A better set of jury instructions will definitely be a step in the right direction but "Eric" is still the problem it's always been. I think there's a very good chance the jury will *not* vote guilty.

Unfortunately I agree. I just don’t think the jury will be able to get past this Eric thing. Prosecution needs really strong speech experts. More than the one yesterday, which was goo, but not enough, IMO.
