Shaniya Davis murder trial delayed; defendant Mario McNeill to undergo mental evaluation
Opening statements in Mario McNeill's capital murder trial are delayed until at least Friday so he can be evaluated by medical professionals.
Responding to a defense motion on the matter, Ammons mentioned doctors from two out-of-town facilities who may evaluate McNeill - Central Regional Hospital, a psychiatric hospital in Butner, and Cherry Hospital, a psychiatric hospital operated by the state Department of Health and Human Services in Goldsboro.
In Monday's hearing, the judge referred to an evaluation of McNeill that was done earlier, apparently at the request of his defense lawyers. Neither the defense nor the judge said what prompted that evaluation.
According to the courtroom clerk, the defense motion and the judge's order "are sealed per order of the court."
 
Let's hope they expedite this evaluation so we can get back to the business of frying his behind to a crisp.

I think the a@@^%$#$ is totally insane, you would have to be crazy sick to rape a 5 yr old baby, but as insane as he is, he knew exactly what he was doing..........there is insane: really don't know what is going on in the world

Respectfully this man is evil not having hallucinations and out of touch with reality. He knew what he was doing. He knew it was wrong but did it anyway. I want him to get the worst punishment available.:twocents::banghead:
 
This delay should be against the law! Will they be able to keep the jury the state just sat last week? <modsnip>.

Shaniya Davis case: Evaluation of McNeill's competency just before trial called an unusal move
A decision this week to stop the murder trial of Mario McNeill so he could be evaluated by medical professionals was unusual because of its timing, some legal experts say.
Questions about a defendant's competency to proceed are usually raised before a trial begins, said retired Cumberland County Superior Court Judge E. Lynn Johnson.
Superior Court Judge Jim Ammons delayed proceedings in McNeill's capital murder trial on Monday. A jury has been picked, and opening statements were expected that afternoon.
 
My take on this - he rejected the plea deal and his lawyers said, "He must be CRAZY"....
 
Trials in the US are becoming a farce, and fly in the face of timely justice for the victim's families.
 
Any word yet about what is happening? Today is Friday. Wonder if the Judge has made any new rulings/decisions, etc.

Motions hearing scheduled this morning in #ShaniyaDavis case. Defendant Mario McNeill to be evaluated for competency.
 
It's a Hail Mary pass....he is on video with his victim. The outcome of this trial is fairly certain. They have to try something I guess.

Basically state is saying McNeill's arrogance allowed him to play the psychologist like an instrument, get diagnosis

Actually Hilke met with McNeill at least 5 times before trial... Never had capacity concerns until emergency meeting on 4/20.
