El Dorado County Superior Court Judge Douglas Phimister's order came over the objection of both the El Dorado County district attorney and sheriff, who oppose any contact whatsoever between the two co-defendants. Phimister authorized jail staff to monitor and record the conversations, but said the tapes or transcripts could not be turned over to the prosecution unless there was evidence of a crime being committed, such as an attempt to intimidate witnesses.

Phimister said he would reconsider the request by the Garridos' attorneys for face-to-face visitation at a hearing April 15. "We may expand the rights of the defendants, but if there's a problem with the first phone call, then that will be that," Phimister said.

The judge also appointed two Placerville attorneys to represent Jaycee Dugard's two daughters, who are 15 and 12, in the ongoing proceedings. Roger Runkle will represent the older daughter and Abigail Roseman will represent the other.

One of the attorneys' first duties will be to determine if Dugard's daughters have any objection to their address and phone number being released to the Garridos' attorneys. Phimister said he would consider their input on the same day he reconsiders the visitation request in April. The district attorney has previously said Dugard does not want to be contacted by the defense. Phimister said it would not be fair to allow Dugard to make all the decisions regarding her two daughters, noting that teenaged girls don't always agree with their mothers.

Jaycee Dugard and her family have taken the first step to sue the state of California for lapses officials made while she and her daughters were allegedly held captive by a convicted sex offender.

Dugard, her two daughters and her mother, Terry Probyn, have each filed claim forms against the Department of Corrections, Rachel Wall, a spokeswoman for the state's Victim Compensation and Government Claims Board, said Friday.

Phillip Garrido had been under parole supervision because of a 1977 conviction for raping a 25-year-old woman. He was released from prison in 1988 and placed under federal supervision until 1999, when California took over.

According to an investigation by the Office of Inspector General, mistakes in how California monitored Garrido began right away. Among them, he was wrongly classified as a low-risk offender, which meant looser controls on him, and one agent did not try to confirm the identity of a young girl he saw at the house while on a visit, instead trusting Garrido's claim that she was his niece.

The secretary of the Department of Corrections and Rehabilitation, Matthew Cate, has acknowledged serious errors in the handling of the case.

PLACERVILLE &#8212; Phillip Garrido's lawyer says the man accused of kidnapping Jaycee Dugard, hiding her away and raping her throughout her youth, is mentally ill, not manipulative. But his wife's attorney has a different take: He's both.
"People can be bonkers and still manipulate people, as in the case of my client," Stephen Tapson said after a Friday court hearing in the case. "My question is, is he crazy like a fox?"
Tapson also hinted at a separate defense strategy for Nancy Garrido, suggesting she was herself a victim, though she doesn't see it. The couple faces 29 felony counts in Dugard's 1991 abduction and years of sexual assault while in captivity near Antioch.
El Dorado County Judge Douglas Phimister ordered sheriff's officials to let the couple talk by phone inside the Placerville jail &#8212; two five-minute calls over the next six weeks &#8212; and set an April 15 hearing date to decide if the couple can meet face to face without compromising jail security.
"She's happier than whatever," Tapson said of his client's excited reaction to the ruling.

"Sometimes teenage daughters become recalcitrant with their mothers because of a different view on dating, lipstick, issues of importance," Phimister said. "All I want is for the children to be able to talk to their lawyers over the evidence that involves them."
In any case, Phimister said the lawyers, but not the Garridos, would be granted access to the contact information should either girl agree to turn it over. For now, the judge shelved a request by prosecutors for a protective order barring the Garridos from trying to contact Dugard. He expressed frustration that he could not find a legal reason to appoint a lawyer for Dugard in the case.

Pierson, the district attorney, declined to comment on the judge's rulings, but told Bay Area News Group that crazy-versus-manipulative was a false distinction.
"It's very clear you can be extraordinarily manipulative and what most people don't consider normal," he said.
Sitting in the courtroom gallery was Katie Callaway Hall, the victim in the 1976 kidnapping and rape that landed Phillip Garrido in federal prison, then on parole up until the couple's arrest in August.

SACRAMENTO, CA - An appeals court Monday rejected an attempt by state corrections officials to avoid turning over additional documents relating to the bungled parole of Phillip Garrido.
The California Department of Corrections and Rehabilitation (CDCR) sought to overturn a Sacramento judge's order that the department hand over all of Garrido's parole records as requested by several media organizations under the Public Records Act.
The CDCR argued publishing the documents could endanger the safety and security of its staff.

