Do I smell a plea deal coming here? It's been close to 5 years since little Darnell was murdered, unacceptable.

Yes, we are HOPING for a plea deal - but this is for the jail damage - NOT for the murder charge, unfortunately.

Hopefully she will do the same with the murder charge - do a plea.
 
And by the way - her trial for the murder charge is on 3/7/24.

Defendant’s Motion to Declare Defendant Incompetent to Proceed filed July 14, 2023 comes on for hearing. The Motion is heard and taken under advisement. [Dismissed 8/24/21). Indicted (12/18/18) with felony abuse or neglect of a child. [Dismissed 8/24/21]. Indicted (10/29/19) with 2nd degree murder. [Dismissed 8/24/21]. Indicted & charged (8/25/21) with 1st degree murder, child abuse or neglect, serious emotional or physical injury-no sex abuse, endangering the welfare of a child in the 1st degree, death of a child-no sexual contact & abandonment of a corpse in the death of Darnell. (No plea on this yet). Plead not guilty to 2 other charges. No bond changed (3/21/19) to $100K Cash ONLY bond. Bond reduced (9/30/19) to $5K Cash or Surety Bond. Out on bond 9/30/19. 8/14/23 Docket Update Additional info: ORDER Committing Defendant to Dept. of Mental Health On August 9, 2023, the State appears by counsel & Defendant appears in person & by counsel. Defendant’s Motion to Declare Defendant Incompetent to Proceed filed July 14, 2023 comes on for hearing. The Motion is heard & taken under advisement. The Court reviews the file, exhibits & applicable law. Having been fully advised, the Court finds & orders as follows: 1. Defendant, as a result of mental disease or defect, lacks the capacity to assist in her own defense & thus she lacks the mental fitness at this time to proceed with the charges against her. Defendant understands the proceedings against her. 2. The criminal proceedings against Defendant are hereby suspended & Defendant is committed to the custody of the Director of the Dept. of Mental Health until such time as Defendant has the capacity both to understand the proceedings against her & to assist in her own defense, or until the charges against her are disposed of according to law, pursuant to section 552.020, RSMo. 3. Defendant is remanded to the Sheriff of Cole County to be delivered to the care & custody of the Director of the Det. of Mental Health for placement in such facility as determined by the Director to be appropriate pursuant to the provisions of chapter 552, RSMo. 4. Pursuant to section 552.020.12(1), RSMo, the Director of the Dept. of Mental Health shall report to the Court in writing within six (6) months from the date of this order: 1) whether Defendant has regained her competency to stand trial, and 2) if Defendant has not regained her competency, whether there is a substantial probability that Defendant will regain her competency to proceed in the foreseeable future. 5. The Director of the Dept. shall receive & thereafter maintain care, custody & control of Defendant until such time as Defendant is able both to understand the proceedings against her & to aid her attorney in her defense or until the charges are otherwise disposed of according to law. At said time, the Director shall bring Defendant again before this Court for proper hearing on the matter & such further order of the Court as is just & proper in the premises. 6. The trial is removed from its current settings of pretrial conference on 8/18/23, jury selection in Pulaski County on 9/7/23 & jury trial in Cole County on 9/11/23. 7. The case is placed on the docket for case review via Webex 3/7/24 @ 9am.
3/7/24 Update: Hearing Scheduled. Scheduled For: 3/13/24 & 1pm. Judge William Earl Hickle, Cole Circuit. Hearing Held on 3/7/24. Case Review Scheduled. Order. On 3/7/24 the cause is called by Webex. Defendant & all counsel are present. The cause is reset for hearing on 3/13/24 @ 1pm at the Cole County Courthouse of all pending motions, including the request by DMH filed March 4, 2024 for extension of time.
*Charged (5/21/22) & arraigned (8/8/22) with felony damage to jail/jail property on 5/10/22. Plead not guilty.
