New charges filed against stepmother of missing NH girl last seen in 2019 – Boston News, Weather, Sports | WHDH 7News
[...]

The new theft charge still alleges that she accepted the food stamp benefits for Harmony; it was filed under a different statute. The two “prohibited acts” misdemeanors were filed under a public welfare statute, alleging that Kayla Montgomery made intentional false statements that Harmony was in her household to claim the benefits in February and March of 2021.

Kayla Montgomery is scheduled for arraignment Thursday on the new charges.

[...]

Prosecutors responded that after a review of Kayla Montgomery’s file and consultation with Health Department employees, it anticipated filing a theft charge — also a felony — and eight misdemeanor charges. By the end of the day, the theft charge, plus two misdemeanors were filed.

The bail should remain the same, the motion said.

Prosecutors said they contacted her lawyer about the anticipated new charges, but it was before that conversation that the defense filed its bail reconsideration motion on the welfare charge.

Harmony Montgomery: Uncle says he tried to alert authorities about abuse for years | Fox News
The uncle of the New Hampshire man arrested in connection with the disappearance of his daughter Harmony Montgomery said he tried to report incidents of child abuse to authorities for years, but they never acted.

Kevin Montgomery, the uncle, told Fox News Digital on Monday that authorities only acted in December 2021, when Crystal Sorey, the mother of the missing girl, urged police to open a missing person investigation.

New Hampshire's Division for Children, Youth and Families has declined Fox News Digital's requests for comment on the case, citing its privacy policy.

Harmony Montgomery: Uncle says he tried to alert authorities about abuse for years | Fox News
[...]

A surveillance camera captured audio and video of the shooting, which was alleged to have involved multiple people, including Harmony’s mother and her uncle, Jason Sorey. The video showed a white Volvo pulling up to the area around 6:08 p.m. local time, according to a preliminary police report.

Less than two minutes later, "a faint ‘pop’ is heard" out of the camera’s view. Then a man can be heard screaming, "Jay, help, Jay!" the report states. Several voices can be heard in the video, according to the report, including one that says, "He shot me in my f------ face," and another that says, "Yo get the f--- outa here, the cops are comin'."

[...]

The brawl involved at least four men, including the victim, Montgomery and two others, documents said. After the initial shooting, the alleged victim and a friend drove Montgomery to the floor and pulled his shirt over his head, revealing a "BOSTON" tattoo on his back, before disarming him and taking the gun.

[...]

Police said they received several tips identifying someone named "Ace" – later revealed to be Montgomery – as the man who shot the victim in the face. Another tipster revealed that Montgomery was shot in the arm during the scuffle, but refused to go to the hospital, and that he was with his then-girlfriend, Sorey, the preliminary report states.

Police found Sorey on Jan. 25, 2014, "hiding in an abandoned shed at the rear" of a home in Methuen, Massachusetts, an unheated space amid plummeting temperatures.

Legal pressure applied against father & stepmom in Harmony Montgomery investigation – Boston 25 News
[...]

NH prosecutors are dropping Kayla’s existing welfare fraud charge and are replacing it with another felony: theft by deception.

They are also adding eight misdemeanors on top of it.

It’s more legal pressure for a mother of three, perhaps to convince her to talk.

“It sounds as if it’s crucial, that without any evidence at this time, that they find somebody that is willing to tell them what is going on. And that is why they obviously want to put whatever pressure they can on people to talk,” Boston attorney Peter Elikann said.

Harmony Montgomery case shines spotlight on need for more social workers in police departments, cops say | Fox News

Some of Harmony's relatives told Fox News Digital they reported signs of abuse on multiple occasions and saw no results.

"They did their investigation, it was within a few days or the week, and they said all the kids looked ‘vibrant, happy and healthy,’" said Kevin Montgomery, the uncle of Harmony’s dad Adam Montgomery. ...

Harmony’s great-grandmother also said she called New Hampshire’s Department of Health and Human Services in July 2021 after she heard Adam Montgomery had entered drug rehab to check up on the girl’s well-being and whereabouts.

She said officials told her that Harmony wasn’t in their system, wasn’t in their custody, and that they didn’t have a case open.

25 Investigates: NH Child Advocate launches preliminary review of Harmony Montgomery’s case – Boston 25 News
[...]

Here’s a portion of her interview with Moira O’Neill, the head of the NH OCA:

25 Investigates: I’m wondering if the Office of the Advocate has a clearer explanation of the process that should happen when New Hampshire receives a child from another state?

NH OCA: If there’s an open child protective case, which means that there’s a legal relationship between a state, a child and a family, so generally when they’re sent to another state there may be an interstate compact agreement where the receiving state would have some responsibility to check on the child. If however the child is placed with a non-offending parent, a biological parent who’s not involved in any abuse and neglect, they may not need that because the child is considered safe. We don’t know the circumstances were with this child coming to New Hampshire until we get more information and some sort of a conclusion, we can sort of examine, should there have been some sort of supervision or support of that family when she arrived in New Hampshire.

25 Investigates: We know police were at the home where Harmony was last seen 14 times between June and November 2019. According to those reports DCYF was at that home in August and October of 2019 and, of course, Harmony has presumably gone missing by November of that year. So as the Child Advocate are you asking about the follow-up DCYF follow-up after those visits?

NH OCA: So again I cannot comment on this case. I can tell you generally if there’s something that’s happened to a child that’s been reported to us, we would look at the history of DCYF involvement with the family, what they were there for, what they did and whether or not they met the standard and the legal obligation of the agency there.

The last time police saw Harmony was on Sept. 11, 2019, when police were called to the house for a non-criminal, domestic disturbance. DCYF personnel would later see her in October, police said.

On that day in September, KM, Adam’s uncle, and HM, Adam’s grandmother, tried to retrieve personal items from the house. Adam told police he had paid rent for several months to his grandmother while she was living in Florida recovering from heart surgery. Adam was upset that they tried to “barge their way in without his permission,” according to the police report.

KM told Officer Travis J. Koeppel that Adam and his family had taken over the house when they originally lived only in the upstairs. He and Helen wanted to retrieve some personal items before Adam and his family were evicted at the end of the month.

On Jan. 12, 2020, police were called for the last time concerning the front door being opened; the caller thought it had been kicked in. Sorey said in an interview with the Globe she began searching for her daughter in 2019 after Adam and Kayla blocked her from contacting them.

She went in and out of sober homes and shelters after she lost custody, but reports filed in court indicate Sorey has since been sober.

Sorey told the newspaper she called schools in New Hampshire where she thought Harmony may be a student, used paid internet search tools to gather addresses connected to Adam, and tried repeatedly to contact DCYF before she contacted Manchester police.

“I didn’t just sit around and say, ‘Oh, they took my daughter, I’m just going to get high, man,’ ” she said. “By the time detectives got involved, I had probably about 16 e-mails [full] of information for them already … because I had already been looking for her for a year and a half.”
