If ever a case SCREAMED for the death penalty, this one does. :furious: :furious: :furious: I'm sure she'll plead not guilty by reason of insanity but she knew EXACTLY what she was doing and had planned it for months.
 
If you watch the videos at that link, it says that Bobbie Jo was stabbed with a kitchen knife...apparently not strangled. The original affidavit says she was strangled and that there were ligature marks on her neck....hmmm...did one person strangle her while Lisa cut out the baby??? Was Bobbie aware and alive while her baby was cut out....this is worse than we ever imagined, and I still don't think Lisa did this alone.
 
I can't imagine Graves not seeking the death penalty in this case....I think, depending on Montgomery's plea, we will soon hear that it will be a DP case.

Graves can only recommend the DP to the DOJ committee who then makes a recomendation to the U.S. Attorney General who has the final say - the AG makes the decision of whether to pursue the DP or not. Note the following excerpt from Graves' comments (taken from his news conference of 1/12/05 following the indictment):

"Graves said he will make a recommendation to a Department of Justice committee about whether to pursue the death penalty. That group will then make its own recommendation to the U.S. Attorney General's office.
That process usually takes several months to complete, Graves said."
 
Ahh, thanks, Charlie. I'm woefully ignorant of how federal cases proceed. I still think they will seek the death penalty, though.

I have no doubts Graves will recommend the DP to the DOJ committee - unless there is some deeply mitigating factor, I do not see the DOJ committee doing anything other than what Graves will ask for. As for the AG - quess that may depend on who the AG is when the documentation is forwarded there.

Ashcroft is an enigma on this issue and is very religious ( high priest in the Assemblies of God) so I am not certain what his views are. One would think I should know seeing as how Ashcroft is from Missouri (he was a lousy governor IMO) - I've tried to dis-own his Missouri citizenship for years ! So it will come down to who the AG is - that is if we have one confirmed by then.

Ashcroft is a weenie, IMO. I'm also a Christian and I admire that in him but he doesn't seem very tough, which I think an AG has to be in this day and age. Hopefully a tough one will be in there, and soon.
 
Will Lisa Montgomery be charged by the state too or is it just federal charges?

I meant no disparge towards his Christianity, I just don't know how he views the DP. It's tough to quess - in his run for governor IMO he seemed to have totally forgotten his religion and was a typical backstabbing, lying, name calling, mudslinging, politician. IMO as Attorney General he pulls the religion card when it suits him, almost to a fanatical edge, which doesn't gain any respect from me even though I am also a Christian. Just can't read the man. Quess it depends on his mood at the time...or what it will gain for him. Sorry so negative but Ashcroft did more harm to the State of Missouri than any governor I can recall.

Right now it's just federal since she crossed state lines with the baby....I haven't heard anything about Missouri going after her, have you, Charlie?

No, that's fine, you likely know more about him than people who are not from MO. I'm glad he won't be AG anymore...esp. with this case coming up.

englishleigh - remember the conversation about "paperwork" relating to the baby ? Well after reading the articles one thing LMs mother said was about LM buying a home birth kit - so of course I went to look. I was rather surprised to find that some of these kits contain a footprint pad and a birth certificate as part of the kit.

“It was hard like she was pregnant,” Hedberg said. “I was confused at that point. I went back and told my mom, wow, it was pretty freaky. It was pretty weird.”
