GIVENS, Defendant. ) ) ) ) ) ) ) ) Case No. 21AC-CR01733 ORDER COMMITTING DEFENDANT TO DEPARTMENT OF MENTAL HEALTH On August 9, 2023, the State appears by counsel, and Defendant appears in person and by counsel. Defendant’s Motion to Declare Defendant Incompetent to Proceed filed July 14, 2023 comes on for hearing. The Motion is heard and taken under advisement. The Court reviews the file, exhibits, and applicable law. Having been fully advised, the Court finds and orders as follows: 1. Defendant, as a result of mental disease or defect, lacks the capacity to assist in her own defense, and thus she lacks the mental fitness at this time to proceed with the charges against her. Defendant understands the proceedings against her. 2. The criminal proceedings against Defendant are hereby suspended and Defendant is committed to the custody of the Director of the Department of Mental Health until such time as Defendant has the capacity both to understand the proceedings against her and to assist in her own defense, or until the charges against her are disposed of according to law, pursuant to section 552.020, RSMo. 3. Defendant is remanded to the Sheriff of Cole County to be delivered to the care and custody of the Director of the Department of Mental Health for placement in such facility as determined by the Director to be appropriate pursuant to the provisions of chapter 552, RSMo. 4. Pursuant to section 552.020.12(1), RSMo, the Director of the Department of Mental Health shall report to the Court in writing within six (6) months from the date of this order:
1) whether Defendant has regained her competency to stand trial, and 2) if Defendant has not regained her competency, whether there is a substantial probability that Defendant will regain her competency to proceed in the foreseeable future. 5. The Director of the Department shall receive and thereafter maintain care, custody and control of Defendant until such time as Defendant is able both to understand the proceedings against her and to aid her attorney in her defense, or until the charges are otherwise disposed of according to law. At said time, the Director shall bring Defendant again before this Court for proper hearing on the matter and such further order of the Court as is just and proper in the premises. 6. The trial is removed from its current settings of pretrial conference on August 18, 2023, jury selection in Pulaski County on September 7, 2023 and jury trial in Cole County on September 11, 2023. 7. The case is placed on the docket for case review via Webex March 7, 2024 at 9:00 a.m. Date: August 14, 2023
