There are so many places both in Utah and AZ this could be. There are so many parks and the white wall he's up against looks like something that would be in a park.

I had a little question -

Shaniya's loving aunt said that she is a single mom to 3 children. Do we know how old her other children are? Have we ever heard her talk about Shaniya's relationship with her own kids - the cousins?

I'm confused about what exactly it is that AD did. MAM's warrant plainly states that he took Shaniya, a minor under the age of 16, without permission from her parent. Given that MAM did not have AD's permission to take Shaniya, then what exactly is AD's role in this? Her charges and his charges are completely contradictory. Either she trafficked Shaniya to him or she didn't. If she did, he couldn't be charged with kidnapping because AD gave her to him. Yet he is charged with taking her without the permission of AD. AD's part in this thing is not clear and until it is I really can't form an opinion about felony murder charges for AD.

Did it say which parent? She has two parents.

Is it possible the information about AD selling her came from Coe, and that cooperation is one of the reasons he was cleared and released so quickly? It seemed almost abrupt to me. If Coe and McNeill are singing the same song in that respect, with MAM denying the actual rape/murder, then maybe AD was poly'd or they're holding her based on the word of two witnesses with corroborating stories?

Not being trying to argue with you, I really am not.
But this site is an organization that wants to repeal the felony murder laws, thinks they are too harsh. And every case they list if the person was not the actual killer they were sentenced to LWOP.

Felony murder does only have two sentences, death and LWOP.
If the defendant was the driver or other "third party" the prosecutor will not ask for the death penalty. I can find the Supreme Court cases for you later as it is a very interesting topic, but I promise you they won't execute a getaway driver. It has been ruled unconstitutional. And the sited website is using that quote out of context (for their purpose of saying it is too harsh).

There were several very interesting opinions written on this recently when the US Supreme Court forced all the states that said they were going to start executing child rapist to repeal those laws. The justices were fairly split on the topic so I think it is something we will see heard again in the not too distant future. A slightly different court might rule the other way. I think it was a 5 to 4 split, but that I would have to verify.

I never believed anyone other than MAM was responsible for killing Shaniya, no big sex ring etc, I hope they string him up by his you know whats!!!! I will never ever forget the pictures of this baby, being carried to her doom, he is an evil evil monster, wonder how many other children he has violated?? I completely agree with you. One of the mistakes "normal" people make is trying to find rationality in things that are not rational. People get stuck on things like the fact he took Shaniya to a hotel, for no apparent reason, in front of cameras and conclude there must be a rational explanation (buyer, sex ring, *advertiser censored* video, etc), but those are thoughts coming from a rational, logical, rhyme and reason kind of mind. McNeill's mind is not like that.

In the three years that I worked with incarcerated individuals like McNeill, many of them talked about being in a "tunnel" or the world just "disappearing" when they were in what they called "the zone". Logic went completely out the window at a certain point. McNeill likely was extremely hyperaroused and his only thought was getting Shaniya someplace private and relatively comfortable so he could meet his goal of raping her.

He had his target in the car, he was driving, it was almost daybreak, he was manic with arousal, passed a hotel, pulled in the lot, got a room, completed the sexual assault and only THEN did he start to plan. That is how these guys are, trust me. I worked with hundreds of them.

If she sold/traded her and it resulted in her death she can be charged with murder. She cannot be executed though if she did not actually kill her. Supreme court has said it is cruel and unusual punishment. Execution is for those who have killed someone (ie the same reason they have said we cannot kill child rapists). Don't agree, but that is the court rulings on the topic. LWOP would be the most she will face.

Not quite. I posted the NC Statute regarding this 2 or 3 threads ago...just search my name. If a felony nurder happens as the result of or during another felony, then the sentence may be DP or LWOP. If mutha did in fact pimp her girl out, she most definitely could face the needle - In fact, I hope it breaks off in her arm!

I don't see how the father can sue children's services when he never went to them to have them approve the home to put his child in there.And since he's had past child custody cases with the same offices in Fayetteville,and lost custody of children,I'm sure they would have investigated the whole situation.I wish NG would check into that whole thing before she remarks about it on her show.

This is the most ridiculous thing I've heard Brad say so far. He better watch himself as LE will investigate this child's life starting at her birth.

I can't find a link in this mess, but IIRC it was in a news article about clothing being found in park after the blanket was found and it was undies.
Then all she had on was the T sleepshirt.......bare legs no shoes etc in photo by elavator.

As I stated before, I don't think it's a given that she made any noise. She was a five-year-old girl. If she knew MAM and was fairly familiar with him (even if she wasn't), she was probably terrified and I don't see a little girl like that making a huge fuss. She could just as easily have been as quiet as possible so as to not anger him.
