He then added, " My company and overall value is actually far stronger and higher than shown in the so-called Financial Statement. The honorable thing to do would be 'DROP IT,' and spend all of this time, money, and energy on fighting Violent Crime in New York. It would make a big difference, and show real strength and courage by the A.G.!"

A signal in the apparent split of legal strategy occured when Ivanka asked Judge Arthur Engeron for a delay.

The letter sought to established that she did not have any role approving financial statements that James' office have characterized as a bait and switch.

Her lawyers wrote that the complaint 'lacks a single allegation that Ms. Trump participated in preparing those financial statements, knew about the valuation methodologies that were used to value those assets, or had any knowledge regarding the alleged inaccuracies in her father’s stated net worth.'

Nevertheless, at least one of James' allegations relates to a property that Ivanka inhabited.

According to a James filing, Ivanka's Park Avenue apartment was publicly said to be worth $25 million, but she retained an option to purchase it for $8 million.

Eric and Donald Trump Jr. each gave depositions when ordered to by a judge. In his own deposition, Eric Trump invoked his Fifth Amendment rights more than 500 times.
 

Forbes reported on Wednesday that Ivanka Trump has retained Bennet Moskowitz of the firm Troutman Pepper as her sole attorney on the case.

Moskowitz previously represented the estate of convicted pedophile Jeffrey Epstein.

Ivanka Trump had been repped by the two attorneys hired by Donald Trump Jr. and Eric Trump – Clifford Robert and Michael Farina – shortly after the suit was filed against the Trump Organization and Trump family.

Moskowitz is also taking over for two Washington, DC-based lawyers – Reid Figel and Michael Kellogg – hired by Ivanka Trump independently of her brothers.
 
Donald Trump, his three eldest children and the Trump Organization failed to turn over emails and other communications in a fraud lawsuit, the New York attorney general’s office claimed in a letter submitted in court last week. The office singled out “an unexplained drop-off in emails for Ivanka Trump” as one of the more significant issues.


The letter notes a significant decline in emails turned over from Ivanka Trump, dropping from an average of 1,200 emails per month in the first nine months of 2014 to just 37 emails a month in 2016. The attorney general’s office asked Ivanka’s lawyers about the issue and was unimpressed by their response. “Not only have defendants failed to offer any substantive response to this inquiry, but there have been no documents produced by Ms. Trump,” the attorney general’s office told the judge on Friday.

In response to the letter, Engoron granted some of the attorney general’s requests on Monday, requiring all defendants to submit affidavits detailing how they have compiled with discovery and setting a deadline of May 12 for the Trumps to turn over all outstanding documents.


 

Donald Trump's three eldest children — Ivanka Trump, Donald Trump Jr. and Eric Trump — are refusing to hand over documents in an ongoing fraud lawsuit against them and the Trump Organization.

In a letter obtained by a news outlet, the Trumps failed to hand over emails and other documents, with “an unexplained drop-off in emails for Ivanka Trump” as the biggest concern.

Ivanka's emails dropped from 1,200 emails per month during the first nine months of 2014 to 37 emails per month in 2016. “Not only have defendants failed to offer any substantive response to this inquiry, but there have been no documents produced by Ms. Trump,” the AG’s office told Judge Arthur Engoron in late April.

Now, Engoron is requiring the Trumps to submit affidavits to explain how they have followed the rules thus far. He also set a May 12 deadline for them to turn over the remaining documents needed.

In May 2022, Donald paid a $110,000 fine after Engoron said he failed to comply with the subpoena from the attorney general's office.

“For years, Mr. Trump and the Trump Organization have tried to thwart our lawful investigation, but today’s decision makes clear that no one can evade accountability,” Attorney General Letitia James said.
 

On April 26, Forbes reported that Ivanka had dumped the attorneys hired by her brothers, Eric and Don Jr., after New York Attorney General Letitia James had opened an inquiry into the Trump Org that could lead to a "financial death penalty" for the company headed by former president Donald Trump.

According to that report, "Bennet Moskowitz of Troutman Pepper informed the court that he was taking over as Ivanka’s counsel and that [Clifford] Robert and [Michael] Farina, the attorneys Ivanka shared with her brothers, were no longer representing her."

At the same time that Forbes was reporting that investigators are questioning Ivanka Trump's email habits, which dropped "from an average of 1,200 emails per month in the first nine months of 2014 to just 37 emails a month in 2016," Lara Trump was dismissing the legal shake-up.

The wife of Eric Trump, who was recently let go as a paid commentator on Fox News, told the Daily Mail, "I think people are trying to make that a bigger deal than it really is."

