Conley sentenced to 23 years in poisoning case

"UTICA — Just before being sentenced Thursday, Kaitlyn Conley had two words for the court:

“I’m innocent.”

Conley, convicted of manslaughter in the death of her boss, was sentenced by Oneida County Court Judge Michael Dwyer to a determinate sentence of 23 years in prison with five years post-release supervision. She could have been sentenced to anywhere from five to 25 years.

Conley, 24, of Sauquoit, received the sentence at the end of a roughly two-and-a-half-hour hearing in which both sides made statements. An appeal is expected...."

Attorneys have filed a motion seeking to overturn Kaitlyn Conley's 2017 manslaughter conviction, arguing her previous lawyers failed to properly represent her in two separate jury trials.

Pelli has not yet returned a call for comment.

"Just because someone loses a trial doesn't mean a lawyer is ineffective," McNamara said, when asked about the motion Wednesday. "If that was the case, our justice system would come to a screeching halt."

McNamara said a motion like this one isn't unusual, particularly for those serving long sentences. Conley was sentenced in January 2018 to 23 years in state prison.​

I understand, but we can't assume anything, and without providing a news link, it isn't conclusive if the Judge denied her latest appeal. They were last in court not that long ago, November 2023. The Judge was going to take awhile to make his decision. I agree, @Tarik, the Judge probably decided to deny it, but I'd sure like a news link saying that.​

Both attorney's requested transcripts of today's proceedings, which they will be reviewing, Judge Dwyer has reserved decision.

Just watched the Hulu 3 part documentary. I didn’t really learn anything new. I did like the one juror lady from the 1st trial and wished they had one from the 2nd. I still think she’s a liar and is guilty. I do go back and forth on whether she wanted to kill Mary or just make her very sick, but based on the research found in Katie’s phone, she definitely knew just how toxic this drug was.
She does seem very smart but tries to play that down with her claims that she didn’t understand the cops and stuff.
They didn’t include the gift card purchase, which I think really shows that she was the one that bought the poison. I’ve seen them talk about it in other shows and I believe it was mentioned in the book.
We Thought We Knew You by M. William Phelps is a great book about the case. I enjoy his true crime writing and he comments in this documentary.

@TDoc72, thanks for the run down on the Hulu 3-part documentary. I didn't realize there was one, and I'll watch it sometime. It wouldn't surprise me if there's nothing new to learn, just because usually if I follow a case closely on WS, I learned it then. MOO, I think producers and even attorney employees come to WS to learn key points or how jurors may see it. There's a book too... thanks for the heads up. Can't remember if you're following this case, also about the drug Colchicine.​

Two key witnesses speak in Bowman hearing Wednesday

Connor Bowman, the man accused of fatally poisoning his wife in 2023, went before a judge on Wednesday.

In the end, Bowman’s legal team argued the search warrants that lead to Bowman’s arrests didn’t include valid probable causes.

The judge asked the defense to clarify where probable cause is missing in the warrants by September 23, before the next court date is set.​

You understand it correctly. MOO, it's not over with yet, like I said. They got the okay in May, so it's getting time for those oral arguments to either have been presented, or time for them to be presented. September 17th would be 4 months since the permission was granted, but I guess it depends on when the brief was filed. It's been nine years since Mary Yoder died from being poisoned. There were two trials and now this.

In February 2024, Oneida County Judge Michael Dwyer denied Conley’s motion with the CPL 440. This decision, too, was appealed.

“When you get a denial for a 440 motion, you’re not entitled to an appeal,” Swartz said. “You have to ask for permission from the Appellate Division for an appeal. We filed that motion around the end of February, and on May 17, I received the decision that it had been granted.”

Following this, Swartz will have six months to file a brief, according to the attorney. After its been filed, oral arguments are expected to be held anywhere from three to four months later.​
