Peterson Prosecutors Ask For New Judge

Peterson's attorney says the former Bolingbrook police sergeant is handling jail okay.

When asked if Peterson will have to testify if the case goes to trial, Peterson&#8217;s attorney Joel Brodsky said, &#8220;That's a decision, once again, that we'll have to make at the appropriate time.&#8221;

Peterson's attorneys also say they have not decided on whether to have a judge or jury try this case, but if they go with a jury, they will ask for a change of venue.

Glasgow's office would only say in a two-page document that it wants Schoenstedt replaced "on the ground of prejudice against the State ..." Brodsky said he would press Glasgow at a hearing on Thursday to explain his reasoning. Schoenstedt dismissed the gun charges in November 2008 after prosecutors refused to hand over internal documents between their
office and the Illinois State Police that led to their decision to arrest the former Bolingbrook police sergeant. Will County prosecutors told the judge such a move would open a "flood gate" for future cases.

Even a mundane request from Brodsky asking for daily visits between Peterson and his legal team was met with a long pause from Glasgow before he ultimately agreed.

The defense has not decided whether it will ask for a jury or bench trial but Brodsky said he was "leaning strongly" toward
seeking a jury from another county. He also said he doesn't know if Peterson will testify on his own behalf.

Peterson lawyer: Drew's bond 'astronomical'

Drew Peterson may own his Bolingbrook home and a small fleet of vehicles outright, but he has "no substantial savings or investment(s)" and relies on his $6,000-a-month police pension to support himself and four children.

That's what Peterson's attorney, Joel Brodsky, is arguing in court papers that seek to reduce his client's $20 million bond on charges he murdered his third wife Kathleen Savio.

Brodsky also says that Peterson, 55, spent two years in the Army -- where he "on occasion" worked in President Gerald Ford's security detail -- has no criminal background and is rooted in Will County.

The former Bolingbrook police sergeant owns two cars, two Harley-Davidson motorcycles, an Ultralight aircraft and has paid off a line of credit on his home, according to the filing in Will County circuit court.

Both sides are due back in court Thursday before Chief Judge Gerald Kinney, who is expected to hear the defense team's objections to a motion by prosecutors to replace the judge now hearing the case, Richard Schoenstedt.

UPDATED INFORMATION: Grand jury in Peterson case adjourns

A special grand jury hearing evidence in the disappearance of Drew Peterson's fourth wife has wrapped up its investigation and did not return an indictment for her murder, according to a statement Wednesday from the Will County state's attorneys office.

The investigation will be continued through the regular grand jury, the office said.

"It is critical to note that the investigations into the disappearance of both Stacy Peterson and Lisa Stebic are not concluded," the statement said. "Both investigations are being pursued vigorously. Now that the term of the Special Grand Jury has expired, these investigations will be advanced by the regular Grand Jury that meets weekly in Will County."

The families of both missing women expressed disappointment that the grand jury was ending without indictments in their cases, but said they were encouraged that the investigations would continue.

No indictment in Stacy Peterson disappearance

Will County grand jury has completed its work without handing up an indictment in the disappearance of Stacy Peterson.

Drew Peterson, already charged with murdering his third wife, Kathleen Savio, will not face indictment in the disappearance of Stacy, his fourth wife - at least for now.

Prosecutors, though, noted the latter investigation involving Stacy still is being vigorously pursued and a regular grand jury that meets weekly still could take action.

Peterson, 55, is due back in Will County court Thursday as lawyers haggle over which judge should preside in the high-profile case. Earlier this week, the defense objected when prosecutors sought to eject Circuit Judge Richard C. Schoenstedt based on an alleged bias against them. Chief Judge Gerald R. Kinney was brought in to possibly decide the matter.

May 20, 2009 (CHICAGO) (WLS) -- Police have discovered a woman's body in the Des Plaines River near the Big Basin Marina.

The badly decomposed body has not been identified, but police say it is a white female.

The marina is located at the Interstate-55 Bridge near southwest suburban Channahon. Several searches for high-profile missing persons cases- including Stacy Peterson and Lisa Stebic- were led throughout the area.

WGN 720-AM "Legally Speaking" hosts Greg Adamski and Karen Conti plan to stage a mock trial of "The People v. Drew Peterson" next week to air in June. Yet would that potentially taint a jury pool in Peterson's murder trial? Or is that a moot point considering how much attention the case has already attracted?

"We're not going to be treading on any ground that isn't a matter of public knowledge," Adamski said. "We're not concerned about the possibility of poisoning the jury pool... We're taking the public record and putting it into a legal format."

CHANNAHON, Ill. &#8212; A cleaning crew in suburban Chicago found a badly decomposed human body on the shores of the Des Plaines River on Wednesday, prompting speculation the remains were related to one of a couple of long-running, high-profile missing persons cases in the area.

Illinois State Police Sgt. Tom Burek confirmed the remains were human, but declined to say if the body was male or female. The Will County coroner will perform an autopsy on Thursday morning.

