Something significant, to me anyway, emerged during this morning's testimony by Daryl House (sp?), one of the two deputies who responded to the scene before Jessica was taken by helicopter to Memphis. During cross examination, the defense asked him to read something from the bottom of his one-page report. He had stated that while he was in the back of the ambulance with Jessica, he asked her if it was her boyfriend that did this, to which she responded "No."

Now I can certainly see how in Jessica's condition that it would be difficult to understand answers to subjective questions like "Who are you?" and "Who did this to you?" But objective questions requiring only an "either this/or that" response, like "Yes/No" or "Black/White" would be easier to understand since the two choices have completely different sounds.

Unfortunately, nobody who questioned Jessica was practicing "three way communication" like pilots and air traffic controller use in their exchanges. It is basically this: (1) Question or command; (2) Response; (3) Verification of Response --- 1st party repeats the response heard. It adds objective clarity to an otherwise subjective response.

Regards,
Clouseau

Jessica Chambers: Jury instructions could make or break outcome of second Tellis trial

"...Jurors Wednesday heard the second day of testimony in the Tellis retrial for the 2014 burning death of Chambers, a 19-year-old from Panola County's Courtland community. As proceedings move toward a decision from jurors in the coming days, memories of how the first trial ended will become ever more relevant.

Phillip Broadhead, a clinical professor of law at Ole Miss, said Wednesday he had never seen a trial conclusion quite like the one in Tellis' first trial last October.

"I've seen juries be confused and send notes out," Broadhead said, "but I've never seen a jury come back and deliver a verdict that was completely erroneous. I tried my first case in 1982; through all those years, I've never seen a jury come back and give the wrong verdict."..."
