(PAUL KAUPAS, WILL COUNTY SHERIFF) "At the present time, he's a model inmate."

Behind the walls of the new Will County Jail, Drew Peterson sits alone inside a cell in the medical wing. These pictures provided by the jail show what it was like before this area opened.

During a tour of the facility I saw Peterson sitting alone in this very day room, known as DR 3.

Only now he's traded in his red jumpsuit for a dark blue one which signifies he's a new inmate who may not know all the rules, so the guards can cut him some slack if he messes up.

Peterson Grand Jury Hears Wire Tap Testimony
Updated 5:01 PM CDT, Thu, May 14, 2009
<snipped>
The grand jury is in its final two weeks of work toward a possible indictment in the disappearance of Peterson's fourth wife, Stacy. But no one, not even Peterson's attorney, knows whether he'll be charged.

Thomas Morphey, Drew's stepbrother, also went before the grand jury Thursday. Morphey went public with claims he helped carry a blue plastic barrel out of the Peterson home, which he now believes contained Stacy's dead body.

From his jail cell, Peterson spoke to the Today Show's Matt Lauer in a phone interview, which airs Friday morning. Watch an excerpt below.

Ex-Cop Peterson Defends Remarks
Peterson Called His Handcuffs 'Bling'

In a clip released Thursday, Peterson told NBC's Matt Lauer that it's not in his nature to hide.

Peterson called his handcuffs "bling" and his red jail jumpsuit "spiffy" as he was led into court last week. Lauer asked Peterson if he worries such remarks will make him seem unsympathetic.

Speaking by phone, Peterson said "there's no book written" on how he's supposed to act, and he doesn't think it would be better if he had tears in his eyes.

Soon a Grand Jury, which today is hearing testimony from Peterson’s stepbrother, will decide if he should stand trial for that murder as well.

“I’m also thinking that I’ll be released on bond and probably be found innocent,” he said.

Part of his confidence, he told Lauer, comes from the fact that he passed polygraph questions about Savio’s disappearance. He also said that the grand jury that indicted him last week was flawed, because it's a bunch of "regular people" who don't understand the law.

He said he doubts the evidence against him and believes he was arrested because public pressure mounted for the prosecution.

Peterson is being held in a brand new jail facility in Joliet, Illinois that he says is very comfortable. He told Lauer that he talks to his four children every day and that they expect him home.

In jailhouse interview, accused killer criticizes grand jury that indicted him

In a phone interview from the Will County Jail in Joliet, Ill., recorded Thursday and broadcast Friday, Drew Peterson told TODAY’s Matt Lauer that he’ll “probably be found innocent” of the 2004 murder of his third wife, Kathleen Savio.

In the meantime, Peterson said, “I'm being treated pretty exceptional. This is a brand new facility — the Will County Jail in Joliet. The staff’s very courteous and professional. I'm in a cell where I'm pretty much isolated from everybody. The only contact I have with people are the guards and the people who bring me my food.”

He also said that he hadn’t anticipated he would ever be arrested. “Now that it’s happened, we’ll have to move forward and defend it,” he said.

“I have phone contact with them daily, and they’re doing very well,” Peterson said. “The older two, they know what’s going on. They are aware of what's happening. And the younger two — I’m just with the police right now helping them.

“You told them you’re actually out helping the police trying to find their mom?” Lauer asked.

“I didn't say I was trying to find her, just said I was helping the police, and I believe that is what my son has told them,” Peterson replied.

'DREW PETERSON LAW'
Drew Peterson law used in Warrenville slaying case
Slain girl's statements can be used by prosecutors at trial

Joshua Matthews, 24, of Maywood, is charged with the Oct. 9, 2005, slaying of former friend Sade Glover, 17, in the driveway of her Warrenville home. Prosecutors contend Glover was fatally shot numerous times because she had filed battery charges against him in July 2005 for punching her in the face when she refused to hide his marijuana while he was on parole from prison.

State legislators broadened the state's hearsay-statements law last year at the request of Will County prosecutors, who want to use similar statements against former Bolingbrook Police Sgt. Drew Peterson, who is charged with killing his third wife, Kathleen Savio, and suspected in connection with the disappearance of his fourth wife, Stacy Peterson.

Peterson stood to lose hundreds of thousands of dollars, court documents say

Harry Smith, the attorney who was representing Savio in her divorce , said this week he has turned over to prosecutors the subpoenas he had issued to Peterson regarding his pension and other financial matters.

Smith, who twice testified before the grand jury investigating Savio's death, said it's his understanding that the county has hired financial experts to determine exactly what the economic loss to Peterson would have been. A state's attorney's spokesman declined to comment.

"I'm sure that's what Peterson feared -- mostly that she was going to take everything from him," said Sue Doman, Savio's sister.

She wrote, "I really feel Drew is a loose cannon" in a letter sent to the Will County states attorney's office in November of 2002.

