters to get out of his way.

Judge Unexpectedly Adjourns Casey Trial Until Monday
Casey Anthony's murder trial was unexpectedly recessed only 45 minutes after it was supposed to start.

Casey and her attorneys gathered in Judge Belvin Perry's chambers. Casey eventually walked back into the courtroom, clearly upset, and began tearing up and dabbing her eyes with a tissue.

After about 45 minutes, Judge Perry walked back into the courtroom and said that due to an unrelated legal matter, court was recessed until 8:30am Monday.

Attorneys decline to discuss why court recessed early

Speculation soared that a plea deal might be in the making, a call for mistrial, or that there might be legal issues involving testimony by Lee and Cindy Anthony.


Jeff Ashton could only confirm that the sudden halt in the trial had "nothing to do with" earlier conversations in court about defense expert witness Dr. Kenneth Furton.

Asked whether a plea deal could be put on the table at this point in the trial, Ashton said: "I couldn't talk about that one way or the other. If I give you an answer, I won't be practicing law Monday."

One theory about the abrupt recess involved some reporting by Geraldo Rivera of Fox News.

Rivera described having lunch with José Baez, who "expressed deep frustration over what he believes to be rulings from the bench that limit his ability to make the abuse argument, however implausible."

Rivera also shared details about the Baez lunch with Juan Williams on "The O'Reilly Factor" television show.

He observed: "He [Baez] wanted that jury to know that those parents feared Lee Anthony was the father of Caylee Anthony. That's why they didn't want him involved in the birth. That's where he was going. The judge stopped it."

When objections were raised on Friday , Judge Perry did stop Baez from inquiring about marital problems between Cindy & George Anthony. He also stopped a line of questioning about why Lee Anthony had, "blocked" out his sister's pregnancy.

Whether Casey Anthony testifies or not, legal analysts, trial observers and mental-health experts agree the defense team must try to explain her behavior and her raft of lies in the wake of her daughter's death.


Lori Butts, a forensic psychologist from Davie who also holds a law degree and does criminal-case consultations. Such traits are "what makes a psychopath."

"They get themselves caught up in their lies," Butts said. "She creates her own reality."

She doubts Anthony, 25, is mentally ill, however, because she's too lucid, precise and logical.

Butts noted the difference between "mad and bad" prevaricators. Earlier in her career, Butts worked with women who killed their children. They were psychotic, and their delusional minds caused breaks with reality. They were insane, she said.

Sociopaths, on the other hand, lie "to get over" for their own advantage, Butts said. They're just bad.

"They're lying in order to get what they want, whether it's attention or money," Butts said. "In this instance, it's to hide the fact that her daughter is dead."

Casey Anthony's first-degree murder trial will resume this morning - two days after Chief Judge Belvin Perry called an abrupt, early recess in the proceedings without detailing why.

Even though Saturday was supposed to be an extended workday, the lawyers in the case met outside the courtroom and discussed matters that are sealed.

What’s coming Monday at the Casey Anthony trial?


Geraldo Rivera, last night on his Fox News Channel show, called the delay shocking. But he also cited ”an unimpeachable source” who said the legal issue “is expected to have no long-term impact on the trial, and further, it is still possible this contentious case could be wrapped up before July 4.”

Mark NeJame a legal analyst for WKMG-Channel 6, advised trial watchers to be “glued” to their sets at 8:30 a.m. Monday. “This is significant, this is substantial, this is a fundamental issue,” NeJame told Tony Pipitone.

NeJame discounted the notions there was a problem with the jury or a witness or that someone got sick. “You can take this judge at his word. He said it was a legal issue,” NeJame said

Judge Belvin Perry announced Monday morning that Casey Anthony's defense filed a motion Saturday claiming Anthony was not competent to continue the trial.

Perry said after the motion was filed, he ordered Anthony to be examined by three independent experts.

The psychologists examined Anthony over the weekend to determine if she was competent to continue with the trial, Perry said.

A secret conversation between Casey Anthony and her lawyers prompted them to ask for an emergency competency hearing and halted court Saturday, according to court records released this morning.


Chief Judge Perry responded that same day by ordering forensic psychologists Dr. Harry A. McClaren and Dr. Ryan C.W. Hall, as well as psychologist Dr. Daniel Tressler, of Altamonte Springs — to evaluate Anthony at the Orange County Jail.

The psychologists determined Anthony is competent to stand trial.

Judge OKs Funding For Unused Expert Witness

Taxpayers will foot a bill for more than $6,000 for a Casey Anthony defense expert who likely won't even testify during Anthony's first-degree.

Jose Baez filed a motion Monday asking for reimbursement in the amount of $6,850.

The amount was invoiced by psychologist Dr. William Weitz, who has since been removed from the witness list for the guilt phase of the trial.
Perry granted the motion Monday.

ORLANDO, Fla. -- While Monday marked Casey Anthony defense attorney Ann Finnell's first appearance in the courtroom since the trial began, jail records show she hasn't been a stranger to Anthony.

Finnell a death penalty-qualified attorney from Jacksonville, was not expected to appear at the trial unless Anthony is found guilty and a penalty phase becomes necessary.


On June 12, Finnell spent about five hours with Anthony, jail records show.

The Case against Casey resumes a day after her attorneys sought a mistrial and a judge ruled she was competent to continue the trial.

Testimony resumes Tuesday morning, a day after Anthony's attorneys asked the judge to select a new jury. The attorneys sought the mistrial based on a ruling by a federal judge in Miami last week. It declared Florida's death penalty unconstitutional.
