Brad Cooper is asking a judge to dismiss the custody case involving his two young daughters and is challenging claims from his slain wife's family that he is an unfit father, according to new court documents WRAL obtained Wednesday.

Cooper custody battle returns to court

Raleigh, N.C. — The custody battle between the husband of a slain Cary woman and his children's maternal grandparents returned to court Monday.

Judge Debra Sasser addressed three motions:

The request by the parents of Nancy Cooper to have her husband, Brad Cooper, undergo comprehensive psychiatric examination and psychological testing to determine whether he is a danger to himself or his two young daughters;
The request by Brad Cooper's attorneys to limit the information he must disclose during deposition in the case; and
The request by Brad Cooper's attorneys to separate the evaluation of his fitness as a parent from the custody decision.

Judge orders evaluation of Bradley Cooper

RALEIGH - Bradley Cooper will have to submit to a psychological evaluation by an expert chosen by his wife's parents, a Wake District Court judge ruled today.
The decision came in a connection with a custody fight between Cooper and the parents of his slain wife, Nancy. The two sides are in a dispute over custody of Bradley and Nancy Cooper's daughters.

No one has been charged in the death of Nancy Cooper, a Cary stay-at-home mother whose body was found July 14 in an undeveloped area of a subdivision near her home. Under a temporary agreement, Nancy Cooper's parents and her sister have custody of her daughters, ages 4 and 2.

This news comes the same day Nancy's husband Brad was ordered to undergo a psychiatric evaluation, from a professional chosen by her family. This is ahead of a custody hearing October 16th. The couple's two daughters have been in the custody of Nancy's family.

Brad Cooper has repeatedly denied any involvement in his wife's death. It has been well documented that he and his wife had marital problems before she was found murdered.

The judge hearing the upcoming custody case says she will take into consideration everything, given how the safety of the two young girls is at stake.

Police in Carey, North Carolina say their investigation of Nancy Cooper's murder is being hindered by her husband's refusal to fully co-operate. The lead investigator in the July 12th murder of the former Edmonton area woman says Brad Cooper "has not been willing to come to the police department to assist in the investigation" despite formal requests from Cary police to do so. Cary police Detective George Daniels, who has watched a video deposition Brad Cooper gave, said in an affidavit filed ysterday that statements

In his deposition Cooper admitted details of an affair he had with one of his wife's friends but then said Nancy had her own problems. He said she spent more than the family could afford and she drank too much for his liking. Brad Cooper also revealed he has hired his own investigator but WRAL-TV says he refused to tell attorneys for his wife's family why, citing lawyer-client privilege.