She went on to complain, "It's not common to have to go through all this stuff that my husband and his siblings go through," before speculating, "'They've had a series of different attorneys throughout this entire process and it just so happened that Ivanka felt closer to one, gravitated towards that [one]. She [may have] said, 'I'm going to have this person directly for me,' but [the attorneys] all work as a team. I think that got lost in the story."

As Forbes previously reported, the so-called "first daughter" moved on to a new and different law firm when she made the switch.
 

Judge Engoron set the Trump family a deadline of May 12 to hand over all outstanding requested documents and communications as part of the discovery process, and a further May 15 deadline to submit a compliance affidavit to confirm under oath that they have complied with their legal obligations to hand over the requested information.


"And judges seem to be getting wiser about repeated efforts to manipulate the system. This is the part of the process where the Trumps have to act like any other litigants in a civil matter and turn over discovery," Vance said. "Requiring a statement filed under oath is a strong signal he means business."

Another Trump and Trump Org lawsuit?


U.S. District Judge Lorna G. Schofield signed off on a three-page stipulation order Friday that granted the Trump children’s dismissal from the case, “in order to streamline and focus the issues to be adjudicated at trial.”

The investors’ attorney, Roberta Kaplan, welcomed the order.

“Discovery in this case, including the depositions given by Ivanka Trump, Donald Trump Jr. and Eric Trump, made clear that Donald J. Trump himself was the architect, principal actor and largest beneficiary of the fraudulent scheme to endorse and promote ACN in exchange for secret payments,” Kaplan said on Friday. “That is why we proposed this stipulation in the first place: Donald J. Trump and the company he used to carry out the scheme, The Trump Corporation, are the right defendants as we move toward a jury trial.”

Judge Schofield previously set a trial date in the case for Jan. 29, 2024, on counts of fraud, false advertising and unfair competition.

The order also states the younger Trumps’ discovery responses and deposition testimony can be used as evidence in connection with dispositive motions and at trial against the remaining codefendants in the case: Donald Trump and the Trump Corporation.

From 2005 through 2015, Trump and three of his three grown children appeared in promotional television ads, at events and in magazines touting the telecommunications company, which offers business seminars and encourages enrollees to bring in new recruits.

In a 2018 federal class action, four investors who said lawyers for the plaintiffs argued that the Trumps misled them to believe they were endorsing the company based on an independent assessment of the company rather than in return for large payments.

According to the complaint, ACN charged investors $499 to register with the promise that they can earn commissions from selling products to customers at small “motivational rallies.” The enterprise works by having recruits identify leads by hosting small events for family and friends, and “small motivational rallies” where a DVD is shown to encourage investment. Multiple versions of the DVD included Donald Trump’s personal endorsement. Investors allegedly made back less than 10% of their investments.

As Trump emerged as the Republican presidential frontrunner in 2015, he claimed to “know nothing about the company” and denied he was paid for his endorsements. But the complaint noted that ties between ACN and the Trumps remained.

In 2017, ACN sponsored a hole at the Eric Trump Foundation’s annual golf tournament, Curetivity, and held a celebrity golf tournament of its own at Trump National Golf Club in Moorseville.

On Tuesday, the court heard DT's $250M fraud appeal in the Manhattan Appellate Court. The appeal is to have the case thrown out.

"The appeals court did not say when it will rule."

It says "adjourned" for yesterday's hearing date. The latest document is a joint letter of March 20th that says the parties are going to attempt to settle through mediation.
 

A New York appeals court on Tuesday narrowed state Attorney General Letitia James' civil lawsuit accusing Donald Trump and his family business of a "staggering" fraud, and dismissed all claims against the former U.S. president's daughter.

The Appellate Division in Manhattan said statutes of limitations prevented James from suing over transactions that occurred before July 13, 2014 or Feb. 6, 2016, depending on the defendant.

The court also said that because all allegations against Trump's daughter Ivanka Trump were too old, all claims against her should have been dismissed as untimely.
 


Michael Cohen may try to call on Donald Trump Jr. at an upcoming trial in the fixer’s suit claiming Trump Organization should have to pay for the legal fees that piled up on the job.

The trial is set to start July 24 in Cohen’s civil case asserting the family real estate company reneged on its promise to cover him legally in various probes of then-President Donald Trump — including by Congress, Special Counsel Robert Mueller and New York Attorney General Letitia James.

Cohen appeared in Manhattan Supreme Court Friday for the final hearing before trial, where he’ll be seeking nearly a million dollars in compensation for bills he racked up after Trump Org. stopped paying his legal costs.
