Why is this only "attempted" child abuse? I don't get it. Does the legal system have blinders on?

It happens all the time. Rape is pled down to statuatory rape, etc. It is supposed to move cases through court quicker.

Behind the plea deal was emotional blackmail. Wade Rogers, Baby B's grandfather, was a disabled Viet Nam Vet..in a wheelchair. Ashley took B to NC for several visits after her birth. Wade passed away from Agent Orange( and stress,imo ) in Feb. The defense was prepared to paint him as a horrible child abuser and pretty much dared Ashley and her mom to fight it. The expense of going back and forth from NC to Mi, their friends being harrassed by the defense, Wade's name being tarnished was too much for Debby. Her goal was to get B out of Michigan and away from Coleman.( Debby is grandma, has custody) The Coleman family had also tried to get custody of B, they did all they could to make the prosecution of Kirk all but impossible.
I cannot remember when I have been so disgusted.
Also..those that factor the "he was in Iraq" into this...he was never in a combat zone, never saw combat, in fact he was behind a desk hundreds of miles away...he did not fit in well with other soldiers and was given a general discharge, vs honorable.
He was never injured, nor does he have ptsd, unless it's the fact he couldn't be away from mommy.
He abused siblings, killed puppies, etc. And he gets his hand slapped.

He has entered a plea deal where he may serve as little as 0-9 months or as much as 5 years. Sentencing will be July 17th.

How can he receive such a light sentence?
He beat her, he raped her she was only 3 months old.

I have at least a hundred very graphic photos of Baby B and her injuries. I put the least graphic and least identifiable on Sass a week or so ago.
This is an ATTEMPT...that's what he plead to. I don't know how to put the pics in here, or I would...
Thank God it was an ATTEMPT..imagine what she would look like if he succeeded, huh ??

you cannot fault Baby b's family-they want justice sure, but not justice at any price. And then there is the Coleman family-Kirk is so non-descript and unimpressive looking, it is only a matter of time before he meets a new woman and raises the possibility of a new infant being available to him...Oh My Lord, please protect the next tiny life to come across his path.

Kirk ’s plea of ATTEMPTED child abuse was accepted a couple of weeks ago. He faces 5 years max incarceration, and does NOT have to register as a sex offender.:furious:

"Boulter testified Coleman wrote a statement in a conference room at Mott Childrens Hospital at UM on Sept. 15 saying he was the one who injured the baby. It was after the second time Boulter questioned Coleman, possibly a 20-minute session.
Boutler said he then got Coleman's father, Tom Coleman, to come into the room, warning him, "You may not like what you are about to hear, but your son needs your support."
Boulter said Coleman wrote a second note saying he was responsible for the baby's injuries and gave it to Rogers, who handed it to Boulter."


He wrote two notes confessing to the crimes against his daughter, which had taken place for a period of WEEKS prior to the child being brought in to the ER. I commented on few other sites about this case; he started this abuse when his child was just over One Month old....what kind of evil is that?

I guess we should be happy that he will await his July sentencing in jail. That will probably count toward time served.

I just don't see this being an accident or a case that should have been allowed to be plead down.

Judge McBain went above the guidelines and sentenced this thing to 3 1/2 to 5 years in prison. McBain's hands were tied by the defense and the timid prosecutor in Jackson, Mi. Defense lawyer Hurst is going after McBain, also for being to *judgmental* ( My interpretation )

This sentence should cause tremendous outrage.....once again, forget the child, coddle the criminal pedo.:furious:

Baby B was flown to U of M hospital from Foote Hospital in Jackson, Michigan last Sept with life threatening injuries she had sustained over a period of days. She had also been raped. Kirk Coleman, 27 at the time, admitted to a Detective and to his wife Ashley Rogers that he had done this. He also confessed in writing.

How much more proof do they need? Good Lord!?!?!

This baby had 17 broken bones. Two broken femurs, eleven broken ribs, two fractured tibia, both eye sockets were broken and she also sustained 3 skull fractures. And she had been raped. Less than 3 months old. A pediatrician stated at trial that he had seen infants survive 100mph car crashes with less serious injuries.

This baby is disabled for life... yet this sorry sack of chit will get a few months then walk. I'm gonna be shocked if the mother and other family members don't feel overwhelmed and a bit on the "distraught" side to take matters into their own hands. Maybe they can get the same lenient, pedophile loving defense attorney.

This is the exact reasons that victims and their families feel the law has failed them.

Absolutely revolted by this sentence. There should be total OUTRAGE over it and it should be increased. If I had my way, this baby rapist would never see daylight again. He wants burying alive

There are some crimes....and this is one of them.....where a "plea deal" should not be allowed. 14 months was the max he could get with his plea arrangement.

The wife lost custody too after the child was hospitalized. She then crossed every t and dotted every i in order to prove to DYS that she was fit to visit and then live with Baby B. I do not believe she has complete custody as of yet-I believe her mother does. IIRC, the defense was going to throw mud at the disabled army vet terminally ill grandfather (maternal) who had visited the child during K Coleman's spree-Mom and grandmother agreed to the plea deal as long as K's parental rights were severed....I can understand their desire to deal out of the nightmare, but the fact that Coleman has a wealthy family in the community and the community has a history of wrist slapping violent pedophiles cannot have helped with the desire for vengeance.
