BREAKING NEWS: Dallas County sheriff confirms body found on James Phelps’ property as Cassidy Rainwater; murder charges filed

BUFFALO, Mo. (KY3) - The Dallas County sheriff says DNA tests performed on a body found on the property of James Phelps confirm the death of Cassidy Rainwater.

The Dallas County prosecutor on Wednesday filed new first-degree murder charges against James Phelps and Timothy Norton for Rainwater’s death. The prosecutor also charged them with the abandonment of a corpse. They each faced kidnapping charges in Rainwater’s disappearance.

Investigators say Norton admitted Phelps asked him to help kill Rainwater while she was staying at Phelps’s home. Investigators say Norton admitted to holding down Rainwater’s legs while Phelps strangled her. Investigators say they dismembered her body in a bathtub. Investigators found the remains in a freezer. In total, more than 200 pieces of evidence were recovered at the home.
KY3 News first broke the news of the kidnapping of Rainwater in mid-September. FBI investigators contacted detectives in Dallas County saying they received photos from an anonymous person showing Rainwater in a cage. Investigators say a detective recognized Rainwater in a partially nude state. After searching Phelps’ phone, officials discovered seven photos of Rainwater. According to detectives, Rainwater had been staying with Phelps while she got on her feet. Investigators say Phelps claims she had left in the middle of the night at the end of July and he had not seen her since then. Detectives searched the area for several days.

Sheriff Rice says investigators have not located any evidence leading them to believe there are any other victims associated with Phelps and Norton at this time. Sheriff Rice says this is an ongoing investigation. If there is anyone who believes they may information concerning this case, they can call investigators at the Dallas County Sheriff’s Office at 417-345-2441.

A judge had scheduled a court appearance for Phelps on November 19.

It was just a misidentification. The person who reported Cassidy missing gave the wrong last name. There is no relationship.

Thankfully it sounds like the evidence was collected before the house fire. These two morons apparently left enough evidence, digital and otherwise, to thoroughly incriminate themselves. Let's hope they also lead to arrests of the arsonist(s) and any others who may have been involved in this depravity.

I pondered that too for only a moment, where does one get the idea to even think let alone carry it out. Too disturbing to spend much time on.

My thoughts are with her loved ones. I'm not sure how they can process this news.

Sooooo many questions still. WHY was that property NOT SECURED? If it was and still IS an active investigation then at the very least there should have been police tape around property. AT THE VERY LEAST! If there was anything found in a freezer then why are there pics of a freezer still on the property? Why has the FBI or ANY LE went there with shovels in hand and began digging? The fire was ruled an Arson AFTER the " 24 hrs a day for 7 days collection of 200 pieces of evidence" was done. Why hadn't the tripwire and explosive devices been found ? They were placed AFTER that search was done. The fire was AFTER that search was done. It's not obvious to anyone that they NEED to be looking at what's buried on that property?! Especially where the explosives were found. And as far as the Sheriff and his comments about fake news and such, why the hell didn't he slam the news and media coverage IMMEDIATELY when the very first reports were made and they all said the same thing " the property belonging to James Phelps..." That property did not ever belong to him! I am so damn angry! I live within shouting distance to that place and I can assure you that as far as there being "an end to the rumors and speculation" as Mr. Rice said, nothing is farther from the truth around here! The communities level of concern rises and trust in this law enforcement department declines with every day and every statement he makes!