She also wrote, "He is out on the streets of Bolingbrook patrolling and just taking the law into his own hands. I haven't received help from the police here in Bolingbrook, and I’m (sic) asking for your help now before its too late."

Savio sent a similar plea for help to former Fox Chicago anchorman, Walter Jacobson.

"When I found out Mr. Peterson was having an affair with a minor at the police department, he began to get very violent," she wrote. She went on to say "he knows how to manipulate the system and his next step is to take my children away or kill me."

"They were searching in weeds and bushes. I don't believe she is in weeds and bushes," he told Lauer. "She's out there somewhere living her life."

"He said to her I can kill you and I can make it look like an accident and no one will know." Statements like that from Kathleen Savio's sister Sue Doman, who lives in Machesney Park, make up much of the evidence prosecutors plan to use against former Bolingbrook police officer Drew Peterson in his murder trial.

But Doman believes the evidence will hold up. She says, "My sister had over 100 pages of documentation of everything in her life. She documented all the times she tried to reach out to people and no one responded."

Doman will face Peterson in court during his next appearance Monday.
She says for the past five years she's visited her sister's grave, grieving and asking how she died. Savio's birthday is next month and Doman says she's looking forward to going there to celebrate what she hopes is justice being served.

Peterson Faces Arraignment in Wife's Murder
Monday, May 18, 2009

Former police officer Drew Peterson could be allowed to stay at his suburban Chicago home as he awaits a possible trial in the death of his third wife.

Peterson, who has been jailed since May 7, is scheduled to be formally arraigned Monday on first-degree murder charges in the 2004 slaying of Kathleen Savio. Peterson's attorney Joel Brodsky is expected to ask a judge to reduce Peterson's bond, which is now $20 million.

Prosecutors: Divorce was possible Peterson motive
May 18
<snipped>
Six days before Kathleen Savio’s lifeless body was found in an empty bathtub in her Bolingbrook, Ill., home, Drew Peterson’s lawyer prepared papers telling his client he had been subpoenaed and was to be deposed in his ongoing divorce battle.

Peterson, indicted last week on murder charges in Savio’s 2004 drowning death, stood to lose hundreds of thousands of dollars in the divorce from the sale of the couple’s home and Sud’s Pub, his bar, according to court documents. Savio was also going after half of his police pension, which pays $6,000 a month.

Instead of losing a bundle, Peterson got just about everything after Savio’s death, including custody of their two children.

The Chicago Tribune has learned the state’s attorney’s office is making a closer examination of the divorce and what was at stake as it prepares for the prosecution of Peterson, who is scheduled to be arraigned today.

"We"ll enter a plea of not guilty to both counts," attorney Joel Brodsky said in court as Peterson stood next to him, dressed in blue jail fatigues.

Also in court Monday, prosecutors asked for a new judge because they say the current judge is prejudiced against them.

Peterson is in protective custody at the Will County Jail, instead of being held with other prisoners, Brodsky said.

"He's being treated well, and he's being taken care of," said Peterson attorney Reem Odeh.

"It's a little bit boring, but much better than normal jail circumstances," Brodsky added.

As prosecutors try to put him away, Peterson's words could play a big role even if he never takes the stand.

Prosecutors seek new judge in Peterson case
May 18, 2009 9:16 AM
<snipped>
UPDATE: Drew Peterson formally entered a plea of not guilty this morning on charges that he murdered his third wife, Kathleen Savio.

Meanwhile, prosecutors have asked for a new judge to be assigned to the case. The hearing currently is in recess.

Drew Peterson is scheduled to be arraigned this morning on charges he murdered his third wife five years ago. But the major issue at that hearing is whether he will get his bond reduced.

The arraignment at the Will County Courthouse in Joliet had been delayed because Peterson's lead attorney, Joel Brodsky, was doing a series of media interviews in New York, proclaiming his client's innocence, the day after Peterson was arrested on a Bolingbrook street.

As with all murder defendants at arraignment, the former Bolingbrook police officer will plead not guilty. But the major news to come out of his court appearance will focus on whether a Will County judge will lower Peterson's $20 million bail.

Prosecutors filed a motion at the hearing asking for a new judge. State's Attorney James Glascow didn't give a reason, and court recessed while another judge was called to handle rest of the hearing.

After his plea, prosecutors asked that Judge Richard Schoenstedt be removed from Peterson's case, citing "grounds of prejudice against the state."
In November, Schoenstedt dismissed felony gun charges against Peterson after Will County prosecutors refused to give the defense communications between Illinois State Police and the state's attorney's office. Those documents had led to Peterson's arrest on the gun charges.
The defense challenged the motion, and a hearing on the issue was set for Thursday before another judge.
The prosecution move derailed defense attorney Joel Brodsky's plan to ask that bail be cut from $20 million to less than $500,000.

