Kayla Montgomery is back on the stand this AM to continue cross-examination. She is testifying in the trial of her estranged husband, #AdamMontgomery, who is accused of killing his daughter

#AdamMontgomery is not in court again for today's testimony.

The defense is highlighting discrepancies between what Kayla told prosecutors on the stand about the day Harmony died and what she told law enforcement when their investigation was going on.

Last week, Kayla testified that Adam hit Harmony when he returned to the family's car from the methadone clinic and noticed Harmony had a bathroom accident. Today, she tells the defense that Harmony also had an accident around 2-3 that morning. Says Adam hit Harmony 10-15 times.

Judge has ordered a mid-morning break. Court will resume in 15 minutes.

The defense is going over every detail of Kayla's testimony-big and small. Including Kayla telling prosecutors that she fed the children as the family left the Burger King parking lot. Defense notes she told police she fed the children at the Colonial Village apts.

Defense also asks Kayla what her other two children were doing while Adam was hitting Harmony. She says one of her sons was screaming. Defense notes Kayla originally told police the children were sleeping at the time.

With Kayla being the state's star witness, this is the defense's chance to make a dent in the prosecution's case by highlighting even the smallest discrepancy in her story.

Adam's defense attorney has thrown several curveball questions at Kayla, trying to get her to admit that Harmony was already dead before the time she claims Adam killed her. Kayla appears confused each time.

The jury is now out on lunch. Testimony will resume in one hour.

We're back from lunch. Defense is now questioning about the family's time at their Union St. apartment--primarily the day Adam allegedly reduced Harmony's body.

Defense notes Kayla originally told police she did not help Adam with Harmony's body, but later admitted that she cut Harmony's sweatshirt off and helped close a bag that her remains were put in.

The defense just asked Kayla about #AdamMontgomery wanting to commit suicide. Kayla says she told Adam that she needed him and their kids needed him. The defense is done with questioning. Prosecutors now have a chance for follow-up questions during redirect.

Prosecutors are circling back to Adam's abuse of Kayla. She reiterates that the abuse was physical and emotional. Says Adam accused her of cheating on him, working with cops.

Prosecutors just asked Kayla if she still loves #AdamMontgomery. She says she still cares about him. "He was my best friend. It's been hard to let go." Kayla says as she wipes away tears.

Prosecutor: Did you beat Harmony to death? Kayla: No.

Kayla is emotional again while telling jurors she no longer has rights to her children. She can no longer speak to them. She also tells the jurors she was not given full immunity and is currently living at the NH prison for women.

Prosecutor: Can you remind these jurors who killed Harmony?Kayla: Adam Montgomery. State has finished with redirect. Defense is allowed to ask follow up questions.

Defense asks Kayla how she knew information about opening statements. She says my lawyer. Defense tries to clarify when judge called attys. up to the bench. We are now in a 15-minute break.

Court is back in session, but the judge just asked Kayla Montgomery's attorney to approach the bench. He was setting in the gallery during her testimony. Prosecution and defense are also there.

Sidebar is still going on at the bench w/Kayla's attorney, prosecutors and the defense. They've been up there for quite some time. Kayla has just entered the courtroom.

Court is back in session. No mention of what happened at the bench. Defense is continuing its questioning of Kayla about what was said in opening statements by Adam's attorneys.

Defense asked Kayla if she was aware that Adam was conceding to abuse of a corpse charge and falsifying evidence charge. Kayla says she learned this because her atty. spoke to her about it the morning of her testimony.

After another nearly six-hour day of testimony, Kayla Montgomery's time on the stand comes to an end. The state has called its next witness, Courtney Garcia. She says #AdamMontgomery is a childhood friend of her husband.

Garcia says she saw Adam on Thanksgiving in 2019. She says her husband gave him gas money and offered to give him a place to stay.

Garcia says Adam was for staying with them, but he and Kayla decided not to spend the night. She says Adam and Kayla's two sons and Harmony were in the back seat of the car. Garcia offered the kids food.

Garcia says between December 2019-January 2020 she saw the family multiple times. She says Adam told her that Harmony was back living with her mother because she kept having accidents in the car.

Defense asks a brief question on cross-examination to clarify that Adam was willing to stay with Garcia, but Kayla was against it. Garcia is dismissed.

We're now hearing from Kimberly Frain. She worked with Adam and Kayla at a Dunkin Donuts in Manchester. She says she babysat #HarmonyMontgomery and her two brothers in the summer of 2019.

Frain says in the winter of 2019 she delivered jumper cables to the Montgomerys. She says she did not see Harmony with them.

Brief cross-examination of Frain by the defense to clarify what kind of car the Montgomerys were living in. Frain says she believes blue Audi. Frain is dismissed as a witness. Both sides are now at the bench with the judge.

Testimony is done for today. Judge says she is aware of tomorrow's snowstorm but says the trial will continue. If that changes, jurors will be notified overnight. Otherwise, they will report to court at 8:45.