The CDCR was forced to release a number of documents Feb. 12 after failing to get an emergency stay from the appeals court. More sensitive documents, such as personnel and medical records, were allowed to be held back for a judge's review.
On Monday, the court summarily denied the state's petition, requiring the CDCR to provide Sacramento Superior Court Judge Patrick Marlette with a list of documents withheld from the initial release.
Marlette will review the documents before deciding which ones will be made public. He had previously set March 1 as a deadline for receiving those documents. A CDCR spokesman confirmed the department had complied.

ABC News has the first footage of Jaycee Lee Dugard, her mother, and her half-sister since Dugard was located last August, 18 years following her abduction. The footage is from home videos shot by the Dugards licensed by ABC from the family.

Part of the footage will be broadcast during Friday's "Good Morning America" and more will be featured on "20/20" and "Nightline" later in the day.

The programs also promise to present "Jaycee Dugard's mother's powerful plea."

Kidnapping victim Jaycee Dugard, held captive for 18 years in a ramshackle backyard compound, was seen cooking with her sister and mother and riding horses in recently shot home videos aired on ABC Friday.

In one video clip, Dugard's mother, Terry Probyn, thanks the public for its support and asks people to respect the family's privacy.

"Please give us the time we need to heal as a family without the prying eyes of photographers and the press," says Probyn, addressing the camera in an outdoor setting. "We released this video to show that we are happy and well, and when we have more to share, we will."

ABC played excerpts from their home videos during "Good Morning America," with additional clips planned later Friday on "20/20" and "Nightline."

Over the past six months, Dugard also has taken steps to reintegrate into society. She got a driver's license last month and obtained birth certificates for her daughters. ABC reported that she is completing her high-school equivalency degree and hopes to attend college.

It's the first glimpse at the freedom kidnap survivor Jaycee Dugard has enjoyed since her rescue last summer from the backyard lair where she was held captive for nearly two decades.

"Hi I'm Jaycee. I want to thank you for your support and I'm doing well," Dugard said in her first public statement since the arrest of her alleged captors. She is seated, dressed in a black shirt and jeans and a pink baseball cap, and feeding two spaniels.

"It's been a long haul," she said, "but I'm getting there."

Dugard and her family have been fiercely private since their reunion and say they are releasing their home video exclusively to "20/20" to ask for their privacy. They say they have been constantly stalked by the media and hope that showing the world that Dugard is happy and well will be enough for now.

Probyn made a direct plea to the camera and also struck down rumors that her daughter and granddaughters had ever been affiliated with or received financial support from an area church.

ABC plans to show video of Dugard, now 29; her mother, Terry Probyn; and her half-sister, Shayna, on "Good Morning America," "20/20" and "Nightline." Dugard has not been seen in public since she resurfaced in August.

"It's a very positive step for her to take," said Vicki Hanes, who lived in the town when Dugard was abducted in 1991. "She's been sheltered for so long and didn't have an identity in that camp she lived in.

"She had a cloistered lifestyle, and now, she's reunited with her mom. This is such a gift."

A September fundraiser in South Lake Tahoe at the Horizon Casino Convention Center raised $13,000 for her trust fund, Hanes said.

Hanes said she hoped Dugard's public exposure will allow her to "communicate her message."

"I'm happy she's doing it," Hanes said. "I hope she sees all the love she has received in the community."

Jaycee Lee Dugard and her family have released snippets of home video, with the kidnapping victim saying she is "doing well" and her mother pleading for privacy as they continue to bond and heal. The video, portions of which aired exclusively on ABC's "Good Morning America" Friday morning, with the longer version airing Friday night on "20/20," shows Jaycee baking Christmas cookies with her mother and half-sister, directly addressing the camera as she sits with two spaniels, and riding a horse as part of her ongoing therapy.

The home video first shows Jaycee, her 19-year-old half-sister, Shayna, and Probyn decorating Christmas cookies in the kitchen of one of the family's therapists.

At one point, they all laugh as Jaycee makes a mistake decorating her cookie. "I've never gotten to decorate a cookie before," she says. In another Christmas scene, the trio sits by a fireplace under Christmas stockings.

In an outdoor scene, Terry Probyn, 50, directly addresses the camera. "I'm Terry Probyn, and on behalf of my daughters Jaycee and Shayna and my two awesome granddaughters, we want to thank you for the love and support that you've given us these past few months. "It is my desire to share our miracle with the world, but it has to be done on our terms."

It's unknown where Dugard and her two daughters are, but for the first time in a televised interview, she's letting the world know that she's OK.

KCRA 3 asked Nancy Garrido's attorney why he thinks Dugard is now talking to the media. "I think the family and some people got together and decided this is probably the best way to avoid the press, and who are trying to find out where she is by saying here we are; therefore it's no big deal anymore, so please leave us alone," attorney Steve Tapson said. Tapson said he doesn't think the Garridos will see Dugard's comments on television.

