Dads sister says LE contacted her because she was listed on the school papers. As what? Legal guardian??

Is there any chance that the person that took her to the motel was trying to get her way from the trailer - to help her- and she dies anyway at the motel so he dumps her body out of fear

No, there are no bumbling heros among this crowd.
 
Nobody had legal custody, so really, Shaniya was open game to either parent... the both had legal rights.

Sometimes when there don't appear to be issues, a parent doesn't go the legal route. I expect Shaniya's Dad didn't because he didn't want to rock the boat.

From the one article and video.....he knew the routine. He's been in custody disputes with one or more moms of his other kids. Is he listed as the father on Shaniyas' birth certificate??

Someone had to have custody of this child to take her to the doctor, enroll her in school, to get her insurance.
So, legally, who had rights to this kid?
Anybody?

I have not seen anything anywhere as to who had legal custody of this precious girl. Judging from her last name( her birth mother) the bio dad was apparently not even on the birth certificate. We know for sure that the aunt Carey by her own admission did not have legal custody.
Maybe only AD was the legal caretaker of Shaniya. And she could jerk the Lockharts around to her heart's content.

I know we all trying to figure out why this happened to Shaniya. I understand this includes her father and we all have questions about him and the circumstances that led up to this tragedy.

We know that the mother and MAM are the ones that did this to Shaniya. I am going to ask that you all please try to refrain from putting blame on the father. We have a lot of questions about him, and I understand but the bottom line is Shaniya's bio mom and MAM so far are the only ones arrested for her death. I would appreciate it if we can not put blame on the father, I know he along with his whole family must be devistated by what has happened. Lets please try to be respectful of that. Thank you.

Hopefully as time goes on we will learn more. Thanks again everyone.

Answers to questions I would love to know! Like, yes, how did LE know to go to that school? And, who withdrew her? Was it formally done? Or, did she just never show up after the 9th or 31st or whatever.....:waitasec:
 
Hey there and thanks for your comments. In thinking of your question what comes to my mind is , yes, maybe some things in the 2 systems you mentioned would help in some ways but , to me, they can't "cure" the problem. I may be totally wrong but it seems that the larger issue is what is going on in the hearts and minds of the people who can do these terrible things? It is the things PEOPLE DO that overload and overwhelm the judicial system , etc. How do we change the hearts and minds?

So true. I've not thought much about it, but how many of these type of cases are drug-related? I'm just thinking out loud. I know I can't even begin to make a dent in a solution, but I would like to at least understand the horrible circumstances that lead to these instances.

To think that a sweet, innocent, beautiful little girl was safe at her dad's house (from all I've read) and then visited her biological "mother" who allowed this to happen, is horrendous.

I realize that I'm not totally hardened yet by these cases - I still honestly would like to find the good in most people, until they prove me wrong.
 
I guess I'm missing why it's disrespectful to question the issues surrounding custody.

Yes, I get that the father and aunt are grieving. No, I don't believe that we should turn a blind eye to an aspect of a case because it's "about respect." This is a sleuthing board and an advocacy board and I think it could be both, but it sure seems hard sometimes.

Does LE not investigate a lead because a parent is grieving? Do they not explore the whys of a case because it's uncomfortable? We're not LE, but it's impossible to sleuth in any viable way if we're supposed to ignore elements of any case. It's not just this one, but this is an issue with the Somer case as well.

It's not even about accusing BL of anything. It's about wondering why Shaniya was there in the first place, how long she was there, and the circumstances surrounding what appears to be a prolonged loss of contact.

All he nedded was parternity papers. My step daughters mom and dad have never even been to court for custody we carry insurance on her and her address is listed as here her mom lives near us but we switch off every two weeks or so ,very informal and very laid back As she gets older it is getting to where she wants to be here more but it used to be the other way arround. I go to her school and get her and I am her step mom ,they have no papers cuz there arent any. Her parent also never married. The school treats her mother the same as me except I get all the serious calls.

