UPDATE: It’s official #DanielTheriot’s mother Cassie Smith and boyfriend Joshua Oxford have been charged with FIRST DEGREE MURDER for the death of 3-year-old Daniel. They’re back in court tomorrow according to court records. 9/6.

I wonder if the mom was at the park saying she "lost" the child, while the boyfriend was doing his thing, and disposing of the boy?

Cases like this makes my ears turn red, like I could spit fire. I can't, for the life of me, EVER understand cases like this. Ever.

Oxford has 2013 previous conviction for child abuse and neglect, battery and domestic violence. When the 3 yr-old child was found and shown to the people at the hospital, there were child abuse injuries, noticeable finger marks, burn marks, scratches and bruises on both ears, above the eyes. Hemorrhages around the eyes. OMG

Good grief. He should have been put away a LONG time ago. And who was the kid he was accused of hurting back then? Why wasn't he in jail for that?!?!

I'm not sure exactly how you get rewarded with money for having children....

I know you said you're from Colorado, but your story is definitely not the norm here in Texas.

I had a "friend" several years ago that was a single mom to 4 kids. She'd never worked a single day in her life. She sat on her laptop and played games all. day. long. Literally. Her mom lived with her and paid her "rent" to stay there, even though she was the primary caregiver for her kids.

Anyway, she got $700ish a month in food stamps, and $920 a month in TANF money, not to mention what she made for child support (unsure of that amount, honestly). But she literally had EVERYTHING paid for by the state or someone else. And the more kids she had, the more money she got...

Theriot, the boy’s biological father from Liberty, was in disbelief.

He received a phone call at 11:30 p.m. Sunday from an FBI agent informing him his son was missing. He was notified Monday morning that the body had been found.

Theriot said his ex-girlfriend was living in Spring with the two boys and going to school to become a certified nurse assistant until a couple of months ago.

Allegedly, she met Oxford and wanted to move to the West Coast to be with him. Theriot said the couple found it too expensive to live in California so they moved in with his mom at her home in Las Vegas.

Once in Vegas, Theriot thought things might be better for the two boys. Instead, he received a series of texts from her warning that Daniel had been acting up.

One of the texts from Smith read: “Daniel is getting worse and worse by the day, he wont listen to either of us. We cant take it anymore. I lost it on him yesterday and josh did today, we cant do this anymore.”

He had planned to visit near his birthday Sept. 20th.

Daniel was only 3 years old. A small child. What sort of people aren't able to deal with a small child without violence?! Too much scum around everywhere...And I don't believe a word they say anyway.

I am sick to my stomach with this. How can you ever hurt your own child or murder your own flesh and blood? Its so tough to keep seeing this happening. And why? For what? Kids deserve a safe and happy place. I would never even lay a hand on my daughter. Its just horrible and sad...

Rest in peace little one, i hope you are safe now.

And to all of my fellow forummembers who spend so much of their private time trying to help on the cases and have to get through all this horror every single time...i know its tough, i know you feel sometimes you cant do this anymore. But look at how much we are doing together. With all our love and dedication. Its the least we can do for all the victims and family. To me here we are also one big family. And if one of us have a tough moment, i am sure that we have each others backs. Thank you for all the hard work that everyone does. I can't imagine being so angry that I hurt my child. Like, yes, I've gotten mad, frustrated, been tired, etc. But we are the ADULT. We're the PARENTS. It's our JOB to protect our kids. Gah. I just... if you can't handle having a kid, figure something out. Goodness gracious. This story is going to get more ugly and more ugly as time goes on, I feel. She definitely wasn't completely innocent. She could have called 911 or something after she realized that he hurt her kid. But instead of would seem that she helped hide it.

God. I tapped my 3-year-old grandson on the knee the other day when he was too excited and wouldn’t stop kicking. Just a tap, and said STOP. He has never been hit or abused so that tap actually upset him. And his reaction made me feel like sh&t because I had hurt his FEELINGS. I can’t even imagine causing any pain to his physical self.

I imagine Daniel’s “parents” had never bothered to establish any kind of healthy relationship with him, let alone loving discipline. He probably was mirroring chaotic behavior that he witnessed all the time. Poor little fellow. It is beyond heartbreaking.

Either that man had a very hard paper round or there are substances involved IMO. He looks a lot older than 40.

The abuse were so 'normal' to these adults that taking photos showing questionable scabs and injuries on the kids didn't bother them.

I hope they rot.

How unfortunate. Dad probably didn't think those texts meant that the adults in the house were abusing Daniel, otherwise I'm sure he would have called CPS, LE or arranged to travel to Las Vegas earlier.

The lesson here is that we do have to take such statements seriously. When a mother says she "lost it" on her child and she "can't do this anymore" then it's time for an intervention. Especially when her boyfriend also "loses it" on the child, which is even more ominous. MOO.

First appearance 9/4/18, murder charges were filed 9/5/18. 2 year old removed from home. Next prelim hearing 9/7 & 11/29.