Digging into this story reveals endless layers of awful. Kayla Montgomery testified today that she and Adam Montgomery bought drugs from a guy who accepted food stamps as payment, so the family of *5* lived in a car & subsisted on baby food for a time.

Officer Neil Penttinen is up first today for the state in #AdamMontgomery trial. He responded to the car accident Adam and Kayla were in.

Nov. 29, 2019, #AdamMontgomery was in a traffic accident. Tabitha Scott was in the passenger seat. Kayla testified she was in the backseat with all 3 kids. Scott and Adam lived together as children -their parents dated.

Officer says he didn't look closely inside the car.

The same officer responded to the second accident on Dec. 2, 2010. His report doesn't note any children in the car, just Adam and Kayla. He doesn't know if he saw them in the car or just talked to them outside of the car.

Tuesday's testimony began with Manchester police Officer Neil Penttinen on the stand. He testified about two crashes he responded to on Nov. 29 and Dec. 2, 2019 where Adam Montgomery was one of the drivers.

The second witness to testify on Tuesday was Matthew Gendron, a former coworker of Adam and his estranged wife Kayla Montgomery's at the Dunkin' on Beech Street in Manchester. He testified that he was Facebook friends with both of them and would initiate conversations with them "every week or so."

Right now, we are hearing from Aaron Sweeney. He is a tow truck driver who was called to tow the car that the Montgomerys were living in when it broke down at the intersection of Webster and Elm streets.

Remember, it's at this moment when prosecutors say #AdamMontgomery first realized that #HarmonyMontgomery was dead. They claim he then put his daughter's body in a duffle bag before he called for a tow.

Sweeney testifies that he only saw two adult males when he was towing the car. Prosecutor asks if there were children there. Sweeney says no.

The state is now questioning Joseph Tucker. He is a former detective for Manchester Police. He searched the Montgomery family's Chrysler Sebring that they lived out of when they were evicted from their home on Gilford Street.

Prosecutors also allege this vehicle is also where #AdamMontgomery began beating #HarmonyMontgomery on the day she died.

This is what the Chrysler Sebring looked like when Manchester Police took possession of it. The car was taken from a local junkyard.

Tucker tells prosecutors while searching the vehicle he found a toothbrush in the back of the trunk. He says it was under some clothing.

Tucker says he took four swabs of the Chrysler's trunk. When asked if they were sent to a lab along with the toothbrush, he says he's not aware, but he assumes the swabbing was being done to go to a lab. Defense is now questioning Tucker.

Tucker tells the defense about his role in processing the Montgomery car. He says he sprayed what's called Blue Star in the truck of the vehicle. Its purpose is to reveal blood stains.

Tucker tells defense that he collected any item that reacted to the spray. Tucker is done with testimony. He has been excused.

We are now hearing from Sgt. Brian O'Leary of Manchester PD. He worked as a detective from 2013-2022. O'Leary was part of the original investigation into the disappearance of #HarmonyMontgomery.

O'Leary was also part of the team that processed the Montgomery family's Chrysler Sebring. He said the whole process was two days. O'Leary is currently discussing the use of Blue Star in the car.

O'Leary says he applied Blue Star to the interior and exterior of the vehicle. When asked about the exterior, he says he sprayed it everywhere on the outside.

O'Leary says he took four swabs of areas that were presumptive positive for blood in the trunk of the car. He says there were also two or three areas that were false positives.

O'Leary also sprayed Blue Star in two areas in the basement of the family's home on Gilford Street. He says there were no positive results there. Judge is breaking for lunch. Jury will return in an hour.

Back from lunch. Defense is now asking O'Leary about his experience with Blue Star. Atty. Brooks asks O'Leary how many times he used Blue Star up until he used it on the Montgomery car. O'Leary says about 15-20 times.

Defense asks O'Leary if a false positive could be contributed to a cleaning agent. O'Leary says that's correct. Remember, Kayla testified about Adam cleaning the car.

O'Leary says he applied Blue Star to the entirety of the vehicle, including the back passenger seats. He says there was no reaction to the Blue Star. He says there were also no positive results from the steering wheel, passenger seats, center console.

O'Leary's testimony is finished, but he has not been excused. He could be called again in the future.

We are now hearing from Anthony Bodero. He is another important witness to this case. Bodero lived at the Colonial Village Apartments. He allowed the Montgomery family to live in his Audi after their Chrysler broke down. This is also after the state says #HarmonyMontgomery died.

This is Anthony Bodero's Audi that the family lived in. Bodero says he met #AdamMontgomery in Aug. of 2019 through a mutual friend. Bodero says Adam gave him a ride to court. He says Adam was with Harmony and the two boys. Bodero says he last saw Harmony abt. 3 weeks later.

Bodero admits that he originally lied to a Grand Jury when asked if he ever sold drugs to Adam. He has since been given immunity for his testimony in this trial.

Bodero tells prosecutors that he sold Adam and Kayla drugs in 2019. He says they would pay with either cash or food stamps. He says the family stayed in his car for two days over Thanksgiving weekend in 2019. He says it was Adam, Kayla and their two boys.