My brief introduction - I was so angry about this case that I started crying. I just felt in my heart there was something that I could do for these missing children....for these little angels. I promised myself that as long as God blesses me with life on this earth I will take 30 minutes each day to spotlight an angel. So I started a website that will reflect on the angels...who they were...not how they left us. One person can make a difference and God knows I'm going to do everything I can to be that one. One day at a time...

Now I have a question about this case - there was an arrest made today of a man named Samuel McNeill. He's 51 and was arrested for violation of probation and possession and currently being held with no bond. Do any of you think there may be a connection or is it just ironic they have the same last name?
 
No, we don't know if the aunt called the father, but based on how it came across in the article, it appears the aunt never called.

Hindsight is 20/20. Just like with the woman that heard the noise outside her home at 3:00 AM. If only she got up and turned on a light, or called the police but she didn't.

This is how I feel about not checking on Shaniya, making a point to check to see if she was in school on Monday, especially after the disturbing conversation between AD and the aunt.

I think he wasn't around when she was born.
He says it was a one night stand, so there was probably a paternity test.
He says he had been the custodial parent for past several years, that implies to me that a transfer happened somewhere along the way.

They probably never did any formal paperwork.
She goes with Dad and ends up staying.
Momster never says a word about paperwork.
Dad can put her on his insurance, I have never asked an employee to prove to me the child they are adding to their insurance is theirs. Wouldn't occur to me unless they were adding an older child out of the blue.

If he has a copy of her birth certificate and immunizations he enrolls her in school (clearly momster didn't she wasn't even on the approved list which also shows how involved she was... I was on the approved pick up list for a friends son in case he was sick or she was stuck somewhere, what parent is not on the list? One that would not even make the short list of being there, not for scheduled pick ups, not for emergencies).

If there was no child support or custody battle going on I can see how this easily occured.

This is from personal experience only. My niece has lived with my husband and myself since she was 2 weeks old, she is now 2 1/2. We never obtained legal custody or legal guardianship until her parents signed over their parental rights 3 months ago due to adoption procedures we initiated (will be finalized 2-2010-Yay!) In this time, we have had no problems carrying her on our insurance or obtaining medical care for her, not once! Of course, she is not of school age and I am a SAHM, so I have no experience with enrolling her in school.

*I used the word niece to explain the situation, but she is my DD all the way!
 
Also, I don't understand the timeline. AD last saw Shaniya at 5:30 (she says). What time did she notice her missing, exactly, according to her story? On the 911 call she says she looked everywhere on one end of the trailer park. Well, when did she do that?

What's weird is that on the one hand it doesn't make sense for her to call 911 so quickly if she knew what was going on, but on the other hand, she chooses to say 5:30 as time last seen, and it makes sense that that's about when MAM would have left w/Shaniya to get to the hotel and be checked in at 6:11. Was she savvy enough to think of the trailer parks surveillance cameras?

Too bad we can't know what any other adults in the trailer told LE.

Forgive me if these are ideas already discussed. I tried to keep current with the threads but sometimes miss things.
We do know that an unidentified witness initially told LE he/she saw Coe drive off with Shaniya that morning. This statement was key in LE's decision to arrest Coe. Upon Coe's release, according to LE, said witness recanted his/her story.

Some WS'ers have speculated that the witness was actually AD, herself. IF that is true, it seals her guilt because why didn't she say that in the 911 call. For that matter, why would she have called 911 so quickly in the first place. Personally, I don't think AD was "the witness" for the reasons just stated.

As to why she would call 911 if she's involved:
  1. MAM was supposed to leave money and/or drugs as payment, and he didn't. She got angry and called 911 without considering the big picture, and how she would eventually be implicated.
  2. As someone else stated here last night, the plan all along was to call 911. MAM actually took Shaniyah much earlier than suspected, and AD with assistance from her sister and others, cleaned up before placing the call. Not sure I agree, but it's a good theory.
  3. There's always the possibility that she had a change of heart. :snooty: But, she knew the father and his family would eventually find out that she was gone, and call in LE. She got scared and made a last ditch effort to save her butt.
I just got home from work, and I'm 10-11 pages behind. I, too, apologize if I'm repeating what's already been discussed today.
