Tuesday, May 24th:
*First Appearance (@ 1:30pm CT) - MN - Eli Hart (6) (Found deceased in mother's trunk, May 20, 2022, Mound) - only for *Julissa Angelica Genrich Thaler (28) “mother” arrested (5/21/22) & charged (5/23/22) with 2nd degree murder (with intent/not premeditated) & firearm use or possession. $2M bond, with conditions & no contact with witnesses.
*Robert Paul Pikkarainen (27) arrested (5/21/22) for probable cause of murder. No formally charged yet. No bond.
According to the Orono Police Dept, officers received a call just before 7:10am. on a report of a suspicious vehicle driving on a rim with its back window smashed out. When officers located the vehicle, they conducted a traffic stop at Shoreline Drive & Bartlett Boulevard in the city of Mound and noticed blood inside the vehicle. Court records reveal that Eli Hart's father, Tory Hart, had been fighting for custody against Hart's mother. In January 2021, Dakota County filed a child protection services (CPS) order & gave legal & physical custody of Eli Hart to Dakota County Social Services. Tory Hart filed to establish full custody on March 11, 2022 & on March 30 a judge ruled to maintain Dakota County Social Services' custody of the boy. The case was then given an inactive status while the Dakota County CPS case was being resolved. On May 10, Eli Hart's mother was granted full custody. Police say that the boy’s death is being investigated as a domestic incident. An autopsy revealed Eli was shot multiple times & that his mother, Julissa Thaler, had human remains in her hair when arrested by police.
5/23/22 Update: Charged with 2nd degree murder-with intent/not premeditated & firearm use or possession. First appearance hearing on 5/24/22.

Here's a more explanation on his charges that will be heard today. He violated his probation when he got arrested the other day.

He won't have a new case number unless he is officially charged in this case. His case number will be for his charge that he violated probation on. 27-CR-20-6950
 
Social workers and Dakota County officials who oversaw the case failed Eli. They need to be held accountable.

It seems like the social workers knew there was a problem, but the judge awarded custody in spite of their concerns. It's not the social workers failure if the judge won't listen to them.

So why did a Dakota County judge close the child protection case?

He was following the recommendations made by the very social workers who raised those red flags, who wanted the case to proceed in family court, records show.

The boy’s father, Tory Hart, filed for full custody of the boy in March, but the judge in that case made it inactive as long as the child protection case remained open.
Under state law, the only way for the custody case to move forward was to close the protection case.

In Minnesota, child protection cases take precedence over almost any other case regarding a child’s wellbeing, said Joanna Woolman, a Mitchell Hamline School of Law professor.

Court records show that Dakota County District Judge Tim Wermager awarded custody to Thaler despite recent concerns about her fitness expressed by a court-appointed guardian and a county social worker who met frequently with Thaler, her son and other family members.

In a report May 4, guardian Sherri Larson said she was "very concerned about Ms. Thaler's mental health." She noted that Thaler was trying to limit contact between the boy and his father even though Hart "appears to be a stabilizing force in Eli's life."

Larson nevertheless recommended that custody of Eli be returned to Thaler, court records show. Larson did not return calls Tuesday.

County social worker Beth Dehner also recommended that Thaler be awarded full custody despite misgivings. In a May 4 monthly report to the court, Dehner said Thaler had not attended weekly therapy sessions for months and "lacks insight into her own mental health and behavior."

Dehner said Thaler also had been neglecting the medical needs of Eli, who had a rare genetic disorder called Townes-Brocks syndrome, which led to kidney disease and hearing problems. She said Thaler failed to make sure her son's hearing aids were in working order and that she often brought him to school late.

Still, Dehner said in the report, "There is no current indication that her son is physically unsafe in her care."

Dehner did not return calls Tuesday."

no, it is. see the link I posted. they had all these concerns and decided on reunification DESPITE their concerns.