Outside court after the arraignment, Savio's family said they did not want Peterson released on reduced bail. Savio's father, Henry, said his one wish is "to have this done."
Savio family members said they think money, specifically Peterson's pension, was a motive in the killing.

Drew Peterson's Words Could Spark Trouble
Murder Suspect's Relish Of Spotlight May Be Seen As Smart-Aleck Behavior; Enters Not Guilty Plea
CHICAGO, May 18, 2009
<snipped>
Drew Peterson may not take the stand if he goes to trial for killing his third wife, but his words could still play a big role as prosecutors try to put him away.

What this trial is going to show - if we even get to trial - will be that there is absolutely no evidence that Drew did anything wrong, anything at all regarding Kathleen Savio's death," Brodsky told CBS' The Early Show.

Bloom said even though most people who sit on juries want to be fair, they can still end up being swayed by things that have nothing to do with evidence.

“They say they won't, but they can be impacted by innuendo, suspicion, speculation and moral judgment,” he said.

That explains why Peterson reminds Black of a lawyer who displayed a mounted fish on his wall.

“It had a sign that said, 'I wouldn't be here either if I kept my mouth shut,”' said Black, chuckling.

Request for new judge delays Peterson hearing

Outside the courthouse, Brodsky blasted the state's motion to replace Schoenstedt, whom he called fair-minded.

"It's nothing but gamesmanship," he said. "I think it shows that the state does not want to try this case on the merits. It wants to try it on technicalities."

"For the prosecutor of the county to call the chief judge of the criminal division of this county prejudiced is quite extraordinary."

Brodsky, who today was granted face-to-face jailhouse visits with Peterson, said he was "leaning strongly" toward asking that a jury be picked from outside the county to hear the case.

He noted that Peterson had not cracked any jokes in court, and he added he had not instructed his client on how to behave. Still, after thearraignment ,there was a "little bit of levity" with Peterson, he said.

But Melissa Doman, Savio's niece, said she felt better seeing Peterson's demeanor changed.

"The smug smirk is gone," the Romeoville resident said. "I've seen him walking around for over a year with that smug smirk and it's gone. Now he's sitting in jail."

His trademark smirk gone, a shackled Drew Peterson learned in court Monday he'll remain locked up a while longer.
The prosecution's effort to eject a Will County judge from the case stalled the former Bolingbrook police sergeant's attempt to get a lower bond.

After Monday's arraignment, Henry Savio said it is his hope that the truth about how his daughter died comes out in court. The 73-year-old father said he is convinced that Peterson killed her for financial and child custody issues.

"My wish is to have this done," Henry Savio said. "My daughter was very determined. I always knew what happened to her couldn't just be an accident."

Added Melissa Doman, the slain woman's niece: "I've seen (Peterson) walking around for over a year with that smug smirk. Now, the smug smirk is gone."

Judge bounced; Peterson taunts Savio family in court

State, Peterson Team Fight Over Judge
By JOE HOSEY jhosey@scn1. com

May 19, 2009

JOLIET — Prosecutors bounced the judge from Drew Peterson's murder case, but lawyers for the alleged wife-killer are fighting to get him back on the bench.

At Peterson's arraignment Monday, State's Attorney James Glasgow accused Judge Richard Schoenstedt of "prejudice against the state" and moved to have him taken off the case.

"I think at this point I should step down and have another judge sit in my stead," Schoenstedt said as he made way for Judge Gerald Kinney to preside over Peterson's initial appearance with counsel. Kinney was in no hurry to get things under way, saying, "I haven't done much of anything in this matter."

And nothing much will get done until Thursday at the earliest, when Kinney will possibly hold a hearing to determine whether Glasgow can get Schoenstedt off the case.

Monday, Peterson remained silent, and even left it to Brodsky to reply "not guilty" when asked how he pleaded.

Still, the new Drew let his serious side slip long enough to "taunt" the relatives of his murdered wife, at least according to Savio's nephew, Michael Lisak. "He was waving at my mom, just continuously looking at my family, the Savio family, almost in a mocking way," Lisak said.

Brodsky, who during the hearing was granted daily, face-to-face visits with Peterson in the jail, claimed to be unaware of this.

The grand jury investigating the fate of Drew Peterson's last two wives wrapped up Tuesday with the testimony of potential star witness Thomas Morphey, a source said.

The grand jury's 18-month term is set to expire Thursday, but the source said it finished two days early.

The grand jury indicted Peterson two weeks ago on first-degree murder charges in connection with Savio's death, but no indictments are on file relating to either Stacy Peterson or Stebic's disappearance, although they may be under seal.

Pelkie declined to comment on whether or not the grand jury has returned indictments in either Stacy or Stebic's case.

Morphey, the last witness to testify before the grand jury, received immunity from the state's attorney's office within days of Stacy's October 2007 disappearance. The state police put Morphey in hiding for his safety for months, but he was called to testify for the first time just last week.