Burek said he would not speculate about whether the remains belong to Stacy Peterson or Lisa Stebic, two missing Will County women who disappeared in 2007 and whose cases have garnered national attention.

Peterson's husband, Drew Peterson, is scheduled to appear in court Thursday on charges he killed his third wife, Kathleen Savio, in 2004.

Savio's death, originally ruled an accidental drowning, was reclassified as a homicide after her body was exhumed and an autopsy conducted following Stacy Peterson's disappearance in October 2007.

Drew Peterson, being held at the Will County Jail on $20 million bail, has maintained he believes Stacy Peterson left him for another man and is most likely living outside Illinois.

Stebic, a mother of two, was last seen in Plainfield in April 2007. Authorities have named Stebic's husband Craig a "person of interest" in her disappearance but he is not charged with any crime. He has denied any involvement.

An autopsy will be performed today on the badly decomposed human remains found by a cleanup crew working Wednesday afternoon on the Des Plaines River.

The key question: Is the body that of either the missing Stacy Peterson or Lisa Stebic? But authorities say there is no timetable for making a determination.

This morning, Illinois State police dive crews were in the river east of the spot where the remains were found. Other investigators were scouring the shore area for clues.

The remains--reportedly mainly bones--were found along the banks of the river near Channahon, just west of Interstate Highway 55, an area where searchers have looked for Peterson since she disappeared Oct. 28, 2007.

Speculation spread that the remains might also be those of Stebic, the Plainfield mother who disappeared in April 2007. Stacy Peterson's family was alerted to the discovery by state police

A cleanup crew working along the Des Plaines River discovered a decayed body near Channahon, but police late Wednesday couldn't determine if the remains might be those of Stacy Peterson or Lisa Stebic.

"They're unidentified human remains," said State Police Master Sgt. Tom Burek, after the body, found on the riverbank, was transferred to a Will County coroner's van.

It appeared to be that of a woman, a law enforcement source said.

An autopsy will be done today, but a source said further forensic tests likely will be necessary to determine the identity of the body.

Relatives of Peterson and Stebic, who vanished in 2007, said they don't expect to immediately learn the identity of the body.

"We're just being patient right now. We're waiting," said Pam Bosco, a spokeswoman for relatives of Stacy Peterson, 23, of Bolingbrook, who vanished Oct. 28, 2007.

Naperville attorney John Paul Carroll may get some measure of fame now that he's joined Drew Peterson's legal team, but he may come to regret the spotlight. He's not exactly being welcomed warmly to the arena.

"He is the poster boy for capital litigation abuse," Kati Phillips, a spokeswoman for state Treasurer Alexi Giannoulias, told the Daily Herald.

Missing is any mention of this nugget reported by the Daily Herald: "In the 1990s, Carroll's law license was suspended for 18 months, according to the Illinois Attorney Registration & Disciplinary Commission. An ARDC disciplinary panel found Carroll filed false income tax returns, gave inaccurate accounting to a client, and charged an excessive fee, according to an agency report."

There is no timeline as to when the autopsy will be complete, but due to the high profile cases, it should be sooner than later.

The badly decomposed body was discovered by a river cleanup crew on Wednesday afternoon. They called police and moments later dozens of investigators converged on the scene and began scouring for clues near the remains.
"They said they would switch their effort to shoreline efforts on the floor. They did and here we are four days later and they found something. Hopefully someone's family can get some closure here," said the owner of a nearby river bar.

A blue barrel was spotted Sunday along the Des Plaines River just about a mile downstream from the remains.

DNA Will Identify Woman's Body In River

A witness at the scene said the body was taken from the scene about 7:50 p.m. after police and Will County coroners had investigated the body. The body weighed no more than 30 pounds and appeared to have been mainly bones, according to the witness.

A source at the scene said the body was not found in the water but off onto a nearby shore.

Witnesses said it was around 2 p.m. that a barge crew discovered the remains &#8212; not an intact body &#8212; near the south shore after spending the past four days clearing logs and debris.

A source said the remains looked like that of a small female wearing underwear, but that DNA testing likely would be required for a positive ID.

The coroner says the partial remains found in the river consisted of a rib cage, spinal column and upper leg bones; missing were the head, arms and lower legs. It wasn't known when the missing body parts became separated from the rest of the remains.

Shreds of blue jeans and a small amount of U.S. currency were found along with the remains, the coroner said.

He said it could take several months to determine when the individual died.

Late Thursday morning, Chopper 2 HD was above the Des Plaines River, and spotted a state police boat with divers on board looking for more evidence. A dented blue barrel was seen in the boat.

Drew Peterson's attorney Joel Brodsky says he met with Peterson Wednesday, and that Drew was aware of the body found in the Des Plaines River, and was reportedly "unconcerned."

State police say they don't know when definitive results of the autopsy will be released.

Joel Brodsky says he'll sitting in the back of the room when hosts Greg Adamski and Karen Conti of WGN's "Legally Speaking" program tape the mock trial next week.

"The People v. Drew Peterson" is set to be broadcast in two parts, on June 14 and 21.
