thanks for the "bump", bde.

Pretrial is two weeks away, Friday February 10, and should be live-streamed.

bumping this up ... reminder that pretrial is Friday, Feb. 10.

Trial dates May 8-11

the decelopments in Chelsea Beuck case were the top story for Monroe County in 2016: http://www.lenconnect.com/news/20170101/monroe-countys-top-10-news-stories-of-2016

[I do not recall that the backpack robbery charges were dismissed]

It all began when Daniel Clay was arrested in Monroe for a robbery involving a backpack full of tattoo-making equipment.
The robbery charges eventually were dismissed when the victim failed to show up for a court hearing, but during the arrest process, DNA was collected from Mr. Clay and sent to a lab.

Very strange that the trial is 3 days long

That's because at WS we are used to trials lasting for months. But why do you think that? We are just an itty bitty area without many big crimes. Get 'em in and out. Not many big shot lawyers around here to dawdle. State the facts and let the chips fall.

Seriously though, he has already confessed, he does not seem to have any support system (family, friends) who are clamoring that he is innocent, there is a lot of evidence. I can't think of any reason to drag a trial out any longer than necessary.

anyone know time of pretrial today?

no .... Monroe is not good at keeping updated :gaah: I keep checking, but cannot find a single thing about today's hearing from any media source.

anyone know time of pretrial today?

I forgot it was today. I wish they would at least display the court happenings online. Let's hope for some form of an update. But since it's a pretrial, what can we expect today? I found a few different explanations online, but anyone with experience following other cases have any input?

Still nothing? :waiting: I wonder if it is even happening, or was rescheduled. I have to go out soon.

ETA:
GRRR!! they could at least let us know in the paper. I asked on the local newspaper page, and got the reply:

The pretrial was delayed until next week.

Sounds like a plea deal is in the works.

new article in the paper, but still had yesterday as his next court date. Four days set aside for the trial in May, but could last longer. The rest is a recap of what we already know, although a statement I don't recall did catch my eye:
During a preliminary examination in November, a medical examiner ruled that Ms. Bruck was beaten about the face and died of those injuries. Mr. Smith argued in court that it was possible his client accidentally killed her by choking her during a sexual encounter after a party near Newport.
So it would seem they are just arguing it was accidental, hoping for a lesser sentence than murder1. Sounds like a guilty admission to me.

I believe they originally were going to murder2 bc they didn't think they could prove it was premeditated. During the trials in the fall, the prosecutors asked for murder1. (If I am recalling correctly. )

Also, he is facing the charges from the other incident when he was in the apartment with another woman.

http://www.fox2detroit.com/news/local-news/186793837-story

"Daniel A. Clay was arraigned in Monroe County for raping a woman after entering her Monroe apartment in July. He was charged with first-degree criminal sexual conduct, a life offense and first-degree home invasion, which carries a maximum penalty of 20 years in prison."

That victim spoke in court as her own witness. Thankfully she survived and came forward to be able to share her story against this monster, since CB cannot...

This article explains the details of that situation. Ugh!!!

pretrial today:
judge said defense can hire medical expert, cannot hire sexual behaviorist specialist (at public expense)

http://www.monroenews.com/news/20170217/yes-to-medical-expert-no-to-sex-expert-in-clay-case

During a pretrial hearing before 38th Circuit Judge Daniel S. White, the attorney representing murder suspect Daniel Clay argued among several motions that he needed a psychologist to testify at trail that it is a relatively common practice for people in their 20s to choke one another during sex as a way to increase
stimulation.

Don't believe it one bit it is not common for consenting adults to choke each other.

Oh my lord. Again, should've called for help or took her to a hospital instead of leaving her in the middle of the woods and staying quiet for months.

(And it bugs me how articles these days are obviously not proofread. "Trail".)

So blame the victim.... again. And yes, articles and even newspapers are awful for typos (as am I, these days. But I still hate how lax society has become)

Thanks for the article. I'm local and forgot and somehow missed it.

This is basically the same article with a little more added.

http://www.monroenews.com/news/20170218/preparing-for-clay-trial

[Mr. Roehrig, Assistant Prosecutor] "This is not a Daniel Clay case," Mr. Roehrig said. "This is a Chelsea Bruck case."

In the next few weeks Judge White will hold what is called a Walker hearing where he will decide if certain statements made by Mr. Clay during the hours-long interviews with detectives can be used as evidence or should be suppressed.

So, no date yet for the "Walker Hearing" - it did say "in the next few weeks" - I take "few" to mean about 3! :) So, from the 18th - 3 weeks would be about March 8th...