The attorney said he'll try and get a videotape of the interview later to Nancy Garrido, who he says misses the girls. "She brings it up, says, 'I'd like to see the kids,' and obviously that's not going to happen," Tapson said. And regarding Phillip Garrido, Tapson said the defendant is crazy and manipulative.

There's debate as to whether Dugard will appear again publicly soon, or need to testify at the Garridos' trial.

One attorney tells KCRA 3 that all the prosecution needs is DNA evidence to link the Garridos to Dugards kids to prove guilt.

Phillip Garrido's attorney, Susan Gellman, said she saw Dugard on television and issued "no comment" in response.

RENO, Nev.—The man charged with kidnapping Jaycee Dugard and holding her captive for 18 years has been ruled out as a suspect in two unsolved murder cases involving children in Reno, police said. Phillip Garrido was cleared after investigators looked for similarities between the cases and Garrido's alleged method of operation in the Dugard case, Reno police Lt. Mike Whan said.<snip>
The unsolved cases occurred within two years after Garrido was paroled from a Nevada prison in 1988 after serving time for the 1976 kidnapping and sexual assault of a 25-year-old woman while he lived in Reno.
One of the Reno cases involved siblings Jennifer and Charles Chia, who were kidnapped on a 100-yard walk from a bus stop to their home in 1989. The remains of Jennifer, 6, and Charles, 7, were found nine months later about 60 miles northwest of Reno.
In the other case, 7-year-old Monica DaSilva was taken from her bedroom as she slept in 1990. Her remains were found three weeks later. Investigators found it interesting that no similar child abductions had occurred in Reno since then. Gov. Arnold Schwarzenegger ordered state corrections officials Tuesday to stop destroying sex offenders' parole files and to make as much of their contents public as possible.

The move follows the arrest of a paroled sex offender accused of killing a 17-year-old girl near San Diego last month and under investigation in the death of a 14-year-old who disappeared in the same area more than a year ago.

Until Tuesday, the department routinely shredded the files of parolees one year after they had been discharged from parole. The policy dates back to 2008. Before that, the department destroyed parolee files four to six months after discharge, depending on the severity of an offender's background. The files typically contain parole agents' notes regarding supervision, as well as records of any violations.

The shredding policy was common knowledge within the corrections department, but came as a shock to crime victims and their advocates.

Corrections officials have said they are limited in what information they can release on a parolee, and in the Garrido case unsuccessfully fought to keep his parole records secret. Garrido, accused in the 1991 abduction of Jaycee Lee Dugard, was still on parole and would not have had his file destroyed.

Officials said they will work to release more details on offenders as a result of the governor's directive. But some questioned how the previous policy ever made sense. "I almost fell off my chair when I heard this," said Assemblyman Ted Lieu, D-Torrance. "If somebody has the time to shred, they have the time to scan it into a computer."

State issues new parole guidelines
Officers will visit sex offenders twice a month, instead of once

The state issued new directives Friday to immediately tighten its supervision of sex offenders on parole in response to a mounting outcry over apparent breakdowns in two ongoing high-profile cases.

According to a summary of the new policies, agents will have to visit the homes of the worst offenders at least twice a month instead of the current once. Agents will also have to more aggressively monitor "all alerts and violations" of the GPS tracking system and document how any problems were resolved. And, parole officials will be required to notify law enforcement prior to reviewing a potential discharge from parole to learn whether there have been "service calls to he residence ... that might alert us to misbehavior which would require further investigation."

The new parole policy also comes in the aftermath of another case that has drawn national attention.

Phillip Garrido, a paroled sex offender, is charged with snatching Jaycee Lee Dugard off a South Lake Tahoe Street when she was 11 and holding her captive for 18 years. Garrido's parole records contained embarrassing revelations that agents missed numerous opportunities to discover that he was holding Dugard in Antioch and fathered two children with her.

California corrections officials have increased scrutiny of paroled sex offenders, a move that follows years of failures in how Phillip Garrido, now accused in the kidnapping of Jaycee Lee Dugard, was monitored.

A policy that took effect Thursday calls for parole agents to check records of GPS tracking for offenders who are on "passive" monitoring.

As a result, corrections Secretary Matthew Cate promised a series of improvements in how parolees &#8211; particularly sex offenders &#8211; are supervised. Higher-risk sex offenders are tracked through what corrections officials call "active" monitoring, meaning their movements for each previous day are checked daily.

As of March 1, corrections officials said there were 2,219 offenders on passive monitoring in California and 4,779 on active monitoring.