Bodero says he never saw #HarmonyMontgomery during that time and does not know where she was.

Adam's attorney, Caroline Smith, is now conducting cross-examination of Bodero.

Smith again gets Bodero to admit that he lied to the Grand Jury.

Smith: You didn't want anything to do with this, right? Bodero: Of course.

Bodero appears frustrated as Smith establishes his criminal history. She brings up a 2022 sentencing in which Bodero was given 2-3 years suspended. Bodero says she's wrong. Smith provides court documents of Bodero's sentence.

We've moved on to Bodero's interactions with the Montgomery family. He says he saw Harmony twice--once at the family's home on Gilford Street and once when the Montgomerys took him to court.

Bodero says for the two days the family lived in his car, he would go down to them a couple of times. He reiterates he never saw Harmony.

Bodero's testimony is over. Court is now taking a 15-minute break.

Now on the stand is Christina Lubin. She is the mother of Kayla Montgomery. Lubin says she only met #HarmonyMontgomery once just after Thanksgiving in 2019.
Lubin says Adam, Kayla and their boys later returned in December and Harmony was not with them.

Lubin ID's a cooler that she kept in the hallway of her home. She says she would put money in it for Kayla to take. Lubin also used the cooler to bring food to basketball games. It's the same cooler pros. says #AdamMontgomery stored his daughter's body while living w/Lubin.

Lubin tells the defense when she met Harmony, she had pigtails and was wearing glasses. Lubin said she was adorable. She says Harmony didn't talk much but seemed fine.

Lubin is done with her testimony. We are now hearing from Katie Swango. She is a criminalist with the NH state lab. She is an expert in DNA analysis and testing. Swango is currently explaining what DNA is to the jury.

Swango says she created DNA profiles of Harmony's mother, Crystal Sorey, and Adam Montgomery from swabs that were provided to her.

Swango says there was one item that came up with what's known as a profile. She tells the state it was a Trolls toothbrush. It's the same toothbrush that was found in the trunk of the Montgomery's Chrysler.

Swango says she tested bristles from the toothbrush. She says she was able to conclude that the toothbrush was used by a female child made by Crystal Sorey and Adam Montgomery. She says it's 100 sextillion times more likely to be Harmony's DNA than another child.

Court is ending today with Swango on the stand. Jury will return tomorrow morning at 8:45 for a 9:00 start.

Adam Montgomery's mother-in-law testified Tuesday in the Harmony Montgomery murder trial.

Christina Lubin, the mother of Adam's estranged wife Kayla Montgomery, testified that she met Harmony only once, shortly after Thanksgiving of 2019 at her home after her daughter and her family had been evicted from their apartment on Gilford Street. She said they came to stay with her for a longer period of time later that month, but Harmony wasn't with them.

... Kayla Montgomery told investigators that Harmony's body was kept in a red cooler the entire time they stayed with her mother, until the end of December 2019.

Lubin also testified about various tools she keeps at her home that she uses to refurbish and flip furniture, including a table saw, a circular saw, a band saw and a mitre saw.

Bodero said he saw Adam "every few days" back in 2019 and has also known Adam's estranged wife Kayla Montgomery for over a decade.

ICYMI: The defendant has refused to attend his own trial. He was present on day 1 of jury selection so these jurors have seen him, but since then he will not come to court. The judge said he has a right to waive his presence but the jail staff ask him each morning so he can change his mind. So he has not been present to hear the very graphic details. This is the cooler Kayla's mom left money in in the apartment building in a common hallway. We've heard in previous testimony that #HarmonyMontgomery's remains were placed in her for a period of time.

Katie Swango (criminologist with the New Hampshire State Police Forensic Laboratory) was back on the stand after yesterday. She continued to testify about tests done on swabs taken from a Chrysler Sebring that the Montgomerys were living in at the time the state says Harmony was killed.

Scott Riley (former juvenile detective) testified about removing a ceiling tile from an apartment at "Families in Transition" (FIT), where the Montgomery family lived for a short time. He said that it was apparent from the odor that something had been decomposing there.

Manchester Police Det. Ray Lamy (lead detective in crime scene processing) testified that he processed the Audi the the Montgomerys stayed in as well as ceiling tiles from the FIT apartments they stayed in after Harmony died.

Rachel Radwich (works for Manchester PD's evidence unit) testified about cutting sections of ceiling tile. She says those sections were sent down to DNA Labs International in FL. She said while working on the ceiling tiles, she could smell a pungent, rotting scent. She said the scent is familiar to her. She associates it with decomposition. She often smells it when working crime scenes with a body.

Kevin McMahon (retired criminologist for the NH State Police Forensic Lab) He said he tested several items for blood connected to this case. Items that came up negative for the presence of blood include a section of carpet from a car trunk, a T-shirt and a cooler. He told prosecutors he also tested four sections of a stained area of drywall. He said those 4 parts tested positive for the presence of blood. McMahon is now under cross-examination by the defense.

Martin Orlowicz (criminologist with the NH State Police Forensic Lab). The court entered Orlowicz as an expert.
